A quick analysis of election results and its relevance to us:
As of 11:45 PM PST, House has gone to Democrats in a landslide; the Senate is on its way depending on outcome in Montana and Virginia. If Democrats win MT and VA (Jon Tester in MT, Jim Webb in VA), the Democrats would control the Senate too...
Thirdly, Jon Kyl almost lost his Senate seat in Arizona. If it’s any indication that anti-immigration noises are no career-savers, this may be it.
I agree with everything as you said. Darn, but certain Congressmen from Wisconsin and Colorado made it back - of course, without the clout.
As Fareed Zakaria pointed in a recent article, (I cannot find the link, somehow) Immigration reform is the only issue that George Bush, Hillary Clinton, John McCain, Ted Kennedy, John Kerry, Rudy Giluiani and Nancy Pelosi agree on! How many such issues are there? I cannot really think of one!
But, would like to point out something about Senator Kyl, who may have voted against CIR finally. But, he has not been against legal immigration. In fact, he had co-authored the Cornyn-Kyl version, that was a variant of the final compromise version being floated in the House. As far as I know, he opposes only certain aspects - but does not have an anti-immigrant stance, as such. He is, of course, better known for his work in healthcare legislation, where he has been very close to what most doctors have supported in terms of Tort Reform, to reign in rising Helathcare costs. In other words, he is more balanced - that may have been the saving grace. But, your analysis is also correct - voting against CIR did not bring him a landslide!

It was such a shock for me on friday when I received the email so anything I typed was in a panic. so don't worry about the spell check.
Myself or attorney has not received the original letter so until then I do not have more info and I came to this forum to see if anyone had similar experience and any feedback.
I normally use murthy forum and friday when I was talking to a friend he suggested some folks here had already gone through similar situation.

John King, CNN happened to mention yesterday on AC360, that CIR can be passed in the blink of an eye. He seems to think it is the easiest thing to do for the president and the Dems in the current situation.

I understand that you guys have done a lot with limited resources, but trying to isolate yourself from the issue of illegal immigrants issue is not going to help us either. We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).
I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B�S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator�s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant�s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Which is why any amount of hue and cry is not going to change the situation? Luckysiri, I am sure things will work out for you and your family. You definitely need to expose and name your employer whose sadistic attitude caused so much pain and suffering during these critical months. We need to teach such employers a valuable lesson so that they don't ruin some one else's peace of mind. Good luck.

When you "joined" them what was your situation? Were you previously on H1? When did you learn the fact that employer is not supposed to ask for money from the employees? If you knew these facts before you joined, and you joined them because of your situational needs, you may be considered a party to the fraud yourself. So if you did know about these situations beforehand, it is in your best interests to stick around till the contracted period and then decide on your next course of action.
Your recourse to the law will be only when you are without guilt, from most of my understanding of how "desi blood suckers" work, they are not the only one taking advantage of you. In most, if not all, cases, people joining them do so because of their weak situation.

It is not joke, that's my unbelievable terrible start since this March. When we look back, still think it like a nightmare. And one neigbour told cop she heard my wife shout "Help me, he is gonna kill me." But you knew we even don't speak English at home. Where that ridiculous words from? BTW, when cops come, they firstly mis-arrest my another neigbour, as they also have some argue. Probably that is where it from.... But now that everything we have to explain on the court and convince the jury. Fortunately my wife always stand on my side.
Anyone could tell me what impact to my 485 approval if damn jury find guilty in my case? Thanks a lot!!!!!!

1- Each one of us buys 10 bath tub stoppers (you know, the stoppers you use when taking a bath, to stop the water from going down the drain) and mail them to Congress, Media, USCIS, etc- With a letter "Please stop the self-inflicted U.S. Reverse Brain Drain, already 100,000 highly-skilled have left, stop the 10-year green card delays for LEGAL highly-skilled immigrants that is pushing them out of the country in frustration and lured by the boming economies of their home countries. Technically it should be your original receipt date , thats means your wife 140 should be processed now but guess what that happens only if TSC finds your wifes file , not sure where the tranfer cases are stored , If they use computer they will definetly find the case but looks like they find the cases by boxes ... I m in the same boat and waiting for 140 approval after transfer to TSC , hope they find our box one day

it is the job profile that dictates whether the case is eb2 or eb3 - the applicant should meet the criteria for the job. not the other way around.
Sure. h-1b is now; labor is what you are going to do when greencard gets approved.
try telling a consultant who is qualified for eb2 that the job dictates it is eb3 and they won't sleep or eat -:).
Reality of the process and how it works is quite different. If you really wanted to pick on things; DOL assessment of education and experience dictate that all of the IT positions should not require more then bachelors and four years of experience (ever IT labor filed with eb2 requirements it to be answered that the job requirements are NOTnormal for the positoin.
If companies don't want to file eb2 then employee will not stay (they cannot fathom waiting 10 years for greencard).
