That's because the existing cases have not had a chance to file their I-485 and therefore are not visible in that report. Does not mean they don't exist. My case is a perfect example of that. I'm not counted in that report but I certainly exist! :-)

In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. ..... The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.
In a couple of my previous posts I copied the relevant Sections (Sec. 202 and 203) of the INA which specifically states that distribution should be preferentially horizontal. Both Sections should be read together.
Please note that there is no ambiguity in the law and DOS may just have taken too long to change the US Code or other relevant section of their rules.
I will definitely be willing to change my interpretation if you can show where the ambiguity in the law lies. I'm definitely not a lawyer so it's quite possible that I'm missing some clause in the law.

We have learned that in all probability House Judiciary committee will finishing marking up HR5882 in the next committee meeting. The bill is likely to be brought to the House floor the following week. We have been told that if our bill(s) pass the House, Senate will include the language of the bill(s) in another Senate bill that has majority support. We must admit that the time is shot but its still possible.
We request everyone that starting monday, please call all the members of Judiciary committee. Thanks to the members who have already made phone calls to the lawmaker's office. We request you to please call again to show your support starting Monday.

None of country gives direct citizenship without residency card. Except some extra ordinary cases.
Even local US people will oppose it. Day you become USC , more responsiblity on govt. Not only money wise but so many things govt need to give you as USC.

Yes ndialani,i waited for 6 month which i did because i don't know I140 premium started from June 2009(For most the cases).They started in Feb 2009 but its applicable to some limited cases).
May be i would have moved it to premium if i knew in June.Some of the options which i would have tried during that 6 months period was InfoPass,Senator,Ombudsman etc but wasn't very serious about 140 as i thought it may take some years for gc(since the dates very moving very slowly at that time).

I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.

I am in also facing the same situation...My employer says, the attorney clubbed some applications into one box and sent it, and donot know which box my application is, hence no fed ex number. Hopefully it should he been reached by july 2nd...No Receipts No Checks cleared...waiting for Sept 30 to call USCIS (after 90 days of filing)...most probably my application would have received by R.MICKELS, Delivery date: Jul 2, 2007 9:01 AM. I have got a list of tracking numbers from the attorney, only this tracking number details shows 4 lbs...hence thinking that my application is clubbed in this one. This was sent to Nebraska service center, My I-140 approved from Texas on June 25th. CAdude, Can you add my details onto the list. The compiled list show the time stamps are very close....

Most of what Hunter has said is not wrong. Exploitation and malpractices by small/big consulting companies is a reality. All of the Indian immigrants know it. Indian workers submit to it because it still is a very good bargain.
But then there are other things that he is simply stereotyping because of personal impact and resulting hatred. Generally implying that foreign workers are crap and cause wage depression isn't true. Wages in IT industry are destined to go down with time because of demand/supply equation. It's nobody's fault that India/China are on the supply side (be it here or there respective countries). Moreover an individual with the will to uproot himself from the other side of the world and come here generally has much stronger zest to make it big than live an average life.
With regard to quality of professionals overall I don't see a marked difference between American and non-American workers. Moreover, I don't think that employers will employ substandard labor just because they are marginally cheap, because it turns out to be more expensive. In all the cases that H1-B and L1 pocket less money than their counterparts the booty goes to middlemen(both Indian and American bodyshps) and not the companies that ultimately use their skills.
What we all need here is a common-sense and honest approach to immigratiion. Also, we must understand that much is driven by forces of capitalism and they are strong enough to find a way, protectionism or no protectionism.
