This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
So life is not always easy. There are people waiting since 2002-03-04.
Don't think that life is not a FIFO always.

As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.

In the name of thinking differently we have smitha, senthil1 , asdqwe..and these guys confusing this struggle / fight for us trying to get ahead of the line or as senthil1 keeps saying uscis/dos made an honest mistake and asdqwe..keeps saying we need to fight for legislation rather than wasting time with these efforts. What all these guys and their ilk fail to understand is most of us are pissed off about the way it was implemented and handled rather than the ability to file AOS itself. If we sit and do nothing is like asking uscis / dos to walk all over us again and again. Besides in US law whenever there is a gray area, the decisions are based on precedents. This means if they have done this now means they can do this in any bulletin hence issued. They can issue a bulletin in Oct 2007 and on Nov 2 say "oops sorry my bad wrong bulletin" . Please come out of the basement and face the sun.

Why should US give us Green Cards? Why should they even extend H1 beyond 6 years?. If they do not extend H1, always new guys can keep coming on L1/H1 and the cost to employers will be much less. USCIS can have lots of money for H1 renewals. Only the body shoppers and end clients will benefit. Are you supporting more body shopping?
L1 dumping is VIOLATION. They can not work at client's place. When there is a competition, it should be on fair terms. If your pay is XXX K, other H1 or US Citizen/GC holder will compete with you for that salary plus minus 5-10 %. But these OUTSOURCE company's that dump L1 are competing for that job with 30-40 K. Can you guys believe this? Ask that guy from that BIG outsouce company, he will tell you, he is on H1. Take him for a drink, he will cry infront of you that he is paid peanuts and is on L1. He took this job as he wants to come to US and that his spouse can work. So he can afford to work for that peanut. Can H1 holder compete with these guys where our spouses can not work? Even Citizens and GC's can not compete due to cost of living being higher.
If you are on H1, at least you can not cheat on W2. But in L1, there is no minimum wage rule.
If you do not want to support the OP, it is OK. But do not stop some one trying to correct the violations.

No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.

I am not sure if I am correct, but I have heard it is totally up to you what form to use when re-entering the U.S. If one posseses a valid H1 and AP, it is up to him what to use. Many people choose to use H1 to enter to safeguard status while I485 is pending. I may be wrong; but I could swear I read about this some time ago.....

Based on what I read earlier in another thread, it was mentioned to choose option 4 which is to reports cases that were seperated. I tried that, reached an IO. IO told me that I should not be calling that number to check the status of my case. Do I need to choose another option?

POJ method can be used for all cases that are current and in the processing window...just keep on trying ur luck and I am sure you'll land a decent CSR who will be much much more useful and worth your trials and efforts.

Write to Janet Napolitano and mention that you are unfairly getting delayed and that you want to know what is holding your application and all checks and clearances done and visa number is available...

yup - i got duplicate CPO emails as well - one on sep 1 and another on sep 2. The LUD date also changed from sep 1 to sep 2 after the 2 updates. Today i got the 485 approved email.
Dont have the GC in hand yet - looks like none of the folks who got current in Sep have received their GCs yet. Speaking to some folks who got current last month, it seems like most folks had GCs in hand within 10-15 days of the first status update regarding CPO.

If waiting time for GC is reduced less than 5 years then this may not be needed except for persons those who are filed GC before 2004. The environment is so tough that they trashed non controversial recapture bill on 2008. So it has to be decided based on how the CIR will shape up this year.

This is a dumb idea. You want the US to give you Citizenship while you have an approved I-140 and AOS status??????? You don't even have GC !!!!
Do you even know the reason for the law that states you have to wait for 5 years after getting GC to apply for US Citizenship?
And what is this nonsense about boosting the economy because you pay mortgage?
Please don't waste time on this - GC confers enough benefits for you (and family) to be able to live and work in the USA without ever applying for citizenship. The only benefit you don't have is to work for some US Govt. agencies, to vote and no visa-free world travel (mostly) or sponsoring some more family members to take away more of the social security fund.
If you read the plan, you are essentially asking to by-pass all security laws and telling the US to sell you GC and Citizenship.

Assume your school makes your 4 year course extended to 6 years and in the process makes you do a lot more..What do you ask at the end of it. 4 year degree or a 4+2 year degree.. .something similar..

Correct me if I am wrong. If a person has a good paying job and if he decides to foreclose, isn't he responsible for the loss incurred by the bank. It is a different case if you have no income, but just because you lost money because of a wrong decision, how could you walk away free with just a dent in your credit history. Maybe I am missing something here.
BTW, I am not judging OP in any way, just curious with how foreclosures work as they make headlines everyday now.

Answering to the question about making bad decision and having a good job..well it is not my bad decision that has brought down the whole market but the banks and stupid people who took loan and didnt knew the consequences of ARM loans and then started filing for foreclosure.. because of those foreclosures the property rates have went down and i cannot get what i paid for the house.
if this whole mess was not there then anyone can find a good job and sell his house, if not profit then atleast with no loss..

From other forum, someone said that it is extremely difficult to legalize the illegal aliens due to recent huge economic recession. But if each illegal aliens give non-refundable $5000 immigration entry fee to the country, the country will have about $60 billion fixed income. Then I immediately have thought about if our international students who have stayed in US for 5 years or above give more immigration entry fee to the country, the country will have tremendous cash flow into the economy and may help the economic crisis. Thanks for the compliments, I'm happy but we will be thrilled if apart from compliments, if you've said that you have just written to change.gov or to atleast one or two reps. Just spend a $10 on postage stamps. Dont think the reps dont read our letters.
If you want a green from me, in your reply, please reply with atleast that you have posted this on change.gov, under Agenda--> Immigration--> Submit your ideas. OK? after really doing it.

Now to this post.. Ofcors how can I not include you in this.One of the last points clearly says to give a greencard to anyone who graduates here. Now its upto them to let in quality students., I support filters at entry level into schools or jobs, not to those who have spent 5-10 years here..
My point is 5 years in US legally and 10 years in US legally. No matter if you went to school, or were on H1 from day one.
Also I am sure you have good # of friends in situation like you are in. Pass this message to them also to write and also about IV.
But dont wait for anyone to come and help you out. Create a snowball affect which gathers mass as it rolls.

I have a question on your solution#4) "granting citizenship to people who have stayed in US for 10 years by rules to pay taxes". The 10 years ----are you talking about several years of study plus several years of working in US in H-1B visa ONLY or for any people who have legally stayed in US for 10 years??? I raise this question because I am curious to know whether I will fit this category. I was a foreign student in US for 10 years and pay foreign student tuition fee in full for 10 years. The first 6 years in several degrees and then back home and then come to US again for professional doctorate degree in 4 years. Originally I find employer to file me the H-1B visa but the quota for Master degree or above is full and then I back home until now. I am sure someone has similar situations to me!!
From other forum, someone said that it is extremely difficult to legalize the illegal aliens due to recent huge economic recession. But if each illegal aliens give non-refundable $5000 immigration entry fee to the country, the country will have about $60 billion fixed income. Then I immediately have thought about if our international students who have stayed in US for 5 years or above give more immigration entry fee to the country, the country will have tremendous cash flow into the economy and may help the economic crisis. i just called DOS. He asked for my visa type and passport number. He said "your visa has been issued in Jan. Call the New Delhi consulate and they should let you know if it would come through mail or do you need to go pick it up"
what happens next ?? how long after this stage it takes to get the visa ?? are there any other checks that could be going on ?? ONCE DOS approves are there any other agencies like FBI, KCC doing some other approvals as well ?? if you know what happens next let me know..waiting for posts..
so now i know I am not stuck due to PIMS and DOS cleared and approved my visa in Jan..what else then ??
Well dats a positive sign then. Dont lose hope.
Just wondering if your job profile fall under TAL (Technology Alert List)??

My PD is sept 2001. India. I would like to know if i can file I140 and I485 concurently? My attorney says I can. Only thing they will not do anything with 485 until the visa numbers become current. Is this true?
