Q-1 (07//19/2007): I filed I-485 application on July 2, 2007, but have yet to receive either rejection or receipt notice. Will this application be fee'd in under the reversal of the USCIS decision?
A-1: The DOS withdrew any changes to the original July VB and assumedly visa number is current in July 2007 for any categories other than "other worker." Accordingly, the 485 application which you submitted on July 2 cannot be rejected by the USCIS at this point. The USCIS is likely to fee in your application and soon issue the Receipt Notice.

you can add your spouses before an I-485 is approved. Once its approved, then you are in trouble. These dates are current only temporarily, and retrogression ("severe" as per the bulletin) is expected again soon. So go ahead and file your I-485 right now if your PD is 'late' (2006 or so) you will probably be on EAD/AP for a while.
if your PD is 2003/2004/2005, then as soon as 485 filing is done, start looking for your life partner :)

Now the question is what if (I know a big IF), but what if, I apply for my 485 (hoping that my 485 will be on EAD/AP for a long time) BUT my 485 gets approved rather quickly and I am not able to marry before that happens -- do I have *any* way to tackle that issue? Or would it then mean that my wife cannot come in US for n number of years after marriage?!

The mistaken notion "GC = freedom" seems so pervasive that I am also tempted to take a whack at this much maligned equation. Lot of anguish can be spared by keeping our expectation from this 3" X 2" plastic somewhat grounded in reality. There is no denying that having GC makes life easier than before, specifically by opening up more job/career opportunities. But these have nothing to do with the constitutional freedom that you presumably allude to with your Statue of Liberty analogy (I should say though, as a metaphor this quote of your colleague is pretty lame). Not only GC does not give us the right to vote, it cannot even protect us from deportation risk on relatively minor legal grounds (http://www.nytimes.com/2008/04/12/us/12naturalize.html?_r=1). It is perhaps wise to remind ourselves that GC is a privilege (http://www.wr.org/media/pdf/immigrationassistance/permanentresident.pdf), not a right.
Here is the other thing I do not get. What is so hard to do in the list that raises such heckles of hair loss, back-in-good-ole-days-life-was-better, and whatnot? It is all about doing little day-to-day things such as maintaining documents (that you would do anyway), or carrying PR card in your (already bloated) wallet, and other mostly mundane stuff. IMO, this is the biggest problem plaguing IV - perception of IV as just another online forum (community) or a "chat room" as a newspaper reporter put it ! (http://www.freep.com/apps/pbcs.dll/article?AID=/20071123/NEWS07/711230422/1009) (under the heading "Taking Action").
This point IV = chat room has come to the fore, several times in discussions. A lot of persons have refused to join IV efforts with the ruse "IV is just an online forum where members discuss mundane matters". Whether someone admits it or not, IV has a serious image problem !. It needs to be corrected soon (by more than making another announcement type "We are not a forum" post !)

This is really sad that they count all dependents under employement category. USCIS should treat all categories in same way. Can't we raise this issue?
Thats a very good point , If they dont count the dependents in Family based cateogry , why are they counting in Employment Based cateogry . Again may be rules are different but we can defiently raise this question

I hope any of the accounting Guru's here help me answer this.
I got an RFE for ability to pay. My current wage is 4000$ less than the prooffered wage. My company filed 1120S and there is no net income line on it, there is only a Ordinary Business Income (total income- Total deductions) line which has 6503$. Is Ordinary business income considered same as Net Income?
My Lawyer is trying to include a cover letter arguing that Current wage + Net Income > Prooffered wage. Do you think "Ordinary Business Income" can be considered as "Net Income".

I would recommend consulting an immigration lawyer, as w/o that its just mere speculation on what an individual thinks...also historical data cannot be used in current times.

All our I485 applications had a soft LUD of today. Recently I applied EAD for my son and it got approved within 15 days. One of my friends got LUD and later (after 2 days) a Hard LUD that they sent an RFE. Our SC is Nebraska. some of my friends also had got Soft LUD 2 weeks before but no change inside... Not sure what is awaiting us. Hopefully its all pre-adjudication. Any insights will be highly appreciated.

Don't worry about what feedback people gave you. People are jealous of you. Understandbly so, because of dates going back all the time. You deserve what you got and you got what you deserve (I mean the citizenship and not the lousy feedback no one should care abt). You have pretty good educational background too.

We received the RFE for the Td vaccine that was missed somehow by Concentra. But since she is nursing now, we were able to get a blanket Waiver for her.

There was another LUD for all three of us (Self, Wife and daughter). Also received a CRIS email for wife with an RFE. I hope this RFE is about her incomplete vaccination at the time of filing. Will post the RFE details when I receive them from attorney.
