Folks,
I would like to run a questions by you guys/gals. I am getting ready to file my I-485 application. My lawyer requested that I find all copies of my I-20, OPT EAD, H1-B's etc. My question is do we have to submit copies of I-20, and OPT EAD for the Adjustment of status (I-485) stage ? Please let me know what you think ?
I-20 is from a university that accept students in the US. The F1 student visa is issued based on the I-20.

Two weeks is substantial considering that in May EB2I movement is supposed to 0 days. :)
On a more serious note, Shusterman had to adjust the statement because everyone is going to question their credibility when the VB comes out and if it is only 2 weeks and not the 'years' that they claimed. Shusterman is just another person who spoke too much too early.

US is made by immigrants and the immigrants should feel great about this country since this country gave us opportunity. Look at the things that is happening to us since last few months.
1. CIR bill introduce with lots of provision for Legal immigrants such as reduction of visa numbers to 90k, some people need to apply under new points system, and higher fees for renewing H1b visa. (Supporting US government)
2. Amendments introduce for legal immigrants coming to US on H1B visa or who are on H1B visa. No renewal of your H1B visa since AC21 was removed from the original bill. (Immigrants can go back to thier home country quickly).
3. VB came out with all the dates current. Majority of the people spent approx. $4000-$5000, and time so that they are their family can have better life. On July 2 2007 VB dates will show 'U'. (Supporting US economy)

On October 18th both of us received the fingerprints requests, which have been processed on October 27th. My wife’s case has been approved in February of 2007. She had her citizenship interview on March 16th, 2007 and became the US citizen on April 11th, 2007 after taking the Auth of Allegiance.
I have not heard anything about my case since the fingerprints appointment. I have tried calling the USCIS Customer Service Number but they did not have any updated information about my case. I have also spoken with the Immigration Officer in the local USCIS office (InfoPass appointment) on July 27th, 2007. I have learned during that interview that my case is pending due to the FBI Name Check. The estimate that has been given to me was as long as 3 to 5 years, maybe more.
So as of now my application is pending together with 320,000 others. Well since it's been pending for almost a year now I'm a proud member of 152,000 who had been waiting for more than six months, slowly moving to join more than 61,000 lucky ones that had been waiting for more than two years. Hence my next question.
4. Did anyone hear the Name Check clearing between one year and two? Based on all of the people I've talked to it either took just a few months or more then 2 years. Seems to me once they put your file in that special pile it will not take less than 2 years.

I am sorry if I am wrong, but do you think if IV CORE try to hold a meeting with top CIS officials on this issue, wouldn't that be more effective? Many members reported not getting proper response to letters. Who knows whether anyone @CIS has time & willingness to read and act on our letters? Why not take an active approach rather than passive one?
I agree, We still should send the letters though. I will send mine by monday Nov. 10. Meanwhile, if we can do the webfax or email, we may can have more members participate. just my 2 cents!

Actually this letter campaign is just one part of the whole exercize. There are other efforts to talk with USCIS officials but to get positive/quick results we need to make enough noise so that officials recognize that it is a problem affecting large number of people. We need to keep on sending letters.
As can be expected its not an easy task to establish a proper channel and talk to officials and make them agree that recent spate of denials are wrong and are not in accordance with AC21 regulations (as someone pointed out AC21 regulations are only guidelines and not rules - so we need to tread a careful path here). To establish this proper channel and also for strong negotiation in our favor - we need to bring attention to this issue. The best way for that is to write to them - of course we might receive some generic replies, its fine - but if we send hundreds of letters with same request/complaint it does will catch their attention and help us in speeding up the other steps that are thought of as part of this campaign.
But first thing is to write - its kind of disappointing to see the number of letters sent (or to be sent). It only takes a few minutes.

All,
This is a non issue now for all practical purpose because of recent Job Zone change for Computer Information Manager.
The porting to begin with was unethical in our mind and we took a stand. We were challanged by several people on this forum but they did not realize the extent of our convictions.
Unlike others with their lawsuits Ideas, in this case we did follow up on this issue by contacting DOL in early September with our greivance along with a famous lawyer on our side. Enclosed is our letter to Secretary of Labor Elaine L. Chao and other senior officials. We would like to think that our effort has contributed to the recent change in the Job Zones for Computer Information Manager, as that was specifically mentioned in our letter.. This was not exactly our intention as we just wanted DOL to put some more control around the labor certification process especially for the ones who already have a labor approved. Hence our apologies for the unintended consequences of this effort on the future applicants.
Thanks to these members who actively/morally supported us.

There is a difference between laws and regulations. Laws are what in INA (Immigration and Naturalization Act) and Regulations are what in CFR.
It takes congress and senate to change laws where as it takes discretion to change regulations. And the good news is that discretion can be challenged.
There is another thread on the issue and some of us think that we do have a case. Initial response from a certain lawyer has been positive.

The affected parties (i.e. us) need to show damage in certain way and I do have some points that can be used. Our primary point is that the spirit of law has not been upheld.
Following are the steps in making this a reality:
a) Gather around 50 people
b) Develop and finalize draft of the case. Rolling_Flood has a initial draft.
c) Hold initial consultation with a lawyer.
d) Decide as a team if we want to continue.
e) File a class action suit
Not sure what is the total cost but given the years of wait and uncertainty $500 per person should be reasonable. I will also create a yahoo group to start these discussions.
Notes:
If you already have applied in EB2 you won't be affected.
If you have a Masters you won't be affected.

I guess these cases that qualify are all propbably pre-adjucated. In that case will it increase the processing time for PERM, I-140 and 485 stages.
