While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).
I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...
Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

I came to US on L1 in 2005 thru COMPANY-A and then applied for H1B thru COMPANY-B in 2006 and got approval under 2007 CAP. But I didn't start working for COMPANY-B(H1B) and went to India after H1B approval but came to US on L1B again to continue my work with COMPANY-A(Did a leapfrog).
In 2009 I transferred my H1B from COMPANY-B to COMPANY-C and got the petition approval. So I have a valid H1B petition with COMPANY-C.
In the same year my COMPANY-A(L1B holder) applied for COS to H1B under new 2010 CAP and got approval. So my status has been changed from L1 to H1B with COMPANY-A.
Now I have 2 approved valid petitions, one with COMPANY-A and the other with COMPANY-C, my question is if I get an offer from COMPANY-C can I start working with them with out any H1 transfer application ?
or can I transfer my H1B from COMPANY-C to another COMPANY-D ?

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping right after his L1B stamping, will it affect the visa officer's decision in issuing a H1 visa?
Last question: he has already spent 3 years in the US on a L1B visa. So, if he comes here on a H1B visa, will the 6-year term limit count his 3 yr. stay on L1 visa or will a new clock start when he enters on H1?

Good news. The U.S. Citizenship and Immigration Service (USCIS) recently issued guidance on the new H-1B amendment that limits Troubled Asset Relief Program (TARP) recipients� ability to hire H-1B workers. The USCIS confirmed that the new H-1B amendment does not apply to H-1B extensions for current employees with the same employer.

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

I came in on an F1 and got transfered to a H1B without leaving the country.
My H1 was approved for 3 years ie till 2012.
Due to problems at my work place, my H1 got revoked by my employer.
I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
I am currently within the 180 day limit.
What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
If my fiance and I do get married, am I eligible for for adjustment of status?
Please help!

Recently I applied for AP. It was approved on Oct 20, 2009 but when I got the document from USCIS I found that the effective date of my AP is from 12/20/2009 to 12/19/2010. My question is,
1. I want to go to India on 26th Nov and return on 20th December. Some of my friend told me that I can travel between 12/20/2009 to 12/19/2010 not not before 12/20/2009. Is it correct.
2. My understanding was I can go to India before effective date which is 12/20/2009 and can return on or after 12/20/2009. Is this correct.
Please respond as I want to go to India on Nov 26th 2009 due to some emergency.

Now I filed for another H1B transfer to another employer. But around September 2009, the previous I 140 was revoked ( this revocation is normal one and not for fraud ). I didn't know about that. So an RFE came for the new H1B transfer since my I 140 was revoked. I don't have a GC on file right now. I had the impression that normal revocation of I 140 doesn't effect H1B transfer. PLEASE HELP!! What are my options?
