As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.
While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. My argument was on when your file will be looked at the first time. Of course, to get visa number numerous conditions, such as PD Currency, name-check, various documents, etc., have to be met. What I meant is that your file will be looked at the first time, only after cases physically received at the center reviewing your case (no matter what RD is shown on your receipt) before your case was recieved, have been looked at.

Folks keep arguing with me, hey this is a major victory for IVians. How so, may I ask? It has clogged EB3-I like hell. This has given USCIS a reason not to process it further and dedicate resources to it. Most folks who got their EADs, after being eligible for it out of order, have not even used it. It may have benifitted EB3 spouses of some folks in the short run but it has messed it up completely in the longer run. I'm not EB3-I but I can't help stating this.

They would suddenly raise the cutoff dates and have a big window. And then they would go by RDs within that window. So even if your case had older PD, it could happen you didn't get a visa number because your RD was of a later date and visa numbers simply got over by the time they got to you. Instead, they should have some weighted average of RD + PD, within a window.
More importantly, they should NOT raise cutoff PDs dates arbitrarily. Hopefully, with the database revamping these administrative fallacies are corrected and such thing won't happen in future.

I went through the Federal Firearm Law and here is what I found:
(d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�
(5) who, being an alien�
(A) is illegally or unlawfully in the United States; or
(B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)));

Hi Gurus,
I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

I understand that you guys have done a lot with limited resources, but trying to isolate yourself from the issue of illegal immigrants issue is not going to help us either. We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).
I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B�S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator�s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant�s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Yes, flight to DC would have been then recovered from USCIS in the lawsuit against them.. :)
We have a few people making their way to USCIS - so we should know in sometime.
Actually when I say a few, there are probably only 3 or 4. Even after working the phones, emails and private messages, we could not get too many DC area members to help out.
If I have one regret for this campaign it is that I should have booked my flight tickets to DC - it would have been just so exciting to have such a good opportunity to voice our issues and concerns.

When applying for CP the consulate we can apply to...does it have to be only the one in your home country (American Embassy in Chennai) or can it be the one in the country of last residence.
I have studied and lived in Canada for 3 years before coming to US. I am wondering if i can choose American Embassy in Montreal as my consulate post (country of last residence) or is my option just the consulate post in country of birth
Any thoughts on this greatly appreciated!!!

Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.
So, YES, I've tried it, I'm pretty darn willing to and I got a strong pair of balls!

A# is assigned during I-140 approval process. Unless you get an approved I-140 from your employer it is difficult to get the A#. BTW, I didnt knew my A# so I just left that field blank and sent I-140 Tracking number instead.
