I was absolutely pissed off with the "local" ppl that got greedy and dragged the whole economy with them. Seeing that there are ppl like you (one of us) who are pretty much the same, i am seething with rage. Because of idiots like you, people with a pristine credit history of more than ten years and some saved money cant buy a decent house in the bay area (and elsewhere) and have to see their hard-earned money go down the drain in 401k and stocks.....I wish ppl like you rot in foreclosure hell and no one ever lends credit you, ever again!!!

person who has made downpayment and knows he will lose more money if he sells his house for a loss becuase he has to move because of employment.. will definately look for his options.
if it was an ideal situation..then one can sell his house within couple of months..
but because of this American dream, big homes, nice cars, which a person cannot afford, we are in this mess..

There is a difference between laws and regulations. Laws are what in INA (Immigration and Naturalization Act) and Regulations are what in CFR.
It takes congress and senate to change laws where as it takes discretion to change regulations. And the good news is that discretion can be challenged.
There is another thread on the issue and some of us think that we do have a case. Initial response from a certain lawyer has been positive.

The affected parties (i.e. us) need to show damage in certain way and I do have some points that can be used. Our primary point is that the spirit of law has not been upheld.
Following are the steps in making this a reality:
a) Gather around 50 people
b) Develop and finalize draft of the case. Rolling_Flood has a initial draft.
c) Hold initial consultation with a lawyer.
d) Decide as a team if we want to continue.
e) File a class action suit
Not sure what is the total cost but given the years of wait and uncertainty $500 per person should be reasonable. I will also create a yahoo group to start these discussions.
Notes:
If you already have applied in EB2 you won't be affected.
If you have a Masters you won't be affected.

Got an email from USCIS stating that there is an change in status... This email showed new status as Card Prodn Ordered...
This was early evening 22'nd Oct.... Got two emails - one for me and one for my wife... exactly identical email.
Then later at night (closer to midnite NSC time i think), i received the same two emails for me and my wife again.... not sure why.
Since then no other emails.... So far, i have only recvd CPO email.... no other emails at all...

Well it is their country. We are serving through our volition.
We have an expectation, but in a free market it is demand and supply.
i am Not trying to be negative - just a reality check on where we stand and how we can approach.
It is a fact that immigration from Asia shot up at the turn of the millennium. This may look disproportionate to proponents of diversity.
Now 1/6th of the world population comes from one country. But the quota for Iceland and India remains the same.
Consequently many like us cannot: change employers, give up opportunities (lure of which we came here for) and wait for the same outcome that others achieve much faster, simply because they were born somewhere else or their employers & lawyer decided their immigration category. So much for free country and meritocracy.
i believe our main point should be a level playing field and transparent
system so that expectations are clear.
For those of us who have suffered due to lack of clarity, for all fairness, must lobby for a chance to parity after multiple (say 10) years of serving LEGALLY.

I was talking to a reqruiter the toher day and he told me of a case where he placed a candidate with EAD and within weeks the EAD expired and the renewal did not come in time, though they managed to clear out the issue, the company seems to be uncomfortable dealing with the EAD shit, thats what he told me.

Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. Now how do you know that, do you check their passports or do you ask them point blank about their origin. Or do you try to place them by their accent. Obviously not. The only way you can make such a blanket statement and attach an "immigrant of some variety" lable is by the looks alone. My friend, the last ten pages are precisly about such issues. Also, it is quite possible for a third generation Indian/Pakisani, a true Brit nevertheless, to work at Heathrow ... and If I borrowed your eyes for a minute, I see only an immigrant invading the country.

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

Can some one please clarify what this case number is. Do we get the case number when we apply for visa, or this is just the approval notice number.
I am going for my interview on 23rd January to Mumbai. I was just trying to find out whether I can call KCC before leaving US to find out if my approval notice is in the PIMS system or not.

If your app is in either state 2 or 3, the response from USCIS will be "your case has been assigned to IO".
My suggestion is ask them:
1. Has my case been pulled out of the storage area? If not, could you please request that [An IO can do this and I think this was the most useful thing in my case. She said that she will make a request to the contractor to get my case pulled out].
2. Has my case been picked up by an IO or is it still waiting in the holding area? If it has been picked up by an IO, nothing you can do except filling out 7001 form. If it has not been picked up by an IO, ask on the phone if an email can be sent to him advising that your case is current and waiting.
So, broadly, your goal should be to get your app moving from state 1 to state 3. Once an app lands on IO desk, it will take between 10-30 days to get it approved.
