Here is what my lawyer sent me! Forwarding to you all so that you can get some idea what they are planning to do. Of Course she is charging me 250$ for this info!. I am sharing this as you have contributed and Will contribute to IV.

As you know, you and your wife will be able to file your applications to adjust status to permanent residence in July 2007. You will need to prepare the following for your adjustment applications:
1. Form I-485, Application to Adjust Status. You can find this Form on the Internet here:

Please complete this form in draft format for you and your wife. Please write "unknown" instead of leaving questions unanswered.
2. Form G-325, Biographic Information. You can find this Form on the Internet here:

3. Photographs. You and your wife must each have six color photographs taken in accordance with the photo specifications that you will find here:

5. Birth and Marriage Certificates. Please send us a copy of your and your wife�s birth certificates and of your marriage certificate. 6. Medical Exams. You each must have a medical exam done by a CIS approved physician. It is my understanding that it is already becoming difficult to get appointments with these physicians. You can locate these physicians at this website:

These are very tough and partisian bills (immigration bills). This also being an election year, some lawmakers will try to puch their own agenda. Don't expect a featherbed solution. This will be a dogfight.
This time atleast there will be some democrats to vote for our bill, unless the anti guys find some way of preventing them from participating in it.

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. The British made us feel in the hey days that living in our own country was a previlege extended by their administration...even in that environment...Gandhigiri worked....but not without several initial failures..and Gandhi himself had acknowledge that non-violent resistence can succeed even against hitler but not without several initial failures...
The fact that we could get Mr. Gonzalez to even respond to the flower campaign itself speaks that Gandhigiri has worked...the publicity that this will generate will be of immense help....

I think the thread is perfectly valid and we should go for it. If someone has paid income taxes to US for 10 years, it is no mean thing. 10 years represent typcially about 25% of his/her earning life. After spending substantial percentage of one's life living in, and making contributions to, US, especially in his/her youth, the guy is more naturalised except that he does not have a citizenship card. Now how many of these guys will be able to slip back in to their own country to readjust their lives with american born and american grown kids.
I think it is not only reasonable but also humane for the government to consider the plight of such people and issue citizenship. The yardstick for qualification will have to be worked out, but Saralayar listed some of the valid parameters like
- 10 years working in US (legally)
- 40 points in social security
- no criminal record
If I may share my thoughts on yardstick, it would be like this
- 7 years of legal residence, contributions to SSN, and taxes should provide provisional GC
- 10 years of legal residence, contributions to SSN, and taxes should provide citizenship
- 7 years of legal residence post approved I-140 should provide citizenship
Most of us in this forum must have already contributed over 75K-100K to IRS over the years. I strongly believe that the govt owes more than an obligation to take care of the interests of this skilled group.

To quote it in a much broader sense, America is not the end of the world - period! Just take it easy and enjoy life...don't freak out if the visa bulletin updates and you don't get to file your 485...we are all in this country by our free will..if we feel the rules of the land are not fair to us..each one of us is free to leave....
On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...
Agreed it is not the end of the world... but no monetary sum can reimburse the stress we've gone through and going through, the number of years worrying, the numerous decisions we've deferred, the immobility of career we've gone through... just in anticipation. They just brought all these people to the well to quench their thirst only to find out that it's but dried up.

apply for EAD for sure as it will help if your wife wants to work.
apply for AP if you think you will not have time to get the H1 and H4 visa stamps in your passport when you travel to your home country in that case you will have to entter back on AP

We have no idea how many are legally porting from EB3 to EB2. I am sure many are trying but the data is not available. I dont know how you will move forward without such information.

We should send emails to Jon Stewart, Stephen Colbert, Jay Leno, David Letterman, Conan O'Brian, Jimmy Kimmel etc.
They have tremendous amount of viewership and seems like a perfect material for these shows. I will send email to these guys but if more and more peple can make them aware of this development, this news can potentially snowball. :D
