I do know recently where a person who got married before his greencard approval and filed his wife's case. He got approved but then three months after his approval; his wife has been sent to local office interview. I'll let you know what the outcome of that will be.
Another person was on F-1 and went straight to greencard through Schedule A. he got married after he filed for 485. Since he didn't have any non immigrant status; he could not bring his wife here. She had to do follow to join and chennai consulate asked all sorts of questions. Tax returns, w2's, letter from employer; when he joined and when he left.
Think of it this way; were you traveling before greencard with same employer? If you were then what would have changed that all of a sudden you don't like it. It would be a more plausible excuse if you didn't travel at all before and they started to make you do it after greencard approval.

Once it is I40 is appoved it will go to national visa processing .. .Once the pd is current NVC will send a mail to you to pay the fees. Once they receive the fees they will send all the documents to consulate . Usually i think it is 45 days to 3 months depending upon your luck. After that consulate will call you for interview.

I think we should wait for the lame duck session to finish, to make any predictions. Because if there are any new last minute stunt on anything non-immigration, then for the next 6 months or so for the new house, they will be discussing this new stunt. Immigration will take the backseat.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...
If you will be using EAD for new job, stop worrying about vacation. EAD is a "AOS" state meaning you are legally allowed not to even work so you can very well take vacation and even decide not to work till you get the green card. If you are playing "h1 transfer" then your vacation may become tricky if you do not get salary for that vacation. It may have an advese effect down the road. If I would be you and have decided to use H1 transfer then I would not go to unpaid vacation. If you will be paid for the vacation you will be fine for that too.

The Senater has released the skeleton of this bill that provides for legalization of illegal aliens as part of his Comprehensive Immigration Reform legislation proposal. This is a companion bill to his High-Tech Worker relief proposal. Folks I wish your suggestions would be helpful, but I have taken 3 infopass appointments, and to my badluck, everytime I visit I meet the same old-fat-lady who now happens to remember me, and says, "Didnt I tell you last time that blah blah blah ", believe me, she was not willing to even accept request to send interim ead , she gave some reason that NSC outsourced callcenter work to contractors who dont know what they are saying and send us to local office to request interim EAD. She says my FP for ead was done only in Nov(my 2nd infopass resulted in 2nd FP) so it will take 4-6 weeks after that to get EAD. Anyways I will take your advice for a 4th infopass next week.
Print that USCIS memo (see page 1) and insist that they follow procedures outlined in the memo. They required to provide you a written notice that they followed the procedures. Do not leave until they give it to you in writing. If they refuse, ask for their names and write them down. Ask them for a written notice that they refuse to follow the procedures from the memo. Try to be polite, even though it is hard during infopass, I know :) I know how frustratiing it can be when you go for infopass appointments, but be persistent and talk to the supervisor.

It is not the case that when the reduce H1b they need to outsource. Can any statitics tell that last 3 years H1b cap reached but because of that Outsourcing is done or US lost Compettiveness because there is no skilled workers. No evidence proves that. Still US only is having most technology companies.
If US lose 12 million illegals that will cause a problem for employers. But if 50% of H1b people leave the country because of green card issues then same or more number of people will enter by H1 or L1 or b1. That is the reason Skil bill was not able to pass in the Senate based on the fact that some abuses are in H1b. Skill bill can be delayed 5 years but impact will be less for the country. But impact will be more for immigrants. Also now H1b can be extended unlimited number of times when I140 is cleared. So really exodus will be very less compared to incoming persons. So there is no compelling reason for the country to increase gc. But for illegals there is compelling reason to act on them because illegal immigration will go uncontrolled if they leave as it is.

Any way, I think you don't need IV's (for that matter any organization's support) to file a law suit. If you think USCIS is breaking the law, you can file a law suit with the help of a lawyer. A couple of $100 is all that would cost you.

We need to get laws to help us and we need support groups like IV to make that happen. Or else we can pray to God to shower some green.

Do a real exercise and get a lobbyist to sign a contract with you for after revealing to them that you have only 20K. Try it now with even 50K and see how many lobbyists are ready to tow your line
2) Regarding your talk of Erin Brockovich and all, you do not even seem to grasp the fact that AILA is interested in the 11 million undocument workers. 500,000 skilled workers are nothing but a drop in the ocean compared to them.
In any case, have you done your part in contacting AILA? We have! Its easy to sit on the fence and complain but it takes conviction to actually DO something
3) Do you have any idea how difficult the task is to get amendments in? Do you know how much a fine balance the Republicans and Democrats achieved and are not ready to take on anything that might disturb the balance? I totally agree with Arunmohan- We H4's are not considered basic human beings here, we are not allowed to work ,may of us experience difficulty in getting a drivers license, we cannot have an independent bank account- literally we are considered as without life. I do wish I came in here illegally, at least i see hope for illegals in these bills - what do H4 Visa holders have to wait for !!!

One thing that forces you to believe its true is the date itself, why 8 MAY ? it somehow paints a picture that somebody did calculated the remaining visa numbers and arrived at the exact comfortable date. Guys, chances are its fake, but you never know. :)

Went to infopass, CR said we will sent email and you should get copy. ..nothing happened after 5 weeks..Callled USCIS..she said wait 75 days from the date of FP.

You are not the only one....my application was also sent on July 2nd and I got FP notices (both my wife and I) and AP approved (both my wife and I).
My wife received EAD on 10/22 and so far there has been absolutely no update on my LUD and EAD application is still pending. The service center is Nebraska and I am the primary applicant. I think there a a lot of people in the same boat.

Went to infopass, CR said we will sent email and you should get copy. ..nothing happened after 5 weeks..Callled USCIS..she said wait 75 days from the date of FP.
I thionk they have nothing to offer..just some new excuse..
