Isn't it a relief? if the officer calls you for interview, checks your documents and says approved but no GC till PD current? I can live happily with it for couple of years atleast without thinking of GC. The feeling of getting GC in future 100% is almost equal to having GC today. You can change jobs on AC21 without fear and use EAD and AP full force and forget about renewing H1b's

How do you know that you case has moved to local field office?
For July filers, to manage the work load, USCIS forwarded applications (so that they can process EAD, AP and 485 receipt in a timely fashion) to CSC or VSC. For example, I applied to NSC but was forwarded to CSC and now they are back to NSC. My 485 status currently shows exactly same as your daughter's one.
It means that THE CASE HAS BEEN TRANSFERRED FROM CST TO NSC. NOT A BIG DEAL.
Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.

Visa Stamp in Passport: 13-Jan-2007 (I94 in passport expires on 1/13/07)

In this scenario, if I goto India, say in Feb, get my visa stamping done, what will be the validity of my visa in the passport?
1. 05-Jun-2007 to 04-Jun-2010 as stated in my 3-yr extension or
2. the date I went for interview till 04-Jun-2010??
If its the former, then how can I get into US during March '07 as there will be a gap in my visa dates in the passport?

Irrespective of what Ron Gotcher or anyone says, the matter is left to the discretion of the adjudicating IO. One IO may be okay with even 50%-70% hike, while another may start frothing at the mouth for anything over 30%.
I remember the time of July VB fiasco so many members posted here that my hotshot attorney has told me DOS cannot retract the VB in the middle of the month. And guess what, they did it twice! Point of the matter is AC21 ( at least in theory) is decided based on the famous and widely read Aytes and Yates memos. And these guidelines give the IO the descretion to decide 'same or similar job', if there is a major difference in salary. In case IO decides to reject the case the applicant has to do MTR and/or appeal in the court.
It all boils down to one thing EAD + AC21 is not poor man's GC. It's just an illusion which is losing it's shine with each day. If you are worried about a hike now, have you considered the future. Will you continue to work with same level of salary 5-6 years from now?
We need to work to get the real thing fast.

Sorry to answer you question late.
I am the July 2nd filer as well. It took me quite some time to figure out the case numbers on back of the checks. All start with "WAC" means California Servcie Center. Guys,
I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.

Did they pre-approve and assigned visa number to certain application as on July 1 and going to send approval notice later???? If they haven't approved cases and assign visa number before July 2, how come they process and approve pending application after July 2?????

The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.
By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.

I double checked with my attorney , either or AP or EAD usage will change your status, ie H1 is no more valid.

I have filed 140 and 485 in July 2006, EB2 file concurrent at Nebraska service center. So far no word yet.
I would like to know anyone get approve either 140 or 485 from Nebraska service center to get an idea the time frame on my case.

As all the I-140's from CA and VT were transferred to NSC in April so it is slow. I guess they are currently working on cases filed in the month of April. If your I-140 is not approved by December then you might want to consider converting it into Premium Processing so that you can avail the benefits of AC21 once your I-485 is pending for more than 180 days.

Greencard and H-1B expenses should be paid by the employer. Anything else is illegal. I am requesting admins to close this thread.
I think H1B expenses must be paid by employer. However, GC fees need not be... as GC is an optional element (employer is not required to process GC for every H1B employee).

Actually I just wanted to point out the generic indifference shown towards the feeling of people of India by mainstream western media and governments - the long wait in immigration queue and ignoring the plight of Indian legal immigrant aspirants , setting a per country quota ignoring its population representation is just an extension of the same mentality... and I also wanted to point out how this mentality of deliberately ignoring Indian feelings and values is going to become increasingly irrelevant in the changing world where BRIC countries will wield increasing power.

So they will say this is the reason that the country quota should stay.
This way your innocent statement can be used against you and us. This was my concern against these type of nor immigration and matters related to only one country/region/religion being posted in this forum.

I saw some of your suggestions in this thread. I need your suggestion on my case. I applied my 485 in July 2007 with an already approved eb3 I-140 (PD: May 2004). At that time, my 2nd EB2 I-140 was also in process but since I was not sure so I applied 485 with eb3 I-140. Later, I received my eb2 I -140 approved with the same PD of May 2004. Thus , I was able to capture my original PD (most difficult task!!). Since then, I and my lawyer have been sending letters to USCIS to interfile my eb2 140 with pending 485. We have not heard anything back from USCIS so far. I had opened congressional enquiry also and they also could not get answer from USCIS. But, congressman office told me that USCIS indicated that they will take most favorable 140 while adjudicating my case. They also suggested me to talk to them again when my pd is current based on eb2. Can u suggest as to what else can be done in this case? I appreciate your answer in this regard. They also suggested me to talk to them again when my pd is current based on eb2. Can u suggest as to what else can be done in this case? I appreciate your answer in this regard. I am sorry you made BA as a choice. Kindly do not support any airlines/countries that require visas for Indian citizens in transit.
