Redcard,
Life is what you make it. No one force anyone to come to this country on VISA and work and be In GC line. Things happen in life. The way you are talking is as if whole world will collapse if you don’t get green card. No one would die because of that. Grow up and move on in life. This is just a minor obstacle in life. Smart intelligent people can make money and have a good life any where in the world. Probably you would face lot more challenge in life than this green card issue, which I am sure you will give your best to overcome. Don’t make this GC a big deal in your life. :)
I mean the way we talk on these forums are as if all our careers along with our family life will be finished before we reach 30-32 if we don’t get green card. Come on man, so many people faced so many disasters from WW1-2 to flood to hurricanes where they lost everything and still moved on to do great things in life and here we are depressed because of this GC?
Its very interesting to read about people’s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind…lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past… .. and especially the people in the seventh year
1. You are in your seventh year… and you loose you job….what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave…forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist …
2. You have home which you bought with so much pride…what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave…and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..
3. You have child whom you love and have plans for them.. love the school.. are an active member in the PTA … all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"…to another place where they don’t even understand the language forget the culture, national anthem etc..
4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back…why because your don’t have a GC
5. Forget the Golf and Tennis you enjoy so much here …it was all a very good dream..
1. You are educated.. have a masters, have a professional degree.. but have been in the same position and department because of your long wait for GC, what happens… the fresh college graduate or the dumb blond who joined two years back and whom you taught how to log into the network is now your peer and you are still on the same desk doing the same job getting the 2% raise and working even more hard..so that you can keep you job..with a new dumb boss.. who thinks you are so dumb that you have been in the same job for so long time..
2. All your batchmates are doing great..some of them are now sweating to be VP’s having risen by changing jobs …. You are still years away from that situation.. what do you do.. stop attending alumni meets and envy the mails in your yahoo groups from people..
3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..
Last but not the least… flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture …and then set up a new home,,new school for kids….why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...
We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC…

Read the instructions on the I485.
You might only need a receipt notice for the I140 to file I485.
Makes sense since you can concurrent file I140 and I485 anyway.
I filed I485 two months ago, and seem to recall reading this on the instructions or elsewhere.
I would also do AOS not CP.

- What your qualifications are.
What the Sr. software engineer job requirements were. Things like:
- Education
- Experience
and also more info about your experience with PERM:
- Processing center. Chicago or Atlanta?
- Processing time.
- Any audits?
- Any business necessity documentation requirements?
I know I'm asking for a lot of info but I think it would be extremely helpful for many folks who are preparing to file under EB2 to avoid regression.
My wife applied for LC as Business Analyst with Bachelors and 5 years of Exp.
My wife has done her Bachelors in Engineering from Bombay. She had more than 7 years of exp at the time of filing. The job required 5-7 years of exp with abachelors Degree.
She applied to Atlanta center and it took around 5 months and no audits that we know of. thenshe applied for her I 140 which took around 3-4 months. There was an RFE for exp letters since the lawyers did not give it during her I 140 filing. After the lawyers responded to her RFE, her I 140 was approved in 15 days. Now she is waiting to apply for I485.
I hope this gives u an idea that u can apply for EB2 as BA if the job requires Bachelors and 5-7 years of exp.

Even if the Labor cert says "Masters" then as long as you had BS + 5 years experience before you filed for labor, to qualify for EB2, this should be ok.
This statement is not true. Minimum job qualifications should clearly mention the degree required or other alternate degree(s) with experience which would suffice. Moreover, it is a standard misconception among the community about Eb-2/Eb-3 categories being determined under Labor Certification stage. USCIS is the one which classifies applications under different categories (EB-1,2,3, etc) based on degree and/or yrs of experience, not DOL.
Labor certification determines the following: Minimum Job requirements (Education + experience required, if any), Job description/duties, Prevailing Wage. When filing I-140, if the job requirements meet a particular category and labor certification has been approved and the candidate meets the job requirements (education/experience as defined in LC), then the company can file in the appropriate EB category. Note that, even though if you have an approved LC that will qualify you for an EB-2 case, you also have an option to file for EB-3 I-140 with that LC instead of EB-2. Some companies deliberately do this to keep the beneficiaries employed with them for a longer duration.
Now coming back to the OPs case, I observe the following from the information posted so far:
- Labor was filed with a minimum requirement as Masters degree. No alternate degree requirement or equivalency was mentioned.
- USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
- Sponsoring employer revoked approved I-140
- USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
- USCIS denied the pending I-485 based on incorrect I-140 approval
If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

My lawyer is saying that even if you want to file I-485 now, the USCIS has advised Fedex and UPS not to deliver any mail to that PO BOX. In that case I am not sure how one could become member of the class action law suit.

in response to your message, I have posted my original draft below, with a couple of changes based on my opinion - i.e. I believe in asking for only one thing at a time, and that is the skil bill, which will automatically provide for increased visa numbers. But each person can modify their version based on what they think.
If you think IV members should all be asking for the same thing then go ahead and modify this version.

I belong to an organization called Immigration Voice, a small group (and to my knowledge the only one of its kind) that is attempting to help legal tax-paying highly skilled immigration applicants who have been in waiting in limbo for many years.
We are all highly skilled immigration applicants who are stuck in limbo, some for more than 8 years, despite being fully legal, tax paying and highly skilled.
Since the number of highly skilled legal immigrants is so small (less than a million) compared to the number of illegal immigrants (12 million) it is very difficult to get our voices heard about the problems caused by waiting in a seemingly endless queue. The issues, unlike those of illegals, are largely non-controversial, some as simple as asking USCIS to reduce our waiting time from 8+ years to a year.
Since we are all highly skilled in areas where there is a shortage of US available labor and provide a disproportionately large benefit to the US economy, we believe that approving our already filed applications on an expedited basis could be helpful to all of us.
Currently, a bill that is under consideration by Congress called the SKIL bill will solve almost all of these non-controversial issues.
I and my fellow members would much appreciate it if you could run a story on us, and/or direct us to a source that helps publicize our organization.

in response to your message, I have posted my original draft below, with a couple of changes based on my opinion - i.e. I believe in asking for only one thing at a time, and that is the skil bill, which will automatically provide for increased visa numbers. But each person can modify their version based on what they think.
If you think IV members should all be asking for the same thing then go ahead and modify this version.
