Currently a million employment immigrants and their families are stuck in a backlog due to insufficient numbers and USCIS processing delays. Though Immigration Voice is interested in seeing legislative fixes passed by US Congress, it may take a long time for an agreed immigration reform to pass. Considering this fact, Immigration Voice has proposed the following points to President Bush's administration to fix some of the issues administratively. I urge you to support our cause by writing a letter to President Bush, as follows, to implement these administrative fixes without further delay.

1) Recapture 218,000 unused visas wasted over the past few years administratively, in line with Congressional intent of providing 140,000 visas annually to our community.
2) Flexibility in the USCIS interpretation of "same and similar" jobs, to allow promotions and job mobility. Current USCIS rule is restrictive and pushes the applicant to the end of the line, if they accept promotions.
3) Allow filing of 'Adjustment of Status Applications', even when visa numbers are not available. This will not create an increase in visas, but will allow a number of immigrants to avail the benefits of changing jobs while waiting for their visa numbers.
4) Increase the period of Employment Authorization Document (work authorization) and Advance Parole (travel permit) to 3 years instead of the current practice of 1 year. This will reduce the burden on USCIS and on immigrants. It will also make travel to an immigrant's home country easier during emergencies.
5) Allow visa revalidation in the US as before. Currently, immigrants have to travel to their home country to renew their visas. If it was performed here in the US, it would be helpful in making it easier to travel back and forth during emergencies.
6) Restart premium processing for I-140 applications. Now that USCIS has cleared the receipting backlog, premium processing should be made available. Without it, many immigrants are unable to extend their stay beyond 6 years, if their labor certification was applied for after the completion of their 5th year of stay in the US.

Ask that customer service woman to give this to you in writing.
Yes, They assured me that the plan is for unlimited...also covers all the networks (Initiall y some of them thought that it's only applicable for certain networks)....there is no restrictions at all...any ways I will re confirm with them.....
The only problem with them are taxes, there are other VOIP phones in the market that they are charging just 3-4 dollars as taxes, whereas vonage is charging more than 8 dollars which is killing part.....

One must not have immigration intent at the time of applying for F1 visa or entering USA using F1 visa. However, intent can change over time. Please google for 30-60-90 day rule.
In fact, one can file for I-485 after 90 days of F1 visa status, if he/she is otherwise eligible.

I have a couple of issues guys and need your advise:
1. I have a valid H1b visa stamped on passport till June 2007. I and my spouse have EAD and AP as well. Upon my return from India in Dec 2006 the Immigration Officer at the POE did not let us use our h visas, H1 for me and H4 for my spouse and instead asked us to use AP to enter into USA and he stamped my AP and the I-94 showing my entrance as Parole and valid till Jan 22, 2007 ( My AP was valid till that date only). He said that I am not cancelling your h1. What does it mean? Am I no longer on H1 visa? What would happen after Jan 22, 2007 when my parole expires? I have filed for a new AP though but have not recieved it so far.
2. My and my spouse's EAD is expiring on Jan 22, 2007. We filed for the EADs in Nov and waiting for it. In the mean time we got a notice for finger prints. After the finger prints, our notices were stamped with the date on it. The stamp reads as "LIFE ACT PROCESSING STAMP" where as on all the previous occassions of finger printing, the stamp would read as " BIOMETRICS PROCESSING STAMP". Moreover as I have registered on line to check the status of my petitions, usually after the finger prints the date used to change when some thing happens to one's file like getting the finger printing done etc. but this time nothing changed and the date is showing up the same when I initially submitted my application.
Any Idea about this folks??? Time is running out for me.

I think this is very well said. As much as I'd want the predictions to come true, somehow I sense the same observation as below. It appears this has been said in the past, but all we see is very little movement. Secondly, as I recall, DOS had hinted that there'll be advance for EB2 India, I don't know if they mentioned EB2 China? Has anyone seen DOS themselves talking about EB2 C? The reason I am raising this here, is that maybe when DOS had said "substantial movement for EB2 India", did they mean that India will move to China's date (From May to Jul 06, 3 months movement)?

Also I have analyzed that people who have a date in 2008 somehow predict that the dates might move to 2008 and people who have a PD of July predict that dates will move to August . This is just an observation and nothing more , and if you go through the threads thats exactly what you will see.
I will be equally benefited as you all will if the predictions come true , but be well prepared for a major heartbreak also like last year .
While it takes a lot of effort from some of the members to crunch such numbers I would be first to extend my sincere gratitude to them for doing this , I would also recommend you all to take the analysis and predictions with a grain of salt and not to raise your hopes too much on these predictions.

If that is the case you have legitimate reason to take this matter with your local congress man if their legal cannot clear them.
Follow the suggestions of experts in this thread. I suggest you to contact your local congressmen. They would definitely help as in my case they did to expedite EAD renewal.

I must say y'all are doing a commendable job. I have contributed $$ and would do so more in the future if needed.
I remember Senate Majority Leader Bill Frist saying that the comprehensive immigration reform bill will be handled in February 2006. Is the schedule still the same. I am keeping my fingers crossed and hope that everyone of us stuck in this immigration hell-hole will get a relief from the comprehensive immigration reform bills that (hopefully) will be passed in 02/06.

Look at this way.. We are not asking anything unfair or outrageous. All little provisions that makes our lives easier. Some are even basic human respect issues and involves trust. As highly skilled immigrants, we deserve this.
Even if nothing happens...what have you lost in this campaign? This is the easiest campaign that IV has had. Print the letter out, sign it, make a copy and mail it to the president and IV.
In fact if you are hurting so bad..take 20 printouts, get 20 ppl to sign it and put their name and address, maek copies and send it on.
this way at least you are doing something.
Remember the flower campaign? there was a flood of flowers. now lets make it a flood of letters.

As long as you can prove that you have been in legal status all along, there is nothings stopping you from applying for AOS based on marriage. However, none of us here are legal experts on such niche immigration issues since there wouldnt be too many of us in that situation; so consult an expert attorney asap. In such matters I would not go by advise on a public forum.

Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

USCIS and or DOS don't quiet yet understand the full implications of this flower campaign. They still are feigning ignorance or adamant in their analysis of the july fiasco.
Untill this flower campaign is further carried by major newspapers, we still cannot declare full victory.
Yes, USCIS chief fully knows that flowers were sent as a token of protest and they will not know the full impact untill they see them.
I am telling you guys, the USCIS is gonna SERIOUSLY think "Lets keep screwing these guys and getting free stuff AND free publicity"

To me it seems a genuine demand, We need to bring this arguement/demand forward in very rational way keeping emotions aside.
