I am no expert on this but if labor substitution is eliminated it will remove anywhere from 30 to 50% of labor cleared from BEC. I know a lot of people who have applied for labor 2 to 3 times, they applied for a new labor every time they went to a new employer. It is these extra labor certifications that are being sold

That is a good idea singhsa, Once we have good number of signatures I will discuss with IV core. So far the response has been very good - 208 signatures and still going. Everyone is indeed frustrated at Lou and it is indeed high time we protested against the garbage he is propagating on his show.

Last night I called 10 friends and asked them to call. Few are on H4 and were totally up for it. Spread the message folks and call. This is our one chance to make things happen before November. We are almost there.

I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he is a lying, cheating bastard who changes his story all the time.
angelfire, before you go and make such a determination, please do understand the root cause of the issue.
EB3-I processing is stalled, especially after USCIS opened the floodgates and let everyone inside one time.
Folks who were waiting patiently had their clocks turned backwards and pushed at the end? Classic case of starvation.
Upshot - some with older EB3 PDs have ported their dates, after qualifying for senior positions based on their academic credentials and job experience and getting jobs under EB2.
Which is why see an odd 2002 EB2 PD suddenly appearing from nowhere and getting ahead of you.
How many are actually converting?
humongous EB3 number stuck in 2002-2003.
handful people actually converting due to risks involved.
That EB3 people should not be made to start from scratch all over again, however they should also not be given the advantage of a loophole in the system. We all knew the evil of LC sub and this is something similar to it.
However I do sympathize with the sense of desperation and hopelessness that people in EB3 feel when they don't see a light at the end of the tunnel.
There will always be condescending comments made by people on the other side of the tracks. Heck, I've heard some comments that completely put me off from taking part in IV and helping people who already have EAD (I missed the July 2007 orgy). But it is what it is, we either sink or swim together. If you see how many characters in Indian MNCs take advantage of the EB1 MNC executive category, you will be apalled.
Ignore and focus on what needs to be done would be my advice as everything somebody who is not a decision maker in the path to immigration is inconsequential.

I thought EB2 vs EB3 is mainly determined by what your job requires.. You may have a Masters but if your JD does not require one, the company cannot file you on EB2.

We are highly educated, skilled law abiding immigrants. Since we do possess diverse skills, we will be always welcome in Canada, Australia or New Zeland, and other similar pro-immigrant oriented countries. But we choose to stay here and make this country our home and make this country even greater for our children.
The process is not easy, and we have a unique opportunity to get something accomplished that will not only affect us but everyone who comes after us.

I believe the guy or girl who made comment on Immigration website has more like a grudge and might be carrying some old IV mistakes like lack of transparency we had in past etc. But gotta understand, everyone makes mistakes and improve.
More, I don't understand that if that guy doesn't want to contribute coz he or she is poor - thats fine. He will still get benifits from IV efforts.

"You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant." .
Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.

I was looking at the recent forum posts and there was no discussions about EB3 listed. Thought would "BUMP" this to bring the EB3 plight on the top...
