All,
IV supports AILF efforts to file the lawsuit and feels that if the lawsuit has a favourable judgement then, it will provide respite to lot of people in the Community IV represents. IV is not an organization which works with one motive and that is to get people out of the greencard mess and IV will support whoever helps its member community.
We feel that revision of Visa bulletin was not correct and AILF is absolutely correct to file a lawsuit against this directive and hence we support AILF in their bid to sue USCIS & DOS

Guess What from NOV - 08 to July 09, the VB will have older Cut off dates and after July 09 DOS will open the flood gate and move the cutoff of to 2007 or even 2008.
USCIS will start approve the cases with later PD's and the leave the older PD's on the air.

because the backlog for EB3 is currently staring at close to 10 years and an EB2 requirement is around 5 years of progressive experience, which might enable many of them who would have progressed in their careers due to a 10 year wait for green card.
Why not EB2 to EB1 is because, EB1 is for exceptionally skilled people(athletes, doctors, multi-national managers(via L1A) etc). For EB2 candidates to be pushed to EB1, they need to exceptionally skilled which cannot be gained via experience but by acquiring skills which will place them in those categories.
If they can acquire those skills, then they automatically qualify for EB1 or EB1-NIW and can apply anytime by themselves. Note, EB1 does not need a labor approval too.
Hope that makes clear the distinction between EB1, EB2 & EB3. Employment-based GC applying lessons 101...of course this is the simplest one...:D

In 2005 my first kid got an OCI as the rules were diiferent then but in 2009 the current rule is that one parent MUST be a US citizen and I had to take a PIO for my second kid in 2009.
Following is from the FAQ`s of Indian consulate at SFO
6. Are minor children whose both parents are Indian citizens eligible for OCI?

Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. Seems like your end goal is to get GC, have you considered option of waiting for your son to become 18 so that he can sponsor you for GC? That might be an even faster option than EB2, considering the current backlog.

Thanks for your suggestion. I did query about the kind of advertising that we can do. It doesn't look like we'll get much money. Since most of the people are viewing the forums and forums typically have low advertising rates because people using them tend to be highly engrossed in the topic.

If your case is older than 12 months from the date of judgement you can have your case expunged from public records. As of today your's is a public record and is on every entry point in the country. As per immigration laws the IO has the authority to turn you back if you have been found guilty. The best for you is to have the expungement of your case and no one will have the access to your case except FBI.. This may take anywhere 2-3 months from the date you file for expungement..
Avoid travelling till your expungement is done..to be considered for expungement there should not be any other sace pending against you.
Good Luck.. talk to your attorney and file for it even if you are not travelling it will be good for you for future employment etc. also..

For those of you who qualify, HSMP , I think is a much better option. There in UK the permanent residence is not dependent on employer and you can do your own consulting. Typical bill rates are 350 to 600 GBP per day based on skill level and years of experience.

I got EB2 140 approval (I have BS + 5 years of experience)
This is becoming very hard now especially at Nebraska. just wanted those sending applications now to know that Nebraska has recently rejected hundreds of (i) EB2 cases with x yrs of experience + BS even when x is 10 and (ii) EB-1 cases even with Ph.Ds (this accding to my lawyer.)

As i said lawyer told me that no use of MTR. We went with EB3 and now i am on EB3 train with I-140 approved. I was wondering that can i re-appeal now after 2 years .

Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.
It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....
Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.

My EAD renewal was filed in TSC in the middle of June. Now it is more than 2 months I haven't heard anything from them. I wonder do they request for FP during EAD renewal ? When I applied for EAD first time in 2007 there was no request for FP and the EAD was approved without FP. But I have seen several posts where folks mentioned that they have got FP notification after they filed their EAD renewal. I have done one FP beginning of 2008 as part of my AOS filed on July 2, 2007. So, I wonder do I receive another FP notification as part of my EAD renewal or USCIS can use my existing FP (they may have in their system) ?

If you are single and are in a position not to get married b4 August 17th please think b4 applying for 485. It is of no use to you unless you want to switch jobs on EAD which is a HUGE RISK!!My guess is you are going to get married at some point of time(Barring guys who are already in their midlife crisis b4 marriage) and would apply for your wife's Adjustment of Status. Please apply 485 togather when the PD bcomes current again. Bear in mind that even if you apply now b4 marriage you have to maintain your H1-B status. It will only make it worse when one had already applied for I-485 coz you could only get 1 year extensions as opposed to 3 years when you have an approved I-140 and have not filed for 485. Don't get overzealous and apply now and regret later!!

Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. But you see every player in this movie, you, your hiring boss at the client site, the middle company, the lobbyist, the lawmaker and many more, they are all being paid from that $180/hr which you think that you are entitled for because you know Oracle BI and Congnos. Do you realize how easy this ETL, Informatica bull &hit is but somehow you seem to think that its worth $180/hr. And you seem to think that your problem is that other than you, everybody else around you is faking resumes. If you are so smart answer this, how will you avoid using two bitmap index on two columns in two tables when used in the same query? And why would you want to avoid using both the bitmap indexes? Yes GC/EAD gives to room to look around / negotiate the higher rate , to sustain and move up will require a lot more than that.
Look at the aveage compansation for any area.
Assess your expertise ( not to compare with you the guy sitting next to you)
Try to move up in the ladder
Keep updating your tech skill
Diversify to more ( but related ) skill.
Add niche like PMP / Six Sigma.
Top of all , little bit of Luck , to be right place at the right time .
