This is indeed a gloomy and (in my view credible) story. The only thing possibly that can help us within the current laws, is the visa overflow from EB1 and EB2 ROW.

I do have a copy of I-140 approval notice and also I do have a copy of the labor petition, but do not have the job code.
Attorney said that they have represented Employer also along with the employee and hence they need an authorization from Employer in order to answer any questions or to do any thing with my pending I-485.
Either this is not an honest statement (or an excuse for not working on the case if you already paid him/her), or the lawyer is not competent. You are better off with a new lawyer. Simply contact another good lawyer. S/he will file a G-28 form.

Yes, that is perfectly correct. If an employer needed somebody with BS and 2 yrs exeperience, and no US person applied. You (with a BS and 2 yrs experience) applied. Employer filed your I-140, which is approved. Now you wait for 4 years, and in the meantime you get your MS. Technically, you are now overqualified for the position, and employer may decide even not to consider you any more (leave alone upgrading to EB2). Note that entire process is for future employment after you get your GC, until then if you are working, you are working as a guest worker.

If I understand your question correctly, then if you are using H1 then you need to be on payroll all the time. Does not matter whether or not using AC21. This applies even after 180 days of your AOS. If you use EAD then you can be without a job.

You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.
Wait a second. If you are not adaptable to the new environment, it becomes a rat race.If the situation is not conducive, your smartness aint gonna help. I think thats what the OP clearly meant. Its not easy for a kid who is in 8th grade in US to snugly fit into Indian System. Coming to the IIT's, Have you ever compared the total number of seats available in IIT's to the accepted numbers from IVY leagues and other big schools. In India, you have to be the best among the best to get into IIT's. You have to be best here and oh yeah.. You dont have to lose some of the smartness to reservations. But I agree with you that parents should let children pursue their own interests rather than thinking about him/her being a doc/eng.

Success in the entrance exams to those Insititutions comes from focus and hard work. This does not necessarily mean that the people who go there are the best. They ARE definitely the best at preparing for the exam.

While this question may sound redundant, I want to make an honest attempt to understand it. How does creating media awareness translate into making politicians understand the complicated issues suffered by legal immigrants? Further do they give any weightage to the fact that the stories are in the media and therefore they need attention?
I am biased towards the opinion that we might have already run enough media stories. I believe that the real fight now is to convince the politicians to do something about it. Propaganda and lobbying is the only thing that works with politicians in this country. And you have to choose a medium that politicians directly refer to. Meeting politicians and their representatives in person is most effective I believe. With due respect to your views, Pappu, can we discuss some of these questions?

My PD has been current quite a few times since 06/2007. Last time when I called TSC, my NC was still pending. My FP was done during 07/07 and I heard from some one in this thread that FP is valid for 15 months only. So what should I do now. Should I go for an infopass and take an FP appointment ? I just got off the call from uscis regarding my I-485. My PD is in the first week of Mar 2006.
Per the USCIS website, they are suppose to process even the first week of Mar 2006 although the Aug VB says it is 01MAR06. I spoke to the second level IO and he was confident that my case would have to wait for the next month. I insisted that the uscis website says otherways, he went and verified with the third level (or his peer) and came back and told me that I was correct.
Infact told me that my case was pre-adjd and being reviewed by IO currently.
I am sure the same applies to you with the Sep VB. Good luck !!!

What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.
There are a few options:
1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.
2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.
Pros & Cons:
Consular:
You get your GC as against EADs endless loop.
You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.
AOS:
You and your spouse both get EAD. NO need to travel to foreign country.
You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
More time consuming and longer duration.
The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.

From your response CP looks like a better option but its too risky in my case correct?
