Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .

That is why when you feel like venting out you need to really select people that are more compassionate. No one expects a pity party, but at the same time no one should trivialize something as serious as this or give "advice" that is idiotic and that even they, had they been in this situation, would not do. I feel terrible for your friend because he has such education and is stuck like this. It feels like you're wasting the best years of your life just waiting. There is nothing that I or anyone can tell you or your friend to make you feel better but please listen to me and learn from my mistake, and tell your friend, too: DON'T WASTE THIS TIME. If you need to volunteer somewhere to use skills that you have that you are not allowed to use on your present job, DO IT. Or if you can take classes to learn new skills, DO IT. Find a way to be more than what you are now so that when this is over you are not just "floridasun, man stuck in the same job for 10 years" When you finally get out of this hell hole and someone looks at your resume and says, what, you did this for how long!? It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?
The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

Can anybody answer this question - If an employer decides to port an EB3 case to EB2 for an employee not using the experience gained at the job, does the new EB2 role have to be 50% different from EB3 role?

Excellent news.
Now we are getting support from both the parties.
First the State Governors wrote a letter in favor of Legal High skilled Immigrants and now the GOP writes to the Dems in favor of Legal High skilled Immigrants. We can't ask for anything more than this. This is the right time.
We should bang on people like Zoe Lofgren's doors and ask them to create a bill which would only deal with us - Legal High skilled Immigrants. I think all the immigration bills presently on the floor has both legal and illegal immigration and so it would be diificult to pass them. In this present atmosphere a bill on legal high skilled immigrants could easily pass.
Core IV, please look into this and provide directions.

The earlier who mentioned about hard hitting a car on Tree/building to shake the robber and run away is absolutely misleading peoples. There is no reward for bravery or mental sharpness in US for folks who wins a fight with robber or outsmarts them.
How much the Robber can steal from you - Couple of hundred cash, 5 credit cards ( which you can immediately cancel if you are not injured) and some important contacts. Be Nice with him and give him what he wants, tell them that you understand their situation and be sympathetic and polite with them.
I once did that and the robber just took 20 bucks from my wallet, 3 Marlboro Lights cigarettes and returned me the rest of money,credit cards,my SSN card and important contact papers and my rest cigarette pack and told me "you look like a nice guy".
Don't panic seeing robber or don't make the robber panic by shouting or banging your car on the building :) Robbers are just human beings like us with pathetic economic conditions ....

I talked to USCIS information center at (202) 272-8269. They asked me to submit Form G-639 (it is available at www.uscis.gov --> under forms section). It has all the instructions to request the copies we needed.

No vkkkk, I'm not playing. What some people are saying is logic and what i'm saying is the fact. You seems new in this form. But i think most of the people here are serious and try share their sufferings, free help from freinds (virtual).

That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I am guessing that either you are IV core or very close to it.
so can I just ask ... is IV planning any campaigns at all in the near future (i.e. in the next 2-3 months) ?

At this time we have request for interview from over 7 highly reputable media outlets including NPR Marketplace, NY Times, LA Times, AP. We have asked members to interview if they feel anxious about the current state of the affairs. Can you guess how may responses we have recd till now? Is this not part of the effort/campaign? There are few members who will spend whole day discussing sending pizza or fight over tracker data. But we struggle to find sincere members who are ready to interview with the top media outlets. This indicates to us, either everybody is extremely comfortable with wherever we are and no one is feeling the pain, or just 2-3 of us feel the anxiety due the economic slow-down. If over 30 members can discuss for a period of 3-4 days about sending pizza, and the objective is to attract attention for our provisions, then is it not possible to achieve the same with the available media opportunities. Getting media opportunities is a difficult job. And its extremely frustrating to see lukewarm response to the action items and request for help from the members. Please understand that there are many aspects of our advocacy effort. We may be focusing on a specific aspect at a particular time, and its possible that you want us to work on something else. It doesn't mean that we are not working on a specific campaign right now. So I am baffled by your question of doing a campaign in next 2-3 months.
It is possible that next month we may see new bill from Sen. Grassley and we may have to re-adjust our effort to respond to such a bill. Political events are not predictable, but we have to respond to every developing situation. We are always very sincere in the community effort, so I request to please support the effort, even if you do not agree with it 100%. And please participate in the action items, because they are always part of planned activity and is not an abrupt absurd idea.
Campaigns are not based on a specific provisions, even when everyone of us sees it in that light. Provisions are the end product of every campaign. But to achieve our provisions, there is a long drawn process, which includes multiple stages. I am not able to list all the stages in a single post. But I will encourage you to see this document -

My interview is scheduled on 22nd Aug but not received letter yet.

FP on june 28th, still no approval.
My current EAD expires September 24th and i am working on EAD currently.
Called USCIS and opened a SR on August 4th. Got a letter on August 11th, saying, although my situation is serious, i have not provided enough proof. Called USCIS August 13th, asking where i can mail the proof. Was told there is no mailing address and no fax number.
Scheduled an Infoapss Appt. for August 18th, by then it will be around 82 days.
Around the 90th day planning to meet my Congressman/Senator and hoping they could help me.
If some one can help me in finding fax number to TSC to send in my Expedite request it will be great.
GO IV GO.
