I saw a similar thread in one of the anti-immigration forums.
It was about members of immigration voice using filthy language in public forums. Don�t remember the exact words but it read something like �is this kind of third world behavior we get by bringing in so-called HIGHLY SKILLED immigrants to USA?�

I have been banned too - simply because I raised the cause of international students and IV's duplicity in its stance, and that makes some GC-greedy members paranoid. :D
If this thread is about exposing people who have been banned, then so be it. We will reveal the details that we do not normally do. You have repeatedly used offensive language and several of your posts have been deleted in the past. If you want IV to focus on student's cause, then you will need to work on that effort. IV can offer a platform. You continue to post hateful messages against IV. IV is a platform and if you want to do something get students together on a platform, we will guide you. Just like we are helping people stuck in Perm Audits these days. But it is upto people who are stuck to take up the challenge and not expect someone else to do it for them and they will simply come to the site and pass judgments.
Just to give an example of one of of the emails you wrote to us when we sent you the newsletter about DC rally:

Let's say if I am on the green card (EAD) , then still I can not evade this tax situation correct ?I mean if they pay me and I pay to the company in India who is really responsible for the service.
Right now, with the current setup, the company in India will have to pay corporate taxes on their overseas income. If I'm not mistaken, IT companies have a reduced tax rate in India. All in all, the 4pc should not be a big damper.

All I am saying is let's put practicality into matter. USCIS IOs are human who make mistakes. If you put the IOs into situation where they can potentially make mistakes, then they can potentially make an error, be it to your advantage or not.
We've seen some cases where IOs are committing mistakes, haven't you? And aren't we learning from that or not?

As per AC21 rule, it is from Receipt. However, let's put some practicality into the matter. Some IO's interpret the rule wrongly and used Notice Date instead. So what will happen? Your GC denied for wrong reasons and you file for MTR because it was USCIS mistake. If you're willing to take the chance, then go. If not, better use Notice Date for practicality purposes and to avoid all the hassle of MTR, etc.

Guys pls stop taking useless info pass appointments. People like me who have not received EAD and may loose the job are not able to get infopass appointments because of all the people taking appt to know the 485 status. Pls understand......
We always get appointments with in less than 24 hrs in the local USCIS office(closest to Upstate New york). I don't think its a big deal here. I am not sure about other offices.
Again based on the urgency, one can always decide whether to take info pass or not. Appointment time frame is always same for everyone. Unless its urgent(relative to personal needs), one can always take an appointment with USCIS.

Guys,
Getting a residency now is very difficult. Getting a waiver now should not be that hard. I would not say it is easy but if you get a residency position, just take it. We hesitated at first but got through all the issues without any problem.

1) They are not going to provide a corrected W2 since they changed the payroll company starting 01/01/2009
2) The HR has asked me to report those wages even without a W2
3) They also wrote they have not received the Insurance Company payment statements which was not true because the Insurance Company did mailed those documents in the 2nd week of January and the HR also confirmed over the phone that they have received.
I have the statements from the Insurance Company that shows SS and Medicare taxes withheld. The statements also say it should be reported in the year end W2. I have also faxed the Insurance Company statements to them and have a confirmation report.
I really didn't want to file a complaint but since my wife has to receive W2 for the next year 2009 also, I felt they might do the same next year.

The rule that USCIS follows is that if they estimate that your priority date wil become current within a year they give you a 1 year EAD. When they estimate a wait of more than a year they give a 2 years EAD. ofcourse this is not strictly followed as we have seen cases of people falling through the crack and getting 1 year EAD when their priority date is far in the grey area (1 to 1.5 years from the current date)
Look at the bright side a 1 year EAD means that you will most probabaly be current in a year :D:D:D

Do not forget to count the effect of the fact that once congress pass FBI Background Checks Improvement Amendment to CJS FY 2008 Appropriations Bill, total load again will cross more than 650,000 (320000 + June application load +Namecheck stuck files + August and onward load) at least. So in theory Namecheck stuck guys will start popping out of the system first and then us. And this may make all bulletins till 2008 end slow not moving beyond 2003 for almost all EB2-3 categories in general. Now Senate has already passed that Amendment. Ofcourse if it will become law through passing of the bill and till then we all will have to wait. But if it is passed will be effective mostly from 2008.
