At Dr.Marcel Stern, I got an appointment for June 29th. For kids, the charge is $100, for adults b/w 280-350.
They specifically mentioned that they are no longer entertaining Walk in any more. They used to till 12:00 noon today.
All doctors are swamped.

The USCIS confirmed that it will continue to permit interfiling of I-485s when a person obtains two I-140 petition approvals. Interfiling is essentially the transfer of a pending I-485 application to adjust status from one I-140 petition to another filed for the same beneficiary. Examples would be when there is a successor employer, or an I-140 petition filed by a new employer or with the same employer based on a new and different job offer. This eliminates the need to re-file the I-485 in many situations, if there is a second I-140 petition to support the pending I-485.
So if your second I-140 is approved you'll be able to interfile if you want to but I do not see the problem with filing the second I-140 while one is already pending.

You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

Background : EB2 India PERM applied in Oct'08.PERM RFE Audit notice received on Apr '09 and replied immediately by the lawyer. Currently as per iCert labor website Audit cases being processed as of 07/31/2010 are PD July 2008. My H1B six year completes on Jan 2012.
Question :
- When do I realistically expect any decision on my PERM audit?
- Should I apply for fresh PERM Labor in order to meet the 365 days prior labor applied rule for H1 extensions or should I wait for the audit to be decided? My spouse has EB2-I PD OCT '07 with 140 approved ..waiting to file 485.
- In case I decide to wait,what will be my status if the pending PERM currently under audit filed gets denied? What are my options for further H1 extensions in that situation?
- If advised,when should I plan to file my fresh PERM labor? My checks were cashed today.I found the LIN numbers on the back and checked the online case status.It says, we received your application for I-485 on sept 18th.:eek:
I dont understand.my attorney mailed it on July 23rd. why almost 2 months gap?.

There is no such status as "out of project". Based on the fact that you do not have a job and your employer is not paying you, you are out of status already. It is your employer's responsibility to pay you no matter you have a project or not. In fact, it is because of cases like yours that USCIS has raided those desi body shops and put them behind bars.
My advice to you is change your stauts ASAP to F-1 or if you are married, then to H4.
If the bove two options are not something you can do, please leave the country.
I already put a transfer in Oct 2008. since I am not sure about H1b approval of old company.
Its in pening status.
Out of project since one month.

I don't think the state is involved, but its the institution that makes its own set of rules. All the community colleges in the state of Arizona accepts both H and L status as proof of residency.

I did a blunder by not renewing my passport and travelled to India in August 2007, while returning to US , CBP officer in Chicago issued my I94 only till the expiration of Passport , which is March 2008 . My VISA was valid till Jan 2010
I tried to argue but no use his quote "You can not stay in this country with expired passport" as if there is definitive rule

Moral of the Stroy "Renew your passports as soon as you can"
I went to Chicago airport after renewing my passport to renew my I94 , but the officer bluntly denied and asked me to visit USCIS local office . Again just few months back my friend was able to change his I94 in the same airport , looks like I m not that lucky
I contacted my Lawyer on the situation and he suggested either to apply for I94 extension with CIS or travel to Canada . Applying with CIS with 300$ fee doesnt make much sense to me so I decided to fly to Canada and got my new I94 -- Yahoooo atlast valid till Jan 2010
Again in the Tornoto airport officer offered me to keep the same I94 as I did not leave US for more than 30 days , After few scary moments I requested that I needed the new I94 and explained my situation and got it.

Filing seperately is probably not a good option. Since spouse on ITIN, means no income. Given this, the amount you loose on deductions for single will morethan offset the $600 you get.
So one should file joint, and wait for SSN and claim the rebates. I think you can claim the rebates anytime within 3 years. Just sharing what I read in other related threads before and made sense to me.
All said, I still don't know why they ask SSN. Some say for better disbursement of funds etc. But that doesn't make any sense to me. They always make life harder for aliens. Probably they couldn't find a solid excuse to deny rebates to H1B-SSN's. Otherwise this would have been a bigger curse. Most of us got lucky, or they just felt spouses with SSN more likely either both working or primary contributed taxes for many years, so its okay to give back some. whatever reasons behind it..

What is Ron basing his prediction on... I am not sure the trend says so... Can anyone please share his logic?
Well if you read the post by ron, someone has already asked him, on what basis do you predict the date and he simply has replied like this,
"I'm basing that date on what I've been told by the Visa Office."
May be he is in constant touch with the folks at USCIS and not DOS. But one thing if you notice, this guy (Ron) has been correct in whatever he says in the past......
I am in EB3 but i am happy that things move forward for atleast EB2 folks because we can get as many people as possible out of the queue..... with hopes that one day eb3 would move forward too :(

My response was to that point. If you still argue that, I think you might need to clarify things at your end.

He resigns from his primary party as soon as he becomes the speaker. This is not the case in US congress, speaker of the US house of congress is a partisan leader. I filed mine on May 12 and sent to Phoenix Lock box and had the same issue. My checks are not cashed and am going through the same pain as you do. My lawyer suggested its not unusual to have these delays and it could take upto 4 weeks for the receipt notice to come. I am still tensed as the checks are not cashed and there is no receipt for the renewal. Please let me know how you are proceeding or find any new info

I am in the same situation, my application was received on 5/11/2010. Checks are not chashed yet, my lawyer advised me to refile online after one week if filing fee is not an issue. She thinks the delay is unusual and if we are nearing the expiration date, just re-file online.

There has been Governors conference for the last few days and reportedly the Utah Governor Jon Huntsman Jr. and Arizona Governor Janet Napolitano asked Western governors to:
* Oppose blanket amnesty to all undocumented workers and support "appropriate sanctions" for those breaking the law.
* Urge Congress to avoid creating incentives for more illegal immigration by "creating unnecessary hurdles and lengthy delays" for those wishing to immigrate legally.
* Call for full funding for law enforcement and security along the southern U.S. border, enforcement using "cutting-edge" technology, better coordination with law enforcement agents and construction of a federal correctional facility to house illegal immigrants convicted in state courts as well as reimbursement to states for incarcerating illegal immigrants.
* Request full funding for processing employment-based visas; eliminating visa-request backlogs and increasing the number of visas to meet U.S. industry needs, especially in high-tech, bio-tech and seasonal-based industries.
* Establish a guest worker program that will include background checks to help supply workers where there are shortages.
