I'm talking about the cut-off date in VB. No one can get GC if his/her PD is not prior to the cut-off date. The DOL will determine the cut-off date every month basing on how many 485 applications are submitted for processing in that month. Without substitution, VB might move faster.

if a background check reveals that you had been on H-1 you won't be eligible for Z visa. You have to come up with a new face, new name, and new ID. Looks daunting but less daunting than getting GC legally.

First of all everyone should understand that this is an Interpretation of law by USCIS, and in memo at the bottom it has been clearly stated that this only applies to case workers at USCIS processing centers not for others. I think based on this memo they decide each case whether to approve/reject. However I see this as "targetting only perticular group of people".
Also he mentioned that they arrived the "Employee-Employer" relationship based on 2 distinct supreme court judgments, I am not really sure what judgments the mean there.
Please correct me if I am wrong.

I am still on H1 (not utilized EAD), the visa on my passport expired last year. Planning to visit India next week, should I be getting a visa stamped or use AP?

I have been a member for a while now and have seen the benefits of IV. I've also seen a lot of back and forth in various thrreads betweeen various members in various issues and subjects. Before any one starts checking if I have contributed, let me assure you I have ....for the DC rally. Why? because deep down I believe in this org. No one forced me to contribute, no one asked me to have to come to this or that meeting. I live in Wisconsin but have not been able to attend any sub commitee meetings In Milwaukee because of circumstances both personal and official. I need not explain to anyone in more detail. What I mean by this is we need to set our boundries of expectations. How much do we practically expect out of members and how much can be done by a much more core group. Someone who RSVP but dont turn up should technically be a non issue, its definetly bad for the organizer and the core group, but are we hear to teach people courtesy? Its an intangible expectation. When we set this level of expectation lower, we will strain oursleves to a lesser extent. The bottom line is human behaviour and circumstances that model that behaviour and any other external circumstances cannot be changed.
I second any idea that keeps membership open and does not restrict access if one has not paid. However in order for any legislation to happen we all know that $$ is the bottom line. So when ever we need it, we must raise as much as we can. We have to let people come to the web site browse and leave at their will. Restricting access is like closing doors and no popular internet model works like this. Take google, yahoo, hotmail, everythign is still free and has been free and is the most popular. Open source is also more popular than paid software. We have a majority of members who log in from the office or home, and we have to let these people in. Our successes should inspire people (it inspired me) to pay. I will contribute again and also join my state chapter very soon, but my only gripe is when we have emotional members who role play people and call other people names. We dont need to go there.If we are arguing over the internet like this how long will it take us to break into a fight in a state chapter meeting?
Take the anology of our freedom struggle. Did the british grant freedom only to freedom fighters ? How many so called *fence sitters* did we have then? Eventually everyone got freedom. How did we raise money to have morchas and satyagrahas? All that needed money, time and sacrifice too..I dont want to go too deep into this analogy as it is just an example and may not be entirely 100% perfect for the scenario we are in, but its close.
P.S The opinion I have expressed is entirely mine. I have no personal gripes against any one person and have not taken any names. If you dont like what I posted ignore it. Its freedom to express ourselves that will get us to where we need to.

Yes, I'm on H-1B but I prudently avoided having any significant financial or personal ties in this country, because I knew this day would come.

A joke, right? Financially maybe, technologically never. Most European countries are far more technologically advanced than US. I'm sure Japan, Hong Kong, Singapore also are all more advanced than US.
For example, only US is still using paper checks to transfer money. Using coins to pay for a phone call in phone booth. Still has no control over who lives in the country, or who goes in and out. Still not using computers for processing immigration applications (Why do I have to send in the same papers 10 times, send in tax papers, give my background info, give fingerprint 10 times.... and this all on paper... come on it is 2007 not 1907). Still drive around in cars instead of having a good inter-city connectivity with trains. No high speed trains. Still likes to see rubber stamps on official papers and believes it has any kind of value.
And so on and on and on.... I could write a book why US is behind most civilized countries. But thats ok. US is what it is.
But the worrying part is; it is going to get even worse when they kick out all the H1B etc who are here legally and provide free knowledge. And instead keeping the uneducated mass of Mexicans or south americans who run across the border illegally and then given amnesty by some fool in Congress. Good luck with that project.

I think each person can write their own story and here are a few writing points as appropriate.
1) How long you have been here, and how despite your contributions in work and taxes, creativity(of jobs?) and maintainineg legal status, you have been left in a difficult spot of no permanency of status.
2) How you have benefited from this country and would like to give back, and understood that to be the tradition on which america was built.
3) If you have US born Children. That it would be unjust to ask them to be brought up elsewhere.
4) That your entrepreneural ideas have been held back by your inability to have permanency of tenure here.
5) That you never understood that to be the way it is done in America. However, a little voice keeps telling you to never quit on America, as she eventually gets it right.
6) That you have been unable to buy a home due to this issue and wonder why it is that you can't help yourself while helping America. That you have a stable job, 20% down, excellent credit and the whole nine yards except the green card. That there are thousands like you waiting to jump in.
7) How the US gov't bureaucracy has "wasted" over half a million green cards already allocated annually by congress, all happened while there were years long queues and merely recapturing those visas has been blocked by gridlock.

I see there is a very common misconception in these forums
First. EB2-I being current does not help EB3-I -- at least not directly. The numbers after EB2-I being current will not rollover into EB3-I. It goes to the general EB3 pool, from where first the 7% rule is applied, so unless EB3-World becomes current, EB3-I does not benefit from the numbers.
2nd, yes, the reclamation will help, but again not to a great extent -- at least not directly. All of the numbers so gained will go based on the 7% cutoff, so while we will get some extra numbers, but does not mean EB3-I will go ahead by leaps and bounds, that is until all the rest of the categories are current.
Most of recaptured numbers will come to EB2-I and EB3-I bcoz EB3-ROW is not that bad and EB2-ROW is always current. So yes, any recapture will benefit EB3-I significantly

Masti_guy - Don't worry about not having an MS. If people with MS move out of the queue the queue will autmatically move forward. There are a number of MS engineers working in EB3 positions especially the one who have never changed employers after they got out of school..

I want to let core team know that I am 100% in full support of IV. I encourage other people who have not yet shown their support to IV to do the same. They need it.
It is sad to see people who are probably frustrated due to their situations or lack enough patience venting their anger on IV core team. I for one, don't seem to get enough time out of my routine to really do anything and really admire core team members for spending so much time on this issue which is of course of so much importance for all of us on this website.
The people lashing out at core members need to understand that IV is not a shop where you pay money and buy results. It is an attempt to take voice of skilled immigrants to lawmakers, and that is all. You should not expect anything else. Please understand what is causing the frustration and address that issue separately. Leave the core members alone.
As for core members, I would like to say thank you from bottom of my heart. Seeing core members lashing out at other members is not probably the best thing for IV, however I can understand the frustration of core members.
I just hope that most members realize the limitations of IV and have enough patience to weather out this phase of frustration without causing harm IV which in fact should be their only hope.

Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.
CIR is a heavyweight bill. Heavyweight bills passed hastily leads to heavy indigestion. Look at the parliamentary history in US and India. We need lite weight riders and hitchhikers. Pushing on CIR is betting on a horse that is soon to be retired, with masked broken limbs..
Next move for EB should be THE decisive, concise, striking at the heart and quick. CIR is not the best bet for that.

Yes, that is right, I said �plight of EB2-India�.
I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

It is just speculation that it will take 10 years or 15 years. Actually past 3 years atleast 50% h1 were used by TCS,WIPRO and similar companies. So those who are processing gc is less. But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
next 5 years. But Skil bill is asking too much(May be for permanent resolution of
gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract
large opposition and passed easily. Simlarly if H1 increase also limited for 2 or 3 years that can be passed easily as we can convince Senators like Sessions.
But if we keep on asking so many numbers of H1 and Gc and also exemptions
for Master degree then we have to wait for CIR as this will have lesser impact
in numbers compared to illegal immigrants.
Yes, you made a very good point. I totally agree with you. Most people here do not really care about the fundamental immigration reform as long as they can get their GCs. Maybe instead of asking for SKIL which is very controversial, we should just ask for visa number increase for a specific period, for example, 5 years. That will solve our problem and is less controversial. After 5 years, all of us here should have had our GCs. The rest of the problem can be left to other people.

But if we keep on asking so many numbers of H1 and Gc and also exemptions
for Master degree then we have to wait for CIR as this will have lesser impact

Yes, you made a very good point. I totally agree with you. Most people here do not really care about the fundamental immigration reform as long as they can get their GCs. Maybe instead of asking for SKIL which is very controversial, we should just ask for visa number increase for a specific period, for example, 5 years. That will solve our problem and is less controversial. After 5 years, all of us here should have had our GCs. The rest of the problem can be left to other people.
