Guys,
Here are my thoughts:

There are Four group of people (Became current with July bulletin) who are affected and suffered.
1) The people whose applications reached to USCIS before 10:00 AM
07/02/07, i.e. before USCIS's new revision/update.
Note: Legally this group is the SAFEST one as their file reached to the
USCIS table on time while USCIS's first bulletin was in effect. Their
case is strong as far as "Law and Justice" is concerned.
2) The people whose applications reached on 07/02/07 but after USCIS's
declaration of new revision.
Note: This group can be fit in a category "Who did not receive ample
notice from USCIS for its intention to change the bulletin. And so
may be considered "Probable beneficiaries" by the judiciary
3) The people whose applications reached or will reach to USCIS from any
time between 12:00 AM 07/03/07 to 11:59 PM 07/31/07.
Note: This group will have a "Strongest" weak argument and case. Their
act of sending files perhaps may not be considered "Law-abiding" as
they have already received ample notice from USCIS and clear
statement of USCIS about "Rejecting applications upon receiving"
then also this group sent the applications.
4) The People who will not send applications at all with respect to the
USCIS's revision.
Note: In my oinion and mostly I believe in Judiciary's opinion thsi group will
be considered "Law-abiding" and who acted as per USCIS's
instruction within the periphery of respecting legal authority.
Now other points to be noted are as under:

DOS and USCIS screwed up? Yes... Did not happen ever and now it happened , yes.. People suffered stress..expenses.. yes. Now what is stressed on is one time bulletin per month is a tradition and it is a long time tradition but probably DOS has a power to change that... It seems that there is no such law that DOS can not do that so there exactly Lawsuite filer may have a weak case. Now USCIS is supposed to follow DOS and make bulletin as per DOS's guideline and that is what USCIS did so where is the "Law-Breaking" ? USCIS acted perfectly in legal manner. Probably if Lawsuite filer decide to file the lawsuite on the basis of "Why the helll USCIS declared "All Current" at the first place" then there they have a chance to make a case strong but if they go another route like "Why USCIS revised the bulletin" then I personally do not see "much worth".
Now having said this, to me it looks like whether you file till in July or not OR whether you become plantiff or not, it should not matter. AILF and/or any other organization ethically and perhaps legally can not define "Class" narrowly to the limited group of people. If real justice is prevalent in this country judiciary should not allow any entity to define "Class" narrowly. To me "ALL affected" is the "Class" and if judiciary is considering it as a "class action" then it should consider "All affected" as a class. Now US justice system would go this way, I do not know but if it is not going that way then I would consider that as abig black loop hole in justice system itself. My guess is that if AILF would go defining "Class" narrowly, there will be some mechanism by which individually or with group you should be able to challenge that legally as well.
Now Judiciary, in my opinion may not take stand that ok this is a "Class lawsuite" and now Mr.X has become the plantiff so he would only be the beneficary if lawsuite is won. Either ALL affected should be considered for whatever the benefits come out or everybody looses it. Same argument goes for people who are not filing. By not filing they are obeying the legal instruction of government department of USA and for that they should not be punished and can not be punished by not granting any benefit to them whereas granting the benefits to the people who clearly challenged USCIS's revision by filing from 07/03 and onwards....
If USCIS is smart, it should accept all files now and create the process to have them rotted in the queue for years and that way it will be able to save its own face and limit on visa numbers will automatically send whole bunch of files for eating the dust for years.
I personally see our strong point only at have reimbursement of the money and time if "We are not getting current before one year (Validity of Medicals)

Thanks for your informed comments. Like you, I am also surprised to find many people in this forum, who are interested in fire arms.
I don't own a fire arm and not planning to while the immigration status is not yet Citizenship. I don't want the authorities to give another reason to look into my case. I just go for fishing once in a while.
But our family owns two guns in India and have worked with guns from childhood.
Another point is I am very much impressed with how the Americans manage wild life and the nature in general. They enjoy it while preserving it. India does neither. We just destroy it, and write eloquent speeches on nature protection.
Federal law does allow H-1Bs to purchase firearms if they have lived in the US (Same residence, if you move, the clock is reset) continuously (if you leave the country, the clock is again reset) for 90 days and fall under one of the 4 exceptions listed below.
- Possess a valid (unexpired) hunting license issued by any state in the US
- Are a Law enforcement officer from a foreign nation, here on official duty
- in the US to participate in a shooting sports competition
- get a waiver from the Attorney General
The easiest of these 4 exceptions is the Hunting license exception.
Once you meet the above mentioned criteria, you are okay, per federal law to possess a firearm. Doesn't matter what non-immigrant visa you are on (H-1B, F-1, AOS).
Next step is to check whether your state has additional restrictions. I don't think any states completely bars non-citizens from possessing firearms (atleast none of the states that I have lived in do), although some states have restrictions on the type of firearms non citizens can buy. e.g. in MA, non-citizens (including GC holders) can't buy handguns or high powered semi auto rifles (ARs, AKs) but they can buy non-large capacity rifles and shotguns.
As someone pointed out, trying out guns at a public range which has rentals is a great way to introduce oneself to the sport, learn basic firearm operation and safety, and to try a wide variety of guns and calibers.

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc,west virginia north and south carolina. Arranging busses for the students is not a bad idea. Students once convinced why they need change in current immigration reforms for employment base legal immigrants will participate in huge numbers to attend the advocacy efforts done by immigrationvoice.org as they have more time in hand

First of all, you dont have a binary choice in the matter such as either you learn 50,000 words and their spellings or go smoke dope. There is a middle ground here.
Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?
Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. Anyways, that's my belief and my opinion and everyone is free to raise their kids in whatever way they deem fit. I for one, would never ask my 2 children to participate in any spelling bee contest.
As far as your desi company thoughts go, it has nothing to do with spelling bee topic. However, let me tell you this. By being holier than thou and telling other people "I got a degree from here and you dumb asses have never been to an American college, so get lost you idiot, this job here is mine..." does not help anyone. Also, no desi companies put a gun to the head of anyone - Indian educated or US educated - to work for them. And let me remind you, there is AN ENTIRE GENERATION of US educated US masters degree holders who had no job after graduating and have been to a desi company to get trained on the real-world software applications. I am sure you know some people yourself, just as I know some people in that situation. If the US masters degree made them super-duper smart, then they would not be knocking doors of desi companies for education after graduating.
I am no fan of desi companies, everyone here knows that. But don't preach a holier than thou sermon to everyone who doesn't have a US degree. Because your US degree isn't worth a bucket of warm spit when it comes to getting a job.
I guess you are speaking like Tom Peters. But in the end, it all depends on where one wants to be and what is the world view of someone. If one thinks that just because someone is a manager over others, that makes that someone better and more successful than others, and if most B- students manage A+ students (which is fuzzy maths), yes, in that case it maybe that its better to get a B- grade than A+, and there is no need to go to business school either. If the world view and the objective is not just to become a manager or make 100K instead of 120K, but actually do something worthwhile in every stage of your life, rather than just having an objective of becoming a manager, maybe its about learning a language and words, then why not. Strong vocabulary is the first stage to clear expression and clear expression is the corner stone of a successful and satisfying career, including bring a manager. I don't see anything wrong with learning more words, or loving parents or obedient children. Everyone has a different age in their life when we revolt against the environment, just to break free. Its not necessary that one must continue to revolt an entire lifetime to be creative or be better than others. Bill Gates or Steve jobs never wanted to become just managers, they wanted to re-invent the future. College dropouts, but successful. But how many Gates and Jobs do we have? I guess there is no clear definition of success and different people gauge success differently, but most people, more so in this crowd on this forum, relate success to level of education/university (US masters or Bachelors from India), and title at work place. But maybe the key is not how others gauge your success, but how you gauge yourself. Maybe you have set your eyes on squeezing most number of lemons or maybe being fastest eater of a water melon, or climbing on top of rhinoceros back, whatever it is, if you have done it and you feel satisfied, you will see yourself as successful. So whatever is the definition of success, whatever is anybody's opinion or world-view, the fact is, these kids did well with the goal they had set for themselves. And if that is how they feel satisfied with their hard work, they are successful. I think we should start a Employer Hall of shame and nominate employers who are either cheating the employees or the Immigration system.

People make their own purchasing decisions based on their comfort. On forums, you just need to read and follow your own gut.
Also, there is a talk that when US dollar currency weakens considerably from the current levels, foreigners may be interested in owning real estate in US.
Also, US being a tourist destination for many countries Hotel sector may start booming.
However, if foreigners want to purchase, US must make considerable changes to their immigration policies to invite.
There are way too many problems infront of Fed Chairman.
1) Asking people not to walk out of homes and pay up their loans
2) Making the wall street firms like Lehmen, bear sterns run their businesses as usual.
3) Contain the inflation so that long term interest rates are lowered.
4) Come out clean if the US policy is shifting towards Weak dollar or going back to string dollar policy. Either way US and world over have to face gyrations in near term.
There is blood on everybody's hands for the mess we are in.
1) Japan for too long provided the world with cheap loans (~1%).
This money not only found its way to corprate India but also into US
Housing markets.
2) Americans spent money much much more they earn or worthy off.
3) Globalization created another affect (Read Alan greenspan's 'economic conundrum' theory). Google it, you will find plenty of articles.
4) China for too long manipulated their currency and provided the world cheap goods.
5) Oil exporting countries didn't utilize the profits in developing their countries and economies. Instead they started buying aasets all over the world causing unsustainable price levels in asets.
6) Indian software industry far too long booked profits without developing/diversifying into enterprise strength products and remained fixated on their business models. Software sector is staring clueless and is unprepared for the fallout of outsourcing industry. Pink Slip culture is on the rise.
How do we come out of this financial mess in US?
There is no easy solution.
10,000 people buying homes will not help this economy. On contrary, 10,000 people not buying homes will help.

I am planning to file EAD/AP for my wife who is on H4 along with adjustment of status application. Will she continue on her H4 status till she gets EAD/AP?
She will continue on H4 status until she uses EAD (by filing I-9 with an employer when she starts working). At that point, her H4 is automatically invalid and she is then on EAD. Until then she can be on H4. Same rule applies to H1.

AP is for a short emergency travel during AOS. Yes..it will be a pain if AOS takes many years, particularly travel issues.

Albeit silly.... I was thinking, Ok... at least now folks here will realize that not in IT but Indians are talented/can shine is many fields and that's the way it is. The reality being there are more talented people in that country who never got chance global recognition (until the ice was broken by the IT industry)... More talented people --> Hence more immigrant (not a rocket science).

well ..the problem is by the time EB3 - person gets his chance --he may become more qualified than a EB2 candidate ..esp in IT. for eg -- tell me who is more qualified.
say a person does MS (maybe from timbuktu) has 1-2 years experience (EB2) ..and there is another EB3 person with 4 year college - 3 yr experience when he applied in 2001 .(so now he has 10 yr experience and along the way he got certifications etc) ..so now who is more valuable ??
the problem is there are (some have been rectified) lot of loopholes, problems, inefficiencies (and I care rat's a__ attitude at USCIS) ..how else can you justify the wastage of visas every year ..when the US needs immigrants just as immigrants need US
How many of MS(EB2) candidates got Jobs without faking their resumes. I am not saying all EB3 are not doing that. At the same time not all companies do EB2.

Tuesday June 8th, Press conference in the morning; meeting with legislative offices and a congressional reception that will run to around 10/11 pm. So please book your flights back home on red eye flights Tuesday night or early morning flights on Wednesday.
I have confirmed my travel plan. I will attend all events on Jun 6, 7 and 8. I have already paid for my airfare. I can bear all the local trasportation and incidental expenses. I don't have a place to stay, though. I would appreciate if someone can sponsor a 3 night hotel stay for me in Washington DC.

1. If you are in IT field, you don't even have a grasp of software development lifecycle and the part QA plays in it. A good QA cycle is essential for a good quality product. It is your ignorance about software development cycle that makes you say good QA guys are not an asset for a good product and they are not smart as developers.
Well I am not a software engineer but I do understand the role it plays so I do know im not dumb. Thank you for your words of wisdom.but I wouldnt agree with the fact that people have to be flown in from other parts of the world for this, yes there are corner cases in every product validation cycle which needs really talented people the vast majority do not do that
A tenth grader with enough common sense can do good software development. India produces lot of people with good common sense and analytical thinking. That is one of the reasons for India's software boom.
IMO if you don't have a patent in your name, you are not high skilled enough.
2. How many consulting companies do you know do charge their candidates for filing H1 ? I haven't come accross any. It is illegal to do that. If someone is doing that, ICE is after them.
