Unless the baby cries and asks for food, mother does not feed the baby. Similarly congress will provide relief only if we ask for it.
Can somebody please send me the addresses for sending regular mail. I have 30 posters almost ready,. I am checking. I have those 6-7 addresses (Zoe, Director, John, department, etc) but I need many more.
I want to do this 1st thing MOnday morning. ..

Guys, Are we sure that Fedex will not deliver on saturday or sunday, what will happen if they deliver, nobody will be at USCIS to accept right, so it will still be opened only on monday ?

DOS has to be utterly dumb, insane and ludacris....
what makes you think they cant blame USCIS statistics for this? USCIS gave us wrong stats, we made it current, then they said that no, they have enough visa numbers.
If its written into law that DOS can only issue VB once per month, and cannot update it during the month, they cannot do a damn thing.

Me too in the same boat. I have not received any receipt also i checked today whether the checks has been cahsed or not and they were not cashed yet. I consulted my lawyer and he said initially when he sent the application to nebraska some applications has been transfered to Texas and the process in texas is really really slow. Mine was filed under EB2 category. I dont know whether that makes any difference.

For senator and congres(wo)man it is really simple call your local senator or congres(wo)man or got to their website and fill out a privacy form and send it to the person handling immigration service at their office. As a part of that form explain them your situation and what you want their office to do for you. They will promptly follow up with USCIS on your behalf and will provide you with regular update as and when they get it from USCIS. You can easily find your local senator or congres(wo)man on google search.

We should send emails to Jon Stewart, Stephen Colbert, Jay Leno, David Letterman, Conan O'Brian, Jimmy Kimmel etc.
They have tremendous amount of viewership and seems like a perfect material for these shows. I will send email to these guys but if more and more peple can make them aware of this development, this news can potentially snowball. :D

I received I485 approval mail on Sept 9th 2010, but have not received my cards yet. There was a soft LUD on Sept 17th. Anyone in this situation?
What was the LUD you received on Sep 17th? I got the same msg on 09/09, but nothing after that. Is your online status changed to card production?

.... Why should they even extend H1 beyond 6 years?. If they do not extend H1, always new guys can keep coming on L1/H1 and the cost to employers will be much less. .....

This is a very good question. When I was on H-1B visa, at that time, it can not be extended beyond 6 years. At that time, people will move to home country/Canada for 1 one year, plan to move to O visa if qualified, will try to regain time for out of US time etc. The argument was gaining strength that person should get green card before her/his 6 years are up. To make matter worse, H1 and H4 time was counted together.
Now, rather than providing the long term solution of increasing the quota for green cards per year, EB based applicants were offered band-aid solution of extending H1 indefinitely beyond 6 years if labor is pending > 365 calendar days or I-140 is pending/approved. This was further sugar coated that if I-485 is not approved in standard processing time of 6 months, applicant can change GC job for same/similar classification. People were very happy with AC-21 and many thought (and they still think) that getting EAD is like a provisonal green card, as they can change job easily and employer can no longer "control" them.
Now, since H1 can be extended beyond 6 years, the arguement for faster green card has become weaker. Reason is simple, since applicant can work for "green card sposoring" employer for infinite time, even if I-485 is not filed.
In my opionion, ac-21 was a band-aid solution. Strangely enough, perople are still looking for more band-aid solutions.

I am also from India but the point I am discussing here is clearly a violation of law by Outsourcing vendors including IBM (not just Indian companies), TCS, Wipro etc. I work for a medium size consulting firm based in US and on H1 visa ...and I am impacted by these violations and I think I have the right to oppose this act.... to prove my identity shud I tell you my stories in Chennai consulate... or shud I tell u abt my days in b'lore or shud I tell you all abt my 24 years in India.. you can decide :-).
BUT regarding the L1 violation we have decided and this time the vendor is exposed to the authorities and justice is done. We have the support of good client managers who understands visa regulations.

Before I begin with my question, allow me to give you a brief overview of my case:
In the year 2000, I initially filed for Labor Certification.
In 2004, I received approval of my application for Employment Authorization (I-765).
In 2005, I was sent a letter from the USCIS indicating that my application was rejected because I failed to file my case prior to a certain date issued by the USCIS.
Pretty straight-forward, right? Wrong. You see, in the last letter I was sent by the USCIS it states that I failed to file my case promptly enough; I filed my case nearly a year before the deadline was set!
My lawyers and I have attempted to appeal the decision, however our attempt has been futile: our request for appeal has been denied.
I am unsure of what to do now... It is apparent that the USCIS messed up, but I cannot think of any way to reopen my case and prove it. My attorney has presented me with two options - in mid-June he will engage in a conference call with a senior individual at the Immigration Office, at which time he will present cases (including mine) which have been wrongfully denied; my second option is to sue the United States.
I am very unsure of what course of action to pursue now! My lawyer has kept my waiting all this time with stalls and meetings which he has stated will help my case, however with each passing meeting, it simply seems like he is giving me false hope... I really do not want to have to wait until mid-June, only to find out that I must wait even longer before my case is reopened.
Additionally, I am highly reluctant to sue the United States of America for messing up in the processing of my case. The judge presiding over my case will be a United States citizen - it would be like telling a child to kill his/her parent... it simply cannot happen! If I were to sue the United States of America, I would be fighting an uphill battle and risk deportation if I were to lose.
Please! Has anyone on here been rendered an unfavorable decision by the USCIS based on a mistake made by the Immigration office? What have you done to fix your case?
Attorneys: have any of your clients been put into this situation? What have you done to resolve the issue?
Everyone: I understand that a very small percentage of people are likely to be in the same boat that I am in, however regardless of whether or not you are in this situation, what would you do if you were in my shoes???
Would you sue the government and risk deportation? Would you wait endlessly, hoping that things become better, eventually? Or would you do something else? (If so, what?)
