    Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)

    I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!

    To Admin: Please start seperate thread for each consulate, where people can share their experiences and ask specific questions.

    Now coming back to my question. My labor is approved and I-140 is pending.
    I have declared that my employer is applying for my GC.
    Should i carry documents proving that my I-140 is pending and that labor is approved?

    My 6th year H1-B will be expiring in Aug 31 2007 and i have valid I-797 approved upto that date. I know i can get 3 years extension anytime with approved I-140 or atleast 1 year H1-B extension.
    Will that be a problem at all? I am asking this because, the numbe rof months for which stamping will be valid will be just few months.

    I got my visa stamped in june 2006 and expiry was august 2007. Usually your employer will never give you any Lc or I140 approval docs. Good luck trying to get those :). They dont ask for any docs related to permanent residency as long as you have a valid 1797A.

    I got my EAD today...Even i received my Wife EAD also...Mine is sent to NSC on july 2nd...I received EAD's from Texas Center...I think my application was transferred to Texas...I have approved I-140 from Texas...Are receipt numbers for EAD, 485, AP are in serial? I haven't received receipts yet...I filled G-28...my attorney did not receive my receipts...I don't know what is going on...

    This case is pending with AAO from Nov. 2009.
    It will take 24 months to get a result.
    Meanwhile he is going to start PERM in EB3.
    Got RFE before the denial.
    Replied with professor letter and premium evaluations ($750).
    Still USCIS insist with EDGE database. It is private, no govt backing, but they are going by that findings.
    Lawyer is hopeful for the result, he have 6 year college, they questioned about the 3 year degree, but the labor is for masters, He have masters (2 year) and total 4 year combined bachelors(3+1).
    They no need to look the bachelors, when the education requirement is masters.
    The evaluator give 20 US universities name which gives masters degree after 5 year course (5 year integrated degree).

    Agree with what you pointed out but shouldn't the attorney know this?? If this cannot be apealed this individual has lost valuable time and money (attorney looses nothing). I am curious to know what the attorney says about this:mad:

    I am also in similar situation. My lawyer told me that my H1B status is maintained for 240 days after my visa expires. But you would need a H1B approval and visa stamping to enter country again.

    You are mixing two things here.

    1. You are in valid status as long as Extension (or Change of Status) is pending?
    2. If H1-B Status Extension petition is pending, one is allowed to work for up to 240 days for the same employer as long as extension is pending.

    Please note that one can not leave the country while extension (or change of Status) is pending, otherwise that petition is considered to be abandoned.

    I am in a similiar situation. My 485 was approved and my wife got her physical GC but I did not get mine. I took Infopass and the IO raised a SR. My case is from CSC to NSC. I got a response to the SR that my GC was sent and it might have got lost in mail and to file I-90. I called uscis customer rep, talked to 2nd level IO who mentioned that my card was never created and he will raise a SR mentioning the same.
    Today I got 2nd FP notice mentioning that I did not give FP for the first one (I gave FP ahead of the scheduled date and verified with FBI if my prints were uploaded or not) and to appear for FP on Jan 11th, 2011. I spoke with a IO on the day this FP notice was sent and IO asked me the date I gave FP and he mumbled some numbers and checked something in the system. He said he had fixed the issue and ignore the 2nd FP. He mentioned his name to me. I should have taken his extension as well. I hope I get the card now or else I need to take Infopass. I emailed nsscfollowup with the scanned copy of the first biometrics notice which has the stamp from the ASC last week only.

    I have n't contacted senators and congressmen yet and did not email the scopsscata yet

    After the Floor Debate the bill goes to White House or again there has to some measures taken from Senate???? I know there some initiative taken in Senate (last year)..

    As per USCIS official report as of end-August, there were more than 500,000 pending AOS applications:

    So, if we estimate that there were about 100,000 more AOS applications receipted during September and October, that is a total of 600,000.

    I recd supplementary forms to I-693 for my wife and I from the Civil Surgeon earlier this week. Along with the supplementary forms I recd two envelopes (one addressed to me, and the other one to my wife) that had DO NOT OPEN written on them. I sent these to my lawyer's office.

    I called the doctor�s office and this is what I found out. Apparently, when the doctor had first given us the sealed envelopes (in June 2007) she didn�t know that the Supplementary form needs to go with the certification she provided us in the sealed envelopes. We sent the sealed envelopes with our Concurrent I-140 = 485 application recd at NSC on 7/2/07 (as per UPS). Now, some of her clients have recd letters from USCIS asking for the Supplementary form, so she has sent the same out to all of her clients regardless of them getting a letter from USCIS. I hope our application doesn�t get rejected due to this; no checks cashed as of today.

    My lawyer's response: No the application should not get rejected because of this...however we will submit the supp doc's report to the USCIS when we get the receipt notices.

    Anyone else in the same boat? Is this something to worry about? See signature for more info...

    We got our EAD in the mail today - We are late June filers (29th June) and got our receipt numbers last week, - I have some q's-

    -Can one get EAD without completing FInger printing? In the finger priniting colum on the EAD it says - not available, Would that matter?
    -How does one activate his/her EAD?
    -Have any other late june filers already got their EAD?

    There is no second opinion that USCIS is wrong on morale ground for July VB issue. But I am not sure technically, they are right or wrong. They interpreted the law in their convenience. Here is what I see
    What ever visa left for year 2007, they requested to use for July 2007. They kept ready all pre-adjudicated applications and assigned visa numbers on July 1 (Sunday). No one can stop them to send green card approval notice for visa assigned cases later. In a rush, they assigned visa number to few cases whose security check is still pending (technically this is wrong). They realize their mistake and now checking all the cases which are assigned visa numbers on July 1 whether security check is cleared or not. They are now approving the cases (with a slow speed) whose security check is cleared and assigned visa number on July 1. They are returning visa number which are assigned to cases whose security check is not clear.

    This is my understanding.



    Just trying to sum up the situation from USCIS perspective...

    1) DOS releases July visa bulletin making all EB categories current (except for other workers)...hoping to force the USCIS to adjudicate cases and avoid wasting visa numbers as in previous years
    2) This infuriates USCIS, and for whatever reasons (this has been debated enough already), they decide to use up all the FY2007 visa numbers in June itself and then force the DOS to revise the July bulletin in June itself...so no one can file in July.
    3) Unfortunately, they run into issues going through with their plan of using up all visa numbers in June
    4) July 1st and morning of July 2nd...they still are working frantically to use up the numbers to avoid new July filers. But by now, it is July already and they have failed in their original mission (see 2 above). Now they start panicking and do some dumb stuff (in violation of their own regulations). They approve I-485's of some folks who were ready for approval (processing complete and FBI check cleared), but whose dates were not current. They also pre-requested some numbers for folks whose dates were current, but processing was not complete i.e. FBI check was not cleared.
    5) Late morning July 2nd: By requesting all available numbers from DOS and exhausting FY2007 quota, they forced DOS to revise the July bulletin, which was unprecedented.
    6) July 5th and later: It is now post July-2nd, and USCIS still has cases for which they pre-requested numbers. Now the problem is that even if the FBI check comes through for those cases, they cannot approve them because technically, all numbers have been used up for FY 2007. So they start returning numbers to DOS. They also decide NOT the send the applications of people who filed on July 2nd or later back while they decide on the next course of action...

    I think this will have major implications for both USCIS and DOS. The key for USCIS was to exhaust visa numbers on or before June 29th to achieve their obejective without repercussions...and force DOS to revise the bulletin in June itself...and they failed miserably at it.

    And now they will have to pay. I know some people are thinking please let USCIS just sweep it under the carpet and just allow us to file our cases...no harm done. But I diasgree...what they have done is shameful. And they should be made to pay for playing with our lives. They should never be able to even think of doing something like this again. And their operations should have direct congress/DOS oversight so they cannot get away with snail-paced processing wasting visas ever again...
