thanks for the response.
The only reason i got worried was that a friend applied on the 23rd and got hers yesterday. We both applied in the same center too.
I just hope that paperwork is there and hasent been lost or something.

FYI: I have absolutely no source of information for this, it's purely just what I think, so don't trust me.
From the way USCIS works, it could be that they just haven't given much thought to what they're going to do when a lot of people are sending in applications thru many companies. Or maybe USCIS plans to hold the "random selection" in such a way that only one application per individual gets approved.

This is the sad reality. A lot of people applied using sub labor during the June and July fiasco. A lot of people made it through the July 15th deadline by atleast filing a 140 through sub labor.
Now USCIS is processing all these 140s and as they have old dates, they are becoming approvable.
As long as there are visas with old dates approvable - USICS will exhaust them. As long as USCIS exhausts old visas, DOS need not move the dates forward.

If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and foreseeing the demand.

I think USCIS actions are too random . I do not think they want to see the real projections or the real demands. If they wanted to , believe me it should not have been difficult at all. Nevertheless, the first step towards that would be asking for transparency. The letter and poster campaign can do that.

Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

I know I should be asking my lawyer this but what if i94 has been expired from past 3 monthsi.e., from april 2007 , the person has applied for seventh year extension of h1b visa in feb 2007 but it has not come through yet, and they have already done concurrent filing of 140 and 485 in July.
In this situation what does the person (with h4 dependent in the same situation) do ?
Is this a solution:
Make h1 premium now and get the 797 approval, wait for 485 receipt and then go to Canada for getting h1 visa stamping and new I94 card ?
Please advise. Appreciate any suggestions you can give with your limited time :)

I want your input on a very important issue. So far I haven't heard anything proper from IV Core. We achieved the pledge goal. This really shows everybody's passion to get the real data.
We have couple of options:
1. We deposit all the amount to IV's regular account. In that case quite a few guys have asked for guarantee that first $5000 out of this money will be spent specifically for this purpose.
2. We create a new paypal account, get all the donation in that acccount and one of us get the data from USCIS and share with everyone on IV thread itself.
Please let me know your opinion ASAP. This is very important and quick reply is necessary.

I think the Indian Passport offices give new passports with surname and first/given names. Check with the embassy.

I'm not sure if I'm eligible to apply for Master's quota. I'm done with all my degree requirements and I've scheduled my thesis defence on MAy 20th. Is it still possible that I can apply in Master's quota. I've a letter from my schools which states that I'm done with all my degree requirements and I'll be finishing thesis on May 20th. Is this letter enough to apply for MAsters??

According to DHS statistics there are around 50,000 EB2 lndia Labors in 2004 and 2005 each. So ppl with 2005, 2006 priority dates you can wait around 6-7 years for ur priority dates to be current with annual limit of around 5000 for EB2 India.
The lawsuit can be filed by your American Civil Liberties Union Member or ur aunt or uncle or mistress who is a US citizen. U guys and gals with 485's will not be there in the lawsuit but will benefit if the lawsuit wins.
Doesnt sound correct. Perm started March 2005 and for the entire 2005 year, i saw somewhere that the total number of LCs filed were close to 10-15K, for all countries...so i dont know how you arrived at this 50K number, only for EB2-India...
