"Some might wonder why we participated? Well, how could we give up on a chance to make history and truly understand what it means to live in a democracy. Its not about desperation for a green card, its about fairness and dignity. We believe that we have the right to a fair, open and predictable process and anything else is an affront to our dignity. Hello Gurus,
I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.

It is quite childish to create a new id every time you want to say something negative. Your message may be simple and straight forward, but it lacks the integrity or any trust worthiness.
This thread has gone anywhere. It could be simply because of the lack of EB3 I members participation. There is a definite lack of support from the vested parties and a few are discrediting this solution from getting traction and to top it all, I don't see any rational explanation against this. All I see is uncivilized personal attacks, self gloating and people who love to have fun at the misery of others.
As I said before, I will go ahead and do research on what we can do about it and use my years of invested social capital to see if I can do something about it. Once I get some thing substantially done, I will come here for support.
For the "skillz" person, I personally enjoyed your rants. I have/had chances to know personally and professionally many Stanford graduates, I believe they are not as much as fun as you are. :)

By the way, when I called the CIS today, the officer indicated that my finger print is cleared but name check is still pending. I thought they were the same? I can't stop thinking of our efforts in DC. As I have already posted, it was a tremendous experience being a part of such campaign. I came upon this thread of adding more members to IV and from what I read, it was successful largely. IV has increased members from 10,000 to over 40,000 since this thread was started.
I am bringing back this thread again, asking our members to get more involved in their state chapters and to encourage our current membership to be more active in the forums and action items. We, who participated in the DC event, can hold conference calls (if our members are separated widely across the state) or meet in local libraries (if many of our members are in the same city) and talk of our experience in DC and what needs to be done ahead.
Fellow participants, please do come up with suggestions on how to keep the momentum going.........

What is the advantage of claiming trader status on your tax return? I buy / sell shares on different days of the week (example: Buy on Monday, Sell on Friday). Does that make me a day trader?
I am doing this on H1B. I do have approved EAD.
while on H1-B status, one can do intra day trading in stocks, options, and/or futures, he/she can NOT claim trader status on federal tax return. Person on EAD can claim trader status and claim some trading related expenses to save tax on it.

What people are doing here is basically discounting the value of education. They are questioning the point of going to college at all (or to get a graduate degree), when you can just go to a trade school and learn a programming language that gets you a job. By that logic, why study history, biology, philosophy, languages, etc., if you eventually want to be in the software industry.
What people need to understand is that education gives you perspective. I don't directly use 95% of the education that I gained in many years of school, college and graduate studies. Does that mean it's worthless? I beg to differ, and so do my employers and people who work with me.

A good formal education is always desirable. I have no problem with that. What I take objection to is this entitlement mentality of some folks. A degree does not entitle a person to anything. It may help people get their foot in the door, but then on, they should be judged purely by contribution and merit. This is mostly the case in US and the reason why most Indians do well here. Contrast this to an Indian system and you see all sorts of differentiation going on. An engineering graduate thinks a commerce graduate is dirt. A commerce student thinks a history student is typically retarded. An IAS officer thinks he is GOD :D. A US degree holder (of Indian origin) thinks he should be ahead of immigration line. It goes on...
In all this, we are forgetting the actual person and attaching too much weight to an educational certificate issued by an institute/university. Education is an on going thing. It is good to have formal education, but we often forget universities are not the only sources of education and degree certificates the only credentials. Heck, even USCIS recognizes this :D.
Ladies and gents, if anyone of you have that coveted PhD from Stanford, don't jump into water yet, thinking you can walk on it :D:D

Your letter nor the proposed drft amendment to CSPA does not talk about the children of parents who applied their GC under employment based category and got stuck in the Labor Card approval stage for years and when labor got approved and I140 also got approved then again stuck due to Visa retrogression. We must include injustice being done to these children and should ask for retrospective amendment to CSPA to provide relief.
If you are in Illinois are you near enough to try and meet with Richard Durbin, he professes to caring about the children of illegal immigrants. Maybe he needs to put a face to a situation of the forgotten children of legal employment based adjustees to push him into realizing they even exist and he does them an injustice with his DREAM act.
I am a parent of an aged out child. It sucks, quite frankly. Never sure what to say to him when this issue is discussed. I would be happy to become more active on this issue.

I respect your thoughts and to some extent I personally share them. The primary benefit of citizenship for me and I believe for many others posting on this thread would be to bring our aging parents to this country and to be able to live with them.
This is the most insane reason i can think of.GC itself is a distant dream leave alone citizenship...and Aging parents...do you really know if they want to reside in this country here permenantly.3-4 months are over and they just want to escape from here coz they just dont like.And some mean children bring their parents to do nursery/take care of their children as free home nannies with paid airfare,boarding and lodging with food.

Few years back, someone at USCIS, changed the good old horizontal spillover to new vertical spillover just like that (probably on some new-bee intern's suggestion). Without any legislation change, or CIR, or admin fix...
Same way, USCIS can change it back to old horizontal spillover, and EB3-I will start seeing ~15K-~20K again every year.
We should try to re-introduce this concept of horizontal spillover back in USCIS's mind.

Some of us are managers/team leaders. Others have leadership skills and want to be managers in the near future.
If you are a CEO what would you do to solve the EB3 India issue.
Please present your ideas here. Just the ideas.
