please read my message you quoted. I wrote nothing in support of or aganst the letter. Nothing they (earlier posts) say is going to make the dates go back or forward. All the poor folks are trying to do is maybe vent out their frustration. What difference does this make to you? No action is going to be taken based on one letter. You are safe, please enjoy your current date status.
I can see the writing on the wall about where IV would be once most of Eb2 get their GC. It would almost stop existing.

I am currently pursuing some initial draft plans with some legal representation, so that a sweeping case may be filed to end this unfair practice. We need to plug this EB3-to-EB2 loophole, if there is any chance to be had for filers who have originally been EB2.
More than any other initiative, the removal of just this one unfair provision will greatly aid all original EB2 filers. Else, it can be clearly deduced that the massively backlogged EB3 filers will flock over to EB2 and backlog it by 8 years or more.
I also want to make this issue an action item for all EB2 folks volunteering for IV activities.

In Congress circles, however, a Gandhi is a Gandhi, and will smell just as sweet (with due apologies to Shakespeare).
Back to the learning curve and the acronyms that everyone's so concerned about. Here's the first lesson in the Scamsters Dictionary. 2G led to CAG which in turn led to CBI which took it to DoT. Well comparing India to Israel is not going to be justified at this time cause Israel has had a offensive stance right from its inception whereas India has always been reactive, and in the long run, i beleive that has paid off.
However at this point we have to make sure our neighbours take corrective action though to be frank, i am not sure they are capable or have the potency of bringing about the changes cause at the ground level all those dangerous elements (some who have gone and taken refuge from India), enjoy not just support from the intelligence and the army but also from some locals and roam around freely
So in short it is a rogue country, frankly even the super powers are not in control of the situation there ........as some factions are loyal to the superpowers, some to the dangerous elements and some to regional powers, and each one of them is being used by these powers to carry out attacks to various countries around the world...and implment their respective agendas which are contrary to one another.....
What is the strategy for India
In the short term i would say 'Our Sardar' (chieftain...i firmly think this time 'The Sardar' is leading from the front...and not being remote controlled by the lady ) is doing the right thing, he is garnering global support (he first tried the super powers and now is in touch with the regional powers also, and has got PC a highly efficient resource to strengthen internal security), at the same time watching the response from our neighbour, who are talking of war but are trying and i am saying trying to bring about some positive change (how much of that is possible i am pretty pessimestic due to reasons specified above...no single control or point of contact).
In the long term there has to be a solution to the neighbouring country problem either they revamp and reform (after 60 years of being the bad guys...hit men.... for various powers world over), or look at the possiblity of breaking down the wall cause then we can try and clear up the mess......

As far as I know, yes it is...I remember doing H1 myself few years ago and the LCA form has prevailing wage rate section. As we know, the wage rates differ from place to place and so since H1 is based on prevailing wage rate on LCA, then H1 is also location specific. Even though LCA form has been changed since then, I think it still holds true...
I am sure that per law or whatever when you filed for a h1b for a location A and the petitioner moves to a location B, then I believe you have to file an amendment for ur h1b to that new location...the question is Iam not sure how many people care to do that

I guess the only way US of A will ever understand its worth in the world is when: (I am just referring to hypocritical US of A'ans, there are good people too.)
1) India and China stop sending so many Engineers and doctors.
2) China and south-east Asia stop supplying Nike's and toilet paper to Walmart's
I guess the positive side of this H1 bill will be further development of Indian and Chinese economies via decreased brain-drain. I guess it already slowed down (to a trickle?!) quite a bit in the past few years and I Hope this bill plugs the leaks too. Hurray! No more brain drain from India and China.
Why didn't this happen a few years ago and I wouldn't even have had any regrets being in US of A ever. Yikes!

There are two ways to give coverage to an issue. One could be decided based on how many people are affected, second could be based on how may people care for that issue.
If you go by how may people were affected, I'll say Palestine has a population of how much, say less than 5 million, but it has the world attention for over 50% of the entire world affairs coverage. For world affairs coverage its Palestine v/s rest of the world, but it seems according to you thats not enough. Why should Palestine or for that matter Israel be so important that it should get so much coverage or attention. All the religions AND HENCE THE VIOLENCE were created there. That's why its best to ignore that place so that twisted minds will not get motivation to fight anymore. But my point is, Isreal Palestine issue already gets more than adequate coverage, more so than rawanda, somalia, sudan, terror attacks in India etc. So based on this I don't think its NECESSARY to give Isreal Palestine any more attention.
But if you apply the second measure, which is how many people care about the issue, well in that case a lot more people here care about the attacks in India and a war between India and Pakistan. For that matter a lot more people on this forum are affected by attacks in Mumbai. If you go to some Palestine forum, maybe you can get more people wanting to discuss their views about Isreal there. But by law of inclination, since there more people on this site from India, you will see more people wanting to discuss about how they and their loved once are affected. If you want to discuss about paleastine, well, go right ahead, no one will respond to you because people are not interested. I am only responding to your rants and not your issue.
Loss of human life, WHICH IS OFTEN DUE TO SOME TWISTED RELIGION, is always very saddening. This is the core belief of every peace loving society and is not coming out in response to yuor rants. Infact, rants such as yours simple make a few people to tone down their expression of sorrow for the loss of human life.
There needs to be correction in your post. When Pakistanis terrorist attacked mumbai, world community blamed Pakistan and not the entire muslim community. The problem is, the way muslim community responds to such world events, due to the sense of the guilt of their twisted belief system, they think that the world community is blaming every muslim, but that is actually not how the world community responded. Also, because of the urge to defend terror attacks by a terrorist, muslim community tends to justify terrorism and terrosit attacks. We saw many "educated" (HIGHLY SKILLED) members, who were apparently muslims, on this forum justifying terrorist attacks conducted by Pakistani terrorist who happen to be "muslims". Because, the overriding factor for a lot people following islamic faith is the religion of the person performing the bad deeds. And if that person happen to be a muslim, most of you guys tend to justify bad deeds including terrorist acts. This behavior results in world community responding to you in plain and simple terms that terrorist sympathizer is encouraging more terrorism and hence you perceive that expression as if the others are branding your entire community as terrorist, but again, this is not true either. Its the direct result of your sense of guilt and your urge to be terrorist sympathizer.
I don't follow any religion. For me nation of my nationality (which could change in future) is above all forms of religions. When I will take US citizenship, my loyalties will be with the nation where my children are born and with the nation where I will become a citizen by CHOICE. Religion has nothing to do my relationship, my responsibilities and my rights in the country I BELONG. I am not saying that this is the right kind of behavior, but the pattern of behavior which is excepted as reasonable by most rationale minds. However, for you, you have to pick up a side in any issue based on the religion of the terrorist or the victims of any situation. You have no regard for the country of your birth or citizenship. Good Points. I like discussing real-estate; I'm deeply interested in it. So in that spirit of having a good conversation, here's my response:
I completely agree that buying a house is a long term move. But I disagree with some of the points:
1. Does rent always go up? No, my rent did not go up at all during the real estate boom as the number of ppl renting was low. Recently my rent has gone up only $75 pm. (love rent control!!!) So in 5 years, my monthly rent has gone up a total of $125 per month
Real Estate market is always local. Unlike the market for -let's say- rice, which can be transported from one place where it's abundant to where it's scarce easily. Real Estate remains where it is. It's also subjected to a lot of local laws, municipal regulations etc. So, any discussion we have here will NOT apply to every single location. You have to research your own local regulations/market etc.

I completely agree that buying a house is a long term move. But I disagree with some of the points:

Real Estate market is always local. Unlike the market for -let's say- rice, which can be transported from one place where it's abundant to where it's scarce easily. Real Estate remains where it is. It's also subjected to a lot of local laws, municipal regulations etc. So, any discussion we have here will NOT apply to every single location. You have to research your own local regulations/market etc.

"What we did today was momentous," declared House Speaker Nancy Pelosi (D-Calif.). "It's historic."
The bill is the most far-reaching attempt at ethics reform since Watergate, although it is not as aggressive as some legislators wanted in restricting the use of earmarks and in requiring the disclosure of donation bundling. The legislation, which had been stalled until negotiators worked out a deal in recent days to get it passed before the August recess, is a priority for Democrats, who won control of Congress in part because they had decried what they called "a culture of corruption" under Republicans.
Although it passed the House 411 to 8, the bill could face hurdles in the Senate, which is under a new ethics cloud after the FBI raid Monday on Sen. Ted Stevens's house. Last night, a group of Republican senators prevented Democrats from bringing up the bill, forcing the scheduling of a vote tomorrow to break the filibuster. Still, senators from both parties predicted easy passage by week's end.
Senate Majority Leader Harry M. Reid (D-Nev.) all but dared Republicans to try to block the proposal when it comes to a vote as early as tomorrow. "With that resounding vote in the House, 411-8, I think people ought to be concerned about voting against it," he said yesterday.
But in a closed-door lunch with fellow Republican senators yesterday, Stevens (R-Alaska) himself threatened to block the measure, objecting that the legislation's new restrictions on lawmakers' use of corporate jets would unfairly penalize members of Congress who live in distant states, such as himself.
The legislation would end secret "holds" in the Senate, which allow a single senator to block action without disclosing that he or she has done so. Members of Congress would no longer be allowed to attend lavish parties thrown in their honor at political conventions. Gifts, meals and travel funded by lobbyists would be banned, and travel on corporate jets would be restricted. Lobbyists would have to disclose their activities more often and on the Internet. And lawmakers convicted of bribery, perjury and other crimes would be denied their congressional pensions.
"These are big-time fundamental reforms," said Fred Wertheimer, president of the open-government group Democracy 21.
Rep. Michael N. Castle (R-Del.), who failed to get ethics legislation enacted last year, noted that the final bill's disclosure rules are considerably less tough on the "bundling" of small campaign contributions into large donations by lobbyists. The original ethics bill would have required the disclosure of bundled contributions over $5,000 every three months. Under the final bill, lawmakers would have to report every six months any bundled contributions from lobbyists totaling more than $15,000. In one year, a single lobbyist could funnel nearly $30,000 to a candidate or campaign committee without any of those actions having to be disclosed.
House negotiators also refused to lengthen the current one-year "cooling-off" period, during which former House members are prohibited from becoming lobbyists.
Some conservatives latched on to the weakening of earmark disclosure rules that had passed the Senate in January. An explicit prohibition on trading earmarks for votes was dropped by House and Senate Democratic negotiators. A prohibition on any earmark that would financially benefit lawmakers, their immediate families, their staff or their staff's immediate families was altered to say that the ban would apply to any earmark that advances a lawmaker's "pecuniary interest." Critics say that would mean the benefit would have to be direct for the measure to be prohibited, and that the ban would not apply to a project that would benefit a larger community, including the lawmaker.
House members are covered by earmark rules, passed earlier this year, that are tougher than the legislation, which would apply only to senators.
"Earmarks have been the currency of corruption and, unfortunately, this lobbying reform bill does not adequately address that problem," declared Rep. Jeff Flake (R-Ariz.), a longtime critic of earmarks.
Reform groups and Democrats accused opponents of using the earmark issue as a pretext to block the other rule changes. Sen. Tom Coburn (R-Okla.), who has blocked the legislation in the past, confirmed that he remains uncomfortable with the broader bill's mandates on lobbying disclosures and gift bans.
"You could've done nothing, or some staff member could have made an innocent mistake, and now you're defending yourself in a court of law," he said. "It's nuts."
Sen. Jim DeMint (R-S.C.), another critic, had single-handedly blocked the calling of a formal House-Senate conference to negotiate the final deal, forcing Democrats to hammer out the compromise on their own. The House passed it under fast-track procedures that prohibit amendments but require a two-thirds majority for approval -- a threshold that was easily met.
Now, Reid must get the bill through the Senate without any amendment, using a parliamentary tactic that has been roundly criticized by Republicans in the past as strong-arming. But in this case, Senate Minority Leader Mitch McConnell (R-Ky.) has given his tacit assent, laying the blame squarely on his own conservative hard-liners.
"In a sense, we made it difficult on ourselves," McConnell said.
It may be even more difficult for Republicans to block the measure while their senior senator, Stevens, is under a cloud of suspicion. FBI agents raided the powerful lawmaker's house Monday, looking for evidence in a long-running investigation of an Alaska energy firm, Veco, and its alleged efforts to bribe Alaska lawmakers.
And yesterday, the House ethics committee indicated that it may consider an inquiry into whether Rep. Heather A. Wilson (R-N.M.) violated rules by calling a federal prosecutor about a pending investigation. The committee's staff interviewed the prosecutor, former U.S. attorney David C. Iglesias, yesterday.
At least eight lawmakers -- six Republicans and two Democrats -- are under federal investigation. Earlier this year, the homes and business interests of Reps. Rick Renzi (R-Ariz.) and John T. Doolittle (R-Calif.) were searched, and Rep. William J. Jefferson (D-La.) was indicted on corruption charges.

With regards to h-1b processing; if you file an h-1b and you are silent as to the work location on the i-129 and you get an lca for your h-1b office location and then USCIS gives you an rfe for a client letter.
You get a client letter in a different location and did not have an lca for that location prior to the receipt date of the h-1b filing then USCIS will deny the h-1b saying that it wasn't approvable when filed. Therefore, because of this USCIS is essentially saying that you are only getting h-1b approval for the work location specified in the petition when it was filed. It does not include a blanket approval to work at multiple locations.
Therefore; one should always amend the h-1b for different work location. Everytime you amend; you have to pay uscis/lawyer fees and are at risk of getting rfe everytime.
With regards to greencard. You don't have to work at the location required in the labor until the greencard gets approved. Most labors state job location is "various unanticipated locations across usa". If it has this statement then you are covered and don't have to locate to the office of the company; you can work in any location.
If there is not such an annotation in the labor then to make it 100% legal you should go and work in the location covered by the labor. However, as the baltimore decision stated; you can use ac21 for a different locaiton with same employer. Therefore, if 485 is pending more then six months and greencard gets approved; you have essentially used ac21 without even knowing it.
I do know a few cases where attorney did labor in location of where persons client was located. However, if person has shifted to another location then it would be impossible to justify it legally that you will go back there when greencard gets approved because that job would no longer exist.
There are a lot of complexities involved in this. It just goes to show that on a whim; uscis can do a lot of things to make peoples lives miserable.
So then lets take an example
1. Company Files H1b from NJ
2. Consultant gets a job in NY or OH or xyz state. Employer files 'amend location' each time. The work and keep on moving like that
3. Time comes up for renewal of H1, if the employer gives the current client's contract in a different location, it will definitely trigger USICS to possibly deny the extension? Since the original H1 petition did not mention this place or since they filed amend its ok?
4. When they file for amend, do they need to give a contract/client letter to justify the amend? If yes then will it trigger an RFE?
According to you anything is possible with USCIS these days.
My original request still stays. I want some advise, I will definitely use an attorney but wanted your opinion on it..

Here is the key thing - now it is crystal clear that purchasing a house cannot be a short term investment. If you plan to buy a house, you should plan on staying in (or retaining it by way of renting) the house for at least 5 years. I feel, that should drive the decision of your buying the house or not. Visa status is just a very small factor in this decision. If you are not very confident of keeping your visa status valid until you get a green card, then quit the idea of buying the house for now.
I would think even if one has a green card in hand and cannot be sure of being in one place for at least 3-5 years, then quit thinking of buying a house until you secure yourself in one place for that kind of a term.
my greencard is filed under EB3 category and it looks like a long wait. My PD is 2003 Nov and i am an indian. We've been debating whether to buy a house when 485 is pending. what is the risk involved? how many people are in a similar situation? I have twin boys and they are 3 yrs old now and it's getting increasingly difficult to keep them in an apartment. Now with housing market going down as well, we are in a tight spot and have to make a decision quickly. I would appreciate any suggestion in this regard.

o.k. ..I guess it was the beer that I had made my post confusing. what I am saying is even now home prices are inflated ..see mariners post above. GC is the main hurdle and it will take around 1.5 years to get it ...I guess by that time prices would have corrected and that is when I would buy it.

BTW even I say it depends on one's situation ....some of my friends have extended families in US or their kids are grown up and they need space (some of them are renting their basements to a relative) ..in such cases it definitely makes sense to buy a house.
if it makes u feel better ..in my view ..long term prices will go up ..at around 4% once the correction is done (2010or 2011). at the same time for e.g when prices in atlanta drop by 4.5 percent (as in last case S index) ..the real drop is 7% when you take inflation in account.
one last example ..one of my batchmates in engg had purchased a house in san diego at the height of the bubble (750K) ..when I mentioned the bubble ..he said I don't care ..I like to live high or whatever ..now his house is in foreclosure

Buying a house is good or bad based on your homework you've done or need to do. I did not buy a house until I was close to my EAD. However, a couple of my wife's friends purchased their 'home' even when they were on H1B. This happened in California where the house value is astronomically high when compared to other places (like Texas, Arizona, Virginia, Chicago, etc). They lived in their home for 3-4 years, still didn't get their GC, sold their house and collected a huge profit of $200K and moved to over Texas. This happened in early 2006. They took the risk which worked out well for them ...meaning they were constantly on projects.
You gotta live in a place like CA to make reasonable profits. I am at present in VA, having bought a house there. I bought in Nov 2006 when real estate began to crash. As I speak I didn't make any equity. How much equity will I build in the next 2 years. This is anybody's guess ...maybe 10K or 20K, assuming real estate problems are bottoming out.

Buying a house is good or bad based on your homework you've done or need to do. I did not buy a house until I was close to my EAD. However, a couple of my wife's friends purchased their 'home' even when they were on H1B. This happened in California where the house value is astronomically high when compared to other places (like Texas, Arizona, Virginia, Chicago, etc). They lived in their home for 3-4 years, still didn't get their GC, sold their house and collected a huge profit of $200K and moved to over Texas. This happened in early 2006. They took the risk which worked out well for them ...meaning they were constantly on projects.
You gotta live in a place like CA to make reasonable profits. I am at present in VA, having bought a house there. I bought in Nov 2006 when real estate began to crash. As I speak I didn't make any equity. How much equity will I build in the next 2 years. This is anybody's guess ...maybe 10K or 20K, assuming real estate problems are bottoming out.

I agree that innocent civilians are getting killed which is very sad. I always had a soft corner for the Plaestinians and was horrified to see the massacre in Jenin some years back. But now Hamas is the legit government in Palestine. They are responsible for their civilians. Hamas cannot fire rockets on another country. Israel in this case is right in acting against Hamas. If Hamas was not in government then it would have been wrong but since they are the govt ,Hamas is responsible for the killings of these civilians.

However, unlike in Tunisia, Egypt, or Libya, security forces in China quickly locked down the proposed demonstration sites and arrested anyone thought to be a potential source of unrest. The demonstrations proved ephemeral, with many more police than protesters. It was a massive deployment of China�s public security forces that signaled not only the power of the country�s security apparatus but also the enormous insecurity of the country�s leaders and their concern about the organizing power of the Internet.
While the Internet may not have produced a revolution in China�s political system, it most certainly is producing an evolution. The Internet has become a virtual political system, providing an almost unprecedented level of transparency, rule of law, and official accountability. With over 450 million Chinese Internet users�and the number is increasing daily�information crosses gender, age, professional, and provincial boundaries in ways that Beijing often considers threatening. News of government corruption and cover-ups go viral in a matter of minutes, forcing the government to think quickly and flexibly and react decisively�not traditionally strengths of China�s political system.
Netizens Demand Change
What do the Chinese people want? Nothing unusual. They want their concerns heard and addressed. Chinese nationalists, for example, often rally support for their causes via the Internet. Anti-Japanese sentiment, in particular, has been a recurring theme among online Chinese nationalists. Periodically, Chinese nationalists have taken to the Internet and the street�often in very large numbers�to protest historical inaccuracies in Japanese textbooks and to call for retribution. Nationalists have also initiated anti-Japanese protests after recent territorial disputes in the South China Sea, perhaps encouraging the government to adopt a tougher stance in its negotiations with Japan.
Yet online activism in China is the domain not only of the nationalist but also of the political reformer. Much of what transpires on the Web in China is bringing transparency to the political system. In late 2010, Chinese netizens contradicted official reports by covering a significant environmental disaster in Jilin province, where thousands of barrels of pollutants were dumped into a water source by a local chemical plant. In the ten days that it took Chinese officials to admit to the disaster, thousands of citizens were informed of the cover-up via the Internet. They responded by purchasing a massive amount of bottled water and angrily denouncing the government�s inaction. It was only after citizens refused to believe the official stories that the government finally acknowledged the disaster and handed out free bottles of water to those in the afflicted areas. Similarly, a year earlier in Guangzhou, online transparency had caused a reversal in local government policy. Middle-class-led protests over a planned incinerator were picked up by young online netizens, who then spread the news through social media websites. Even though the activists, themselves, were not affected by the plans, they wanted the word to get out. Once enough citizens became involved, the government agreed to halt the project until a full environmental assessment was completed.1
The Internet has also become a means of holding officials accountable. In a now-famous case, in October 2010, Li Qiming, the son of a local deputy police chief. Li Gang, ran over two Hebei University students in his car while drunk�fatally injuring one and breaking the other�s leg. As he tried to escape the scene, he yelled out, �Sue me if you dare. My father is Li Gang!� Communist officials attempted to suppress information about the event but failed, as netizens from all over the country latched onto Li Qiming�s threat. Despite official reports alleging that the victim�s families were content with the government�s handling of the situation and with public apologies from both father and son, the online activists demanded (and got) more: Li Qiming was sentenced to six years in prison, his family was forced to pay over $70,000 to the families of the two students, and much of China�s online population has adopted the phrase �My father is Li Gang� as a shorthand for the widely held belief that the powerful and politically connected do not have to face the consequences of their actions.
In this way, online activism can also promote a form of the rule of law�albeit one that often resembles vigilante justice. During the summer of 2010, for example, Chinese reporter Qiu Ziming was forced into hiding after police placed him on a wanted list for writing critical stories about a local business. According to the popular netizen Michael Anti, microblogs are the most important political organizing force in China today. Anti notes that through Twitter, over 1.4 million yuan were raised for the Open Constitution Initiative (Gongmeng), an NGO of rights defense lawyers. He also points to the uncensored discussion held between the Dalai Lama and Chinese citizens in May 2010 as an example of the political influence that Twitter can exert. According to Anti, the people who participated stopped referring to the Dalai Lama as Dalai and now call him by the more respectful Dalai Lama.3 With over 120 million microblogs in China, censors haven�t yet discovered a viable long-term response and are generally reduced to attempting stop-gap measures to block certain news from going viral.4

In what is now commonly referred to as �AstroTurf advocacy,� Internet police often add favorable opinions of the government to various social media websites under the guise of grassroots support by anonymous citizens. Infact pro immigrants and Corporations are arguing that shortage of skills and they are not displacing US workers. If that is true why cannot they accept the conditions that they will not displace US workers. If you accept that you do not mind replacing some american workers also then all of your points are valid. Then you can lobby for unlimited H1b and Unlimited greencards. You will never get American people support for that. But we all are lobbying based on the shortage of skills. So we should be ready to reduce H1b when demand goes down or accept the conditions for non displacement of US workers. Right now demand is more so US will absorb even 200K H1bs. But you need to look what happened between 2000 to 2003. So many layoffs. Part of reason was economy but other part was due to H1b and outsourcing
I will accept that 25 year old H1b from India can work 15 to 18 hours a day but same kind of productivity cannot get with 40 year old person with family of 2 kids whether Indian or american. Is it right to replace those person with 25 year old person. If that is the case then you will be replaced by youger H1b person in future.
My view is clear. There should be H1b numbers based on demand and supply. If they cannot come with correct numbers then restriction of non displacement of US workers should be there.

H-1B caps have nothing to do who applied for the H-1s, whether those were consulting companies in US or a company in Japan. In all your posts, you have this mid set where the door closes right behind you and more people should not be allowed on H-1. I am sure you qualify to be the member of IEEE-USA. Please Google search for their membership form. Just because the name of the organization is �Institute of Electrical and Electronics Engineers� doesn�t mean that every thing on their agenda is kosher.

Every community/group, big or small, have their opponents and enemies just because of the sheer nature of the competition for resource with other groups/communities. H-1B community now forms substantially large group of people. It is natural that orgs like IEEE-USA will be a natural opponent of H-1B community because there is a competition. Now, most members of IEEE-USA are older and middle aged folks, who are not able to compete with good quality engineers from other parts of the world. The folks on H-1 are young, dynamic and fast learners. IEEE-USA folks cannot compete with this group and so they are working to eliminate competition from H-1B folks by other means. Sometimes they call H-1Bs as indentured servants, sometimes promoting outsourcing, sometimes taking away their jobs and sometime depressing wages. They throw out all sorts of rationale to hurt H-1B community. And some idiots on this and other forums have not clue of the bigger picture and are hell bent on screwing the so called �body shoppers� as if it is ok to work at the client site to do the same job at the same amount if you are employees of KPMG or Accenture or Bearing Point. But it is not ok to do the same thing if you are an employee of TCS, INFY or SIFY etc. If this is not discrimination, then tell me what is????? So you do think that anything associated with the word �IEEE� is gospel. Let me share with you my friend that IEEE and IEEE-USA are totally different organizations. Just like any other organization in the world, IEEE-USA is working to address the issues of their members only. IEEE-USA is working to fix the issues of their members who live in USA ONLY. It has no clue and no desire and no objective to look at any of your issues, no matter what they are. We all acknowledge that are problems with the H-1B program but the question is, Is Durbin-Grassley approach the real solution to the problem? Congress did not address anything associated with H-1B visa for last 6-7 years. If you write to lawmakers they only understand only thing about the word �H-1B� and that is increase in H-1B� that�s it. Now every system in the world needs tweaking from time to time and this has not happened with H-1B program for a very long time. Either way, throwing out people waiting for green cards for 6-7 years is not the solution, putting in restrictions to undermine the entire H-1B program (because they know they will not have enough votes to reduce the visa numbers or eliminate the program) is not the solution, �investigating� companies when they hire someone on H-1B as if hiring someone on H-1B is a crime is not the solution, singling out companies from one country because the guy driving IEEE-USA (Ron Hira) doesn�t want more people to come from India because he hates his heritage � is not the solution. Yes there are problems, but Durbin-Grassley bill is not the solution.
Who needs enemies if we have friends like you? I mean why do you want hard working people to unnecessary go through more problems before getting their green cards, as if the existing problems for us are not enough. The folks on H-1 are young, dynamic and fast learners. IEEE-USA folks cannot compete with this group and so they are working to eliminate competition from H-1B folks by other means. Sometimes they call H-1Bs as indentured servants, sometimes promoting outsourcing, sometimes taking away their jobs and sometime depressing wages. They throw out all sorts of rationale to hurt H-1B community. And some idiots on this and other forums have not clue of the bigger picture and are hell bent on screwing the so called �body shoppers� as if it is ok to work at the client site to do the same job at the same amount if you are employees of KPMG or Accenture or Bearing Point. But it is not ok to do the same thing if you are an employee of TCS, INFY or SIFY etc. If this is not discrimination, then tell me what is????? I sincerely do want to understand your view and please consider me to be totally ignorant person who is here to learn from you. I sincerely mean it.
So you do think that anything associated with the word �IEEE� is gospel. Let me share with you my friend that IEEE and IEEE-USA are totally different organizations. Just like any other organization in the world, IEEE-USA is working to address the issues of their members only. IEEE-USA is working to fix the issues of their members who live in USA ONLY. It has no clue and no desire and no objective to look at any of your issues, no matter what they are. We all acknowledge that are problems with the H-1B program but the question is, Is Durbin-Grassley approach the real solution to the problem? Congress did not address anything associated with H-1B visa for last 6-7 years. If you write to lawmakers they only understand only thing about the word �H-1B� and that is increase in H-1B� that�s it. Now every system in the world needs tweaking from time to time and this has not happened with H-1B program for a very long time. Either way, throwing out people waiting for green cards for 6-7 years is not the solution, putting in restrictions to undermine the entire H-1B program (because they know they will not have enough votes to reduce the visa numbers or eliminate the program) is not the solution, �investigating� companies when they hire someone on H-1B as if hiring someone on H-1B is a crime is not the solution, singling out companies from one country because the guy driving IEEE-USA (Ron Hira) doesn�t want more people to come from India because he hates his heritage � is not the solution. Yes there are problems, but Durbin-Grassley bill is not the solution.
Who needs enemies if we have friends like you? I mean why do you want hard working people to unnecessary go through more problems before getting their green cards, as if the existing problems for us are not enough. You simple want to make the system difficult to test human endurance? You know what, we can do this, how about all the stringent conditions of Durbin-Grassley bill will apply ONLY on you and we are all sure that the �HIGH-SKILLED� that you are, you will pass all the �tests� with flying colors. For rest all the others, please consider us lowly skilled and please set a bar lower to the extent that is humanly achievable, we are not �highly-skilled� super-humans like yourself.
Yes, you have not yet clearly said that �I support banning all H-1Bs�, not in those words, not yet. But reading your posts, it is apparent that you are headed there, as soon as you get your green card. As I said earlier, form now on, just think that all the Durbin-Grassley conditions apply on you and live your life as per the standard set by Durbin-Grassley. For the rest of us, please have mercy on us.

Sorry but no matter how you spin it, owning a home is better than renting. Renting is not smart. period. your money is gone every month. You are not getting that money back.
When you own a home, the money goes towards a mortgage, and although most of it goes to interest at first, all interest paid is tax deductible which is a huge chunk of change every year. I get more money back as an owner than a renter and in the long run I save more AND own the home.
30 year renter vs 30 year home owner? That is not rocket science.
It's not rocket science, just common sense. In case you are aware, lot of people on this forum don't have gc in hand. What will they do if they decide to leave due to gc taking too long to come through. Ask they bank to give back the money they spend on stupid interest for 10 years for a house upside down ?
Common sense is to rent until you are sure you're staying for good.

Why did they not take the employer to court? Why make the EB2 line suffer for these employer's faults?
If an employer wrongly files your case under EB3 instead of EB2 or EB1, then the onus is on you to challenge them and take them to court if need be.
And start the GC process all over again?. well isn't there an easy option of converting to EB2?. :)
