Everyone makes a mistake. That does not mean they would not have any after effects. They will.
Congress have a bigger issue on their plate right now. That is Iraq. I am pretty sure Congress would take up this issue in near future. Make your voice heard to Congress. Then pray to God/Almighty.

Unfortunately we are all caught in it with only solution to fix is time travel and kill the beast in infancy. There is vested interest by the Govt and Banks to lend because that's the only way money is created. That explains constant rate cut cycle and stimulating artificial growth. The entire monetary system is hijacked by banks. The debt to ordinary people drives the economy and people pay that debt and interest a good part of their life. Thus collapse of big banks could lead to eventual meltdown of the system, and no wonder govt keeps bailing them out.
In the end personal level frugal living and debt free people are constantly punished by taxing interest like ordinary income and no tax breaks. On the other hand big over leveraged spenders are rewarded with big tax breaks. Why ? Because it allows the well-oiled machinery to work.
In last 10-12 months, this overworked (overstretched) machinery broke down because the debt (and interest) is no longer paid back. Banking system of the entire countries start to fail (Iceland, Latvia, Hungry...). What happens next is anybody's guess, but we will be collateral damage, mine and your savings will be eroded by diminished buying power due to currency printed to bail out the fundamentally flawed system.
The sharp decline in moral and ethics is a direct result of entitlement mentality and welfare society. People feel that they deserve everything without having to pay it back and everyone who is better off must be evil. They forget that simple hardworking people can be rich by simply living debt free and with in the means.
Finally the money from debt driven system might survive but not without huge decline in standard of living, a massive recession and permanent shift away from material possession as a central theme of life.

While the USCIS numbers of pending I-485 make me relatively pessimistic on movement for India and China EB-2, the State Department�s internal case management staff are feeling more optimistic. In fact, we are seeing the National Visa Center issue fee bills for EB-2 India immigrant visa files with priority dates as late as November 2007, which would seem to indicate that NVC, at least, thinks the visa numbers will move at least that far ahead this year.
A caveat against reading too much into the NVC action: recall that it was imperfect information-sharing between USCIS and the State Department that led to the July 2007 �Visagate� debacle, and NVC likely has a small minority of the overall number of visa petitions with India and China EB priority dates in 2006 and early 2007, since so many of those beneficiaries could file for adjustment of status in July of 2007.
It�s also possible that NVC is simply trying to get cases set up with fees paid and documents submitted in case the numbers stay current for the rest of the fiscal year � but applicants would lose their filing fees if the numbers retrogress later this year.
We will have to wait for the May Visa Bulletin from the State Department, likely released by April 13 or so, for more detailed information on the State Department�s thinking.

I called vonage cs too...she confirmed the 5k limit exists for residential vonage world program. Minutes are counted only against outgoing calls. 5000 min is approximately ~ 2.6 hours per day for 31 days which I think should be sufficient, unless you are running some kind of a business from home.
In a case the 5k limit is nearing or has exceeded, vonage will send an email alerting us to this, at which point we will need to talk to their usage management team. This team will evaluate the situation for us - mostly that translates to this - if we exceed this again, they may make us get the next higher premium plan.

If you want to change the employer with in 180 days of filing 485 - there is a risk involved. If your 485 approved with in the 180 days then you will get in to trouble. If your 485 is pending more than 180 days - irrespective of when you changed employer before 180 days over or after 180 days over are does not matter - and you will be safe.
If you change your employer with in 180 days - then you have to pray to the GOD for not getting approval with in 180 days of filing.
I think it answers lot of lenghty questions either one way or the other.

Look at this way.. We are not asking anything unfair or outrageous. All little provisions that makes our lives easier. Some are even basic human respect issues and involves trust. As highly skilled immigrants, we deserve this.
Even if nothing happens...what have you lost in this campaign? This is the easiest campaign that IV has had. Print the letter out, sign it, make a copy and mail it to the president and IV.
In fact if you are hurting so bad..take 20 printouts, get 20 ppl to sign it and put their name and address, maek copies and send it on.
this way at least you are doing something.
Remember the flower campaign? there was a flood of flowers. now lets make it a flood of letters.

Why has AILA not yet filed a class action lawsuit? Why have no lawyers filed a lawsuit on behalf of the entire community?
Let us ask thiis question to all our lawyers and ask them to communicate to AILA? Speeding up namechecks will truly help immigrants and will annony employers who want to keep us waiting as long as possible.
This is an open question to all lawyers reading this post. If you can file such a lawsuit, it will be a big help to this community and you will prove to us that you truely care for our cause.

If in that response..they mentioned that an officer is reviewing your case..then you should be safe..

EB3 will not any visa from recapture bcoz it will go to EB2 first. EB2 line is not going to clear in next 10 years bcoz nowadays everybody applies in EB2 and as they move VB forward for EB2, more and more people apply for AOS and it never ends.
So EB3 won't be benefited by recapture unless there is a clause specifically for EB3 allotment out of that recapture

This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
So life is not always easy. There are people waiting since 2002-03-04.
Don't think that life is not a FIFO always.
Why some of the guys became violent when I said, INDIA IS GREAT???

As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.

Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".

What most of the people need is an ability to file for AOS so that they can indepenedent of the clutches of their employers.
I'm sure if you widen your horizon, you will be able to understand the plight of all your brothers and sisters stuck in this retrogression.

I totally agree with you. H1b and employment based GC's are so intertwined that they are almost inseparable. For example, you can get H1b extension based on your pending/approved PERM labor or your approved I-140 application. So, any change to H1b will in some way impact the GC process. I'm all for closing the loop holes in H1b provided certain reforms are also made in the EB green card process- like removing per country quotas and may be give EAD upon I-140 approval.
But do you believe they will do any good for us or they are really interest to protect us. Their aim is to divide and rule.

What they did on Wall Street was short selling of stocks. This is nothing to do with real estate. Short selling of real estate is a way for Lenders to get the marlet value of the property instead of foreclosing it for no value at all. This is something which is approved by the lenders based on the market. Nothing illegal in it.

i dont think the country makes a big difference, i have two friends stuck in name check (one was born in canada with an english first and last name). i think its the combination of the name, DOB and a crappy system

One of my friend (H1b) got into a job ( after passing labor market test - LCA - that no USC/GC could be found). in fortune 500 as direct employee after the job was vacant for more than a year.
However the same job was sent offshore after 8 months his tenure in that job. He was ok as he retained shares, signon bonus and severance.
All we see here is Indians competing against Indians in one form or other.
This is not affecting USC/GC.
How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.
