    Thanks for your kind reply. Yes this amount of 40K is what i saved from my salary after my employer deducts taxes via withholding. I am confused because I read that you have to declare any foriegn accounts help while filling for taxes here in US. I made these trasnfers to my dad's account and I dont have any NRI account. I am not sure if I will fall into this category and have to declare all this. Thanks again for your help.

    L1 A are managerial positions. they can apply in EB1 through employer. Hence it is possible to get GC in Green Cards.What he is saying is true.

    L1 A are managerial positions
    L1 B are like H1B except they worked for their parent company for a period of 1 year or more out of US

    L2 's get EAD within 8-12 weeks and they can start working.

    But unless he uses GC and get out of that company, he wont be earning near to minimum H1 B wages.

    Satyam pays L1B only 41K. that's pathetic. Same with Wipro, Infosys, TCS , they are misers for L1 and H1B for employees.

    I am not telling the July and August application only, but total pending. The 320,000 is the total AOS application receipted due to JULY VB....that is not including those pending before July.

    My estimate based on that file I posted is that there are about 600k pending...and correct, it also included family based application like K1.

    I am in US.
    I received RFE for H1b extension PP last week. Original application was Feb 28, RFE came Mar 6

    I am sorry to hear ur situation, but can you tell us more? Like why should someone get a RFE for h1b extension??? I got my h1b extension last year for 3 years without any hasstles and also got stamping, offcourse I provided all tax documents and paystubs (latest) for the H1b extension.

    Just trying to understand if this is a pattern now.

    "One additional reason for making sure that you have a valid EAD at all times is so that you can claim unemployment benefits in the event you lose your job. H nonimmigrants do not qualify for unemployment insurance. If you have an EAD, however, and can be referred out for job interviews, you do qualify for UI, even if you don't yet have your green card."

    The above is quite interesting. I saw people who were laid off and had question about applying for UI if they are on EAD and this answer explains it really well.

    One of my colleagues got audit for two consecutive years and he received his green card last month.

    My worry is what if we pay panalty after IRS final decission on audit ?

    Did your friend have to pay the penalty any any of those audits.

    I agree. Aware members need to inform ignorant members obsessed with notices on other threads and stop those therads NOW. We have tolerated such threads enough. I am not joking, you will see from today new threads of EAD and AP trackers for the next 6 months. So let us all nip this in the bud in the interest of this organization. What do you think?

    It's not a tracker and I'm not tracking or looking for my receipt notices to come from USCIS or my checks to be cashed or anything like that.
    My notices have already arrived and my lawyer and employer are refusing to give them to me. I have foreign travel planned in October and I might be looking to change employer soon. My question was whether I can invoke AC21 without having the physical receipt notices.

    Would be helpful if someone knows for sure.

    Again, please go back and see this is not a tracker thread.

    I had similar question some time back (minimum and max salary alowable).
    As far as I recall he told me to stay within 65K to 120K.

    Best to consult with lawyer.

    What is the safe range of percentage increase in the salary with a pending I-485?

    We know that too much salary increase will make the adjudicator question about the 'similarity' of the job. But how much is too much?

    You yourself willingly knowingly signed G28 form and gave all the power to your attorney. USCIS is not suppose to be sending you anything. And IV has nothing to do with it.

    You have to realize, that your attorney/employer have to be willing to support your GC honestly, since you might need them in case of RFEs, etc. If they are playing games, then invoke AC21 and leave them.

    You can sign G28 with another attorney, and your new attorney will request your case from your previous attorney. Your previous attorney will have to be REQUIRED to send ALL your papers (including that RN).

    You can apply for EAD with just having receipt number, you can find out it by just calling USCIS. So I don't see any reason to freak out.

    I am in a similar situation. My lawyer prepared the following letter which seems much simpler than what you had mentioned. I hope, its helpful. However, my company HR is not willing to even sign on this one. they omitted the word 'permanent' and also, removed the last sentence mentioning that i will continue as full time employee after receiving the green card. I regret joining a big company now. But, we are where we are and have to deal with it.

    Well, my attorney filed interfiling last friday and according to him, my 485 file should be updated with the new I-140 in 3 to 4 weeks from now. He informed that we should not expect any written confirmation from USCIS though. I will keep you guys updated in this regard. In the mean time, if anybody in the forum has gone through this process, please share your experience.

    Below is my question, please find some time to respond

    I currently working on H1 for the last 5 years.
    I am a July 2007 I-485 filer and have my I-140 approved.

    From what I read from the above thread -

    1. Does it make sense to fill an I-9 form with the same employer and start working on EAD, instead of burning my remaining period in H1?

    2. That way even if for some reason my I-485 gets rejected, I can continue working by switching to H1?

    Thoughts....
