I have news for you (and the certitude with which you make your claims here are laughable). Computer science graduation rates in US went up this year by 6-8%, because the visa caps since 2003 remained at 65000 instead of 195000 creating some demand here. I personally know kids who wanted to go to Computer science, but went for other areas like health care because of the lack of offshoring/H1 etc. If the crooked Indian offshorers and fly-by-night operators are not driving down the wages, more americans will go to computer science, as they would go for a career as MD or Pharmacist or lawyer (almost all those careers need at least 6-8 years of college). They also know that professional associations like AMA or APhA wouldn't allow importing foreign workers by corporations/hospitals on a scale that H1-bs are imported in IT area
Based on my experience, I wouldn't say that Indian kids have any special skills in maths or science compared to americans. Most of the IT jobs were Indian H1-bs are employed doesn't even need computer science or engineering degree. Some of the best architects I have seen in IT didn't have a computer science major. A green-horn from TCS/INFY with a computer science degree and pretending to be an architect doesn't mean he is the best IT professional available in the market.
American college kids spend most of their time partying and sex. They do not study. Only a very very few really study. Others just get by because professors are under pressure to pass them. If professors fail them, then no student will take their course or give bad rating that will affect their Tenure track. The education system is just pathetic and thus kids prefer to study arts and commerce. It is because they cannot fathom tough calculus or trigonometry. The pre-college years are spent in Prom nights and losing virginity. Thus these people fail to compete at global level. Only very few are good and they go to good universities. On the other hand international students come after lot of hard work and tough competitive education system. They are well trained to learn even in meagre resources and compete with others. This is the reason international students and immigrants do well in this country and innovate.
So stop calling your American people as best and brightest. Most of you who come here on this site and live on anti-immigrant sites are middle aged people who cannot get a job anywhere. Some IV members were in DC at USCIS building yesterday (Tuesday, July 10th, 2007) from 10 AM to 1 PM. There were reporters there including CNN-IBN and Voice of America (Aaj Tak chanel) with video cameras. We saw the deliveries of flowers being made by UPS and FedEx. The DHL guy told the flowers were already delivered in the morning in the big truck. The security guards at the loading dock of USCIS were not allowing Video Shooting after the reporters shot the UPS deliveries going inside. When the FedEx tuck came in, they made him park right near the Loading Gate and were trying to cover up by parking two other vans each side of that truck so nobody can shoot the delivery.
Then IV members went inside the USCIS building from the main gate to hand deliver the flowers with Get Well Soon ballon and card for Emilio Gozales. Teh Video cameras followed until the security guard asked them to stop the recording as they didn't have prior approval. The security guards, receptionists and people around were smiling by seeing the flowers for Gonzales. They let the IV members proceed towards the visitor area. Where another secuirity guard asked who the delivery was for and directed to one of the Gonzales's secretaries, Rachel, who accepted the flowers. There were people around her. Rachel said to them "This is creepy, as far as I know he ain't sick, we received flowers last week, they were pretty too. Yesterday someone sent him cookies. This is some kind of peaceful protest". Then she also read the card in front of IV members. IV members asked her about the website update which says they are sending these flowers to Walter Reed. She said yes, we are doing that. IV members thanked her and left the building.

They made them wait and then several people (from different level of securityty to management) came to talk with them and finally said they can not allow to shoot for security reasons. We must respect such feelings - in my country of origin a lot of us never approved of illegal immigration en mass from neighboring countries.
Question is: we the people - who have LEGALLY established roots the way America wanted: Can we brought out from the sun into some sort of shade?
How can we ask this through IV, with factual quantification of our woes, in a way that All Americans can empathize with?
Facebook is a Great start - we need to take it to the next step.
Also, is it possible to buy (through contribution) an ad segment on a Washington Newspaper? TV and internet maybe more expensive.
Drastic indeed - needs money, but swift and possibly more effective.

My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.
I read somewhere in the forum that one guy contacted USCIS regarding I-140 PP and he was told by USCIS representative that they honor Postmark date. If USCIS honors Postmark date not the receive date they one must be careful sending application on June 29th.

It is rather unfortunate that people on consular process track despite the fact that they have approved I-140, yet they couldn't be allocated visa while other people on adjustment process could file their I-485 when everybody PD became current. don't you think it is rather unfortunate.
Any hope for consular processing? with the situation.

Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. If your company / client has decided they do not want to persist with you, there are 101 ways they can get rid of you, legal or illegal, my suggestion is, if you were exposed,
can L1fraud hold his head high in front of his client and still ask for reference with no sense of guilt in future? If not, he has lost half the game but now wants to lose the other half in a self destructive manner.

I am keeping my head up (may be an inch or 2 higher than last 3 weeks) as my project manager and director (middle management ) fully supports me in this crusade. Most of the cases, upper management decides to replace all the local contractors with these outsourcing firms and once the contract is signed these companies dump all their L1 resources to projects and middle management who deals directly with the resources has minimal say in the process.

As far as EAD is concerned, the employers shouldn't discriminate. Especially if more than 90 days are left on it since that's the time-frame govt promises to issue a new EAD. The employer might feel better to work with a citizen or GC or a person of certain ethnic background or national origin. However, thats the kind of decisions the employer is not allowed to make. Employer has to accept EAD, everything else being equal. When the law is not followed and it harms us, we have to fight it back.
I realize employers sometime end up asking questions that they shouldn't like the obvious ones such as age and marital status.

There are 37275 applications with PD of 2004 or earlier. Can we make an assumption that about 20 to 30% of these would try to port once economy turns around in the next 18 to 24 months? How will this impact wait time for a EB2 with PD Jan 2006?
I am really disappointed in the info provided via the foia effort. It told me that there are only 4118 applications before me. 4118 vs 28074. Worst kind of sick joke.
Based on the PD on my 140 Approval Notice (May-2004) there are 28074 applications before me. This is the correct date.
Based on the PD on my 485 Interview Notice (Aug-2007) there are 53192 applications before me.
I do not know how my application was counted when the data was put together.

Should your address showing up on your w2 and pay stub be matching with the address of your parent company that filed your LC for Permanent Residence? My parent company that filed for my GC is in MI and so my Labor was also filed from there and currently I am working in IL and have been filing tax return for the state of IL for the last 3 years. The addres that shows up on my pay stub and w2 is for the state of IL. As my I485 is already filed so would it matter at the time of adudication of I485 about this address issue?

My wife is on F1 visa and I am hoping the dates will move soon and we will be able to file 485. I would like to know if

If you are under H1b and she is applying for 485 together with you then answer is yes she can.

No because F1 is for non immigrant as F1 you show that you have no intention to move to US but once your file your I-485 you show an intention to move and stay in US therefore F1 is no longer valid.

Let me add my 2cents here.
This came up when I was discussing this topic with my lawyer friend -
Person can still file for GC when he/she is at school in eb3 and after finishing school, he/she can file another one for EB2 and can port the date to earlier PD, just like eb3 person who started work instead of going to school. Remember, GC is for the future job and person can not claim that he/she needs to be employed in order for GC to be filed.
Law does provide equal opportunity to both for PD recapture (aka PD porting).
Disclaimer: I am green card holder for 6 years and personally this issue does not affect me.

In 2005, she described undocumented immigrants as �deadly time bombs, because of the diseases they bring into the country.� Cosman, who died last year, has also been criticized for these comments she made about Mexican men.
MADELEINE COSMAN: Recognize that most of these bastards molest girls under age twelve, some as young as age five, others age three. Although, of course, some specialize in boys, some specialize in nuns, some are exceedingly versatile and rape little girls age eleven and women up to age seventy-nine.
What is important here is the psychiatric defenses: Why do they do what they do? They do not need a jail; they need a hospital. They are depraved because they were deprived in their home country. But more important is the cultural defense: they suffer from psychiatric cognitive disjuncture, for what does a poor man do if in his home country of Mexico in his jurisdiction if rape is ranked lower than cow stealing? Of course, he will not know how to behave here in strange America. This is thoroughly reprehensible.
