    Ron is a very decent guy, he is not my attorney but he has helped me with really good advice that helped me a lot.

    Once I posted a question during the weekend and asked him a very specific question (My attorney was out of town) and he not only gave me the right answer but also posted detail information about the actual law behind it. Beleive me I needed the answer that weekend.

    Every law firm wants clients but most of the lawyers would charge you $200 or $300 for 1/2 session, I know this becasue I have done this as well.

    Ron answers your questions on his forum with out any charges, anybody can see this if they go to his site.

    So you think he is "speculative", who isn't??? Why don't you name a lawyer who can "speculate" the visa bulletin correctly.

    I would keep your thoughts to yourself.

    Stop advertising a lawyer. I find him very speculative. He wants everyone to come to his site and you are falling for it.

    As far as H-1, I don't understand: wont you need an H-1 transfer from your new employer, in that case the 3 yr extension will come from him, so it shouldnt matter if your old employer revokes I-140, since anyway you are planning to restart gc process.

    Yes I do need the transfer from new employer but the original extension of H1B beyond six years is granted because I have an approved I140. I was wondering if revoking that I140 has any effect on the H1b too.

    To give more specifics: six years of h1b will be completed in Feb �07. PERM labor is approved and lets say if I140 is approved by Jan, my plan is to do one of two things:
    (i) Immediately apply for 3 year extension of H1B from present employer. Wait until it�s approved � the new H1b is valid until Feb �10. After approval apply for h1b transfer. Is this possible? After the transfer if original I140 is revoked, I assume UCSIS is not going to recall my h1b. Am I right? The extended h1b period is with me to keep � is my understanding right?
    (ii) After the approval of I140 (say in Jan), I will apply for h1b transfer and extension with new employer (extension based on the fact that I have an approved I140 and that priority date is not current). The hitch here is the approved I140 is from a different employer than the one asking for h1b extension. Is this possible? (I know that one year extension based on pending labor is not tied to which employer applied for the labor; is this rule same for approved I140 related extension?). What is effect of I140 revoke on this case?

    Though this can be the case but this is relief to those who have been stuck in NC for years ,so in that retrospect six months is far far better . I think many people can see the things to their interpretation , my take is that you never get everything right on the first time, u revisit and make changes and correct special situations that were not taken care of intially. It is a start atleast now we dont have poeple who are waiting in NC for years and asking about WOM.

    Yes, agree and that is why I have already mentioned "improved" word in my first post. But clarity need to be established. I am giving USCIS a fair chance by using words "Doubt" and I have tried to research the subject but am not getting much authentic articles on net for the same. If somebody (Authentic article/lawyer/Sr. IV member) is saying that "Yes 6 months is from 485 receipt date".. Then I am fine otherwise it will be a missed oppertunity as we had a chance to have more clarified text from USCIS while it was writing a new memo w.r.t that law suite.

    Why I opened this thread? Because I understand the seriousness of this process. After fighting out this, still we will be screwed on this interpretation then again we will be seeing million stuck in a queue (perhaps that may not be a NC queue but different queue.. for an example "processing" queue) And that will be a very darn serious situation...

    I just applied to lending tree on wednesday for 450k loan. Still nobody contacted me :(. I have an excellent credit history and me and my wife both are using our history to apply. Finally looks the market is really tight in credit. Last time I applied for auto loan I got replies in couple of hours.

    Good luck. I am still hunting in NJ and want to get preapproved.

    I few months back got it from Wells Fargo. 100% loan, no PMI, 7.25%, 30 year fixed. I heard they have stopped 100% now. You need to have atleast 3% down. I know it is towards the higher side but I want the safety of keeping the money in my account while we go though his rough economy.

    Are the processing times according to the notice date or the received date ? Mine are 4 months apart.

    USCIS needs to work with paper files for review/approval. RD as on your receipt is the mailroom receive date. Real receive date of a processing center is when they actually opened your file and entered in the system, which is what you see online as, "...your case was received on...". Processing centers prefer to treat this date as RD as this suites them better. In your case your true RD should be a couple of days prior to your ND. Who is responsible for the 4 months period in between when several thousand applications may have been received and entered in the system (and placed ahead of you)? Nobody.

    babawa10: Your case has shuffled around between centers. It was received last by TSC in Aug 08. Therefore, don't get surprized if your Real RD is now Aug 08. USCIS makes a simple claim, they process cases in order they receive them. Perhaps they are talking about the paper files, which are placed in sequence on shelves as they arrive. Check online what it now says for "...your case was received on...".

    You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

    Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
    Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
    Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?

    Before Nebraska service center retrogressed their processing dates I was able to speak with an IO. I asked her a few questions relevant to this.
    There maybe a public USCIS rule / procedures that would confirm what she told me.

    Q) When is the name check typically initiated
    A> Soon after receipt

    Q> Is my name check cleared.
    A> wait a moment..... yes

    I've also explained why Nebraska processing dates moved back...
    1) Transfers from Texas
    2) VB moving forward coupled with no pre-adjudication. Therefore they have to go back to older receipt dates.
    3) 180 day name check rule taking effect -- clean up old cases.
    4) Public processing date was internally known to be too far ahead of reality (and therefore causing service requests).

    Now could USCIS hide behind name check now?
    Probably not for more than 180 days, because you could file a WOM and win.

    Can they stagnate processing dates --- yes, and there is a risk that they will around 2nd July 2007 date (last year's fiasco -- if I need remind anyone). That would make me barking mad since my receipt date is about 59 days before that.

    A WOM will likely succeed when an individual is arbitrarily processed more slowly, and now name check is not an excuse. However, a WOM is much less likely to succeed when a whole group is processed slowly, since USCIS can always claim resource constraints. The happened with labor cert and BECs, the case(s) that I read the judge basically said to speed up one application would slow down another. So you need to show that you are behind the reasonable processing times with respect to others, then you can force USCIS's hand.


    Looks like you may have gotten lucky with the IO that you encountered over the phone. I just tried reaching a level 2 officer. Unfortunately Nebraska center is closed at this time, so I got transferred to the national service center and possibly to a level 1 case handler. She seemed very polite and even sounded quite young ( intern !? ) . Here's transcript

    She ran me thru several questions, default status update thats already on the online case status and finally I steered towards more specific questions

    1) I wanted to check the status of my case, the online status has shown no updates since 7 or 8 months. Specifically was a namecheck initiated in my case?

    A) Sorry sir, you have to make an Infopass appt for that, I have no access to that info.

    2) Usually it should be initiated soon after receipt date, and completed within 180 days, right?

    A) Yes sir, as per the new 180 day rule (seems to be aware of the new rule :) ), it should be done, but I can't tell you whether it has been initiated yet or not, or if it has been cleared. But if you doubt that it has been initiated and its been more than 180 days, then there's the new provision in law that your cards should be ordered immdtly, if everything else checks out (like PD etc). You have to make an InfoPass appt to get this info.

    3) Can I place a Service request over the phone instead?

    A) Your case is outside of our current processing date limits. You have to be atleast 30 days older than the current processing date at your case service center to initiate a service request.

    4) When do you think the Processing dates will catch up with my receipt date?

    A) The computer shows me that it will currently take 53 days (w.t.f !!) to get to your case !


    I will probably give another try tomorrow during normal working times of NSC. Hopefully get to an IO who can tell the namecheck status.

    But if its been cleared, then what next?? Just wait to see the PRD get stuck at July 2, 2007 eternally ???

    I mean what cases are they processing ??? My PD is EB3 May 2001 !! Probably very near to front of queue. How many potential approvable *current* cases could there be that need to be processed before mine? How to get this information? Will an Infopass help to get such information?

    If not then, whats the point of taking an InfoPass?

    bsbawa10. Hope your case gets attention. You have been around for a long time with Apr04 PD.

    You might want to review section pertaining to determination of processing center in the I-485 Operating Procedures. There is a detailed protocol to determine this, and if they find it to be at wrong center, they transfer it to what they believe it should have been. There may be some ambiguous areas due to changes in jurisdictions by USCIS after your I-140 approval, modified process, or your moving from one state to another. In any case take an Infopass, and ask if you can provide additional information related with your case shuffling between centers. As you know, first hurdle to cross is to see that a center has accepted your case for processing. Best...

    It is perfectly legal. Before throwing out ignorant allegations like "skirting the law" and all that, do your homework first. I am sure I did mine thoroughly well!

    Hi!
    My lawyer filed my application in Nebraska on July 2 ( it should have been filed in Texas). Probably it will get transfered to Texas?

    But I have not recieved any updates on my case
    - no checks cashed
    - no reciepts issued.

    The USCIS asks me to wait for 3 months ( till Oct 2) to help in any way.

    Is any one in similar situation. Is this normal?

    Hi cooldudesfo,
    I am just curious that how come you got your EAD and AP approved, since the current processing dates for California Service Center are as follows-:

    I-765 Application for EAD (pending I-485) is 11 Weeks
    and
    I-131 Application for Travel Document is April 18, 2007

    Have you received both the documents in hand? I am concerned because I have plans to travel back home in december and am not sure if i will have AP in hand by then.

    I am in the exactly same situation.

    I talked to my Attorney and they are going to send me Originla I-485 receipt notice. What they told me the RD on original notices is July 2, 2007.

    If this is true, then I will just ignore the Aug 28, 2007 RD on my Transfer Notices.

    Try to get your original I-485 from Attorney and check out what the RD is on them....

    An please post here if you find anything else.

    I have my EADs and APs approved already.
