Can we rope in organizations like those mentioned in the subject line for our cause?
Single most important reason I have not bought a house yet is that I do not have a GC and thus can be kicked out anytime. Most of my savings have been invested in Real Estate in India not because I think investment there is more profitable but because I do not have confidence that I will get GC here for sure. All of my friends who own a house waited till they got GC and those who do not own one, are those waiting for GC. In short, more GCs to Desis generally would mean increased housing demand, at least that is what the initial look at numbers indicate. Thoughts?

This idea has only one problem, it makes too much sense !
If the motivation behind the immigration system was to benefit the immigrants, things would not be where they are today. Think about it, all these RFE's, NOID's and MTR's are the pieces of paper that generate revenue for the USCIS, the lawyers involved and the whole bureaucratic set up. Now why would a common sense solution like yours be implemented which benefits only the immigrants and stops oodles of money from coming in? The whole idea of giving people EAD's and AP's (ie the defacto rights of a green card) and forcing them to renew these documents for years instead of simply giving the green card is preposterous. The excuse given is that it is the law and changing the law is hard. Changing the law is not hard, changing the political realities of a nation entrenched in xenophobia is what is hard.

Many guys here worry too much, just relax and live a peaqceful life. Jus think this, we are highly educated and would defintely be able to make a living anywhere in the world, not just US. Don't worry tooo much and think others have no work and want to fool you guys.
Just my 2 cents......
lol.. well said dude.. you may already know, but happy news digests better.. i dont know if what you are saying is true or not, although I wouldn't be surprised if it is true given what we've seen before. anyway, when you come up with something like this, you trigger massive defense mechanisms of people who are refreshing iv/cris every few minutes. so u shudnt be surprised by the responses.

kpchal2,
Your case may be preadjudicated.....(if at all that is actually true)....yet it does not stop USCIS from sending an RFE for anything especially it has been over a few months since they last saw ur case....and once an RFE is issued you again go back in the list and the wait continues to next year when the window again opens for a short time.
It is absolutely nonsense that preadjudicated cases are in a pile waiting for visa number...this is from my attorney....USCIS can issue n number of RFEs.....and each time it is issued it furthers the chance of green....
SoP
How do you know if your case is pre-adjudicated or not. Could we call USCIS and ask the representative about this?
PD - July 2004 - EB2
I-485 RD - August 17, 2007 - TSC
I-485 ND - Oct 16, 2007
Is there a chance that mine pre-adjudicated? I attended the interview on Jun 25, 2009. The DAO asked me for various docs and I provided all those. Is there a chance of getting RFE still?

Anybody else want to take the same challenge as mine, if we achieve the 60000$ target by Dec 31? 20$/month contribution is not BIG at all.
Starting Jan 2007, I will chip in 20$ per month every month until we get the bill for GC relief cleared, if we can beat Anurakt's challenge of 60000$ by 31st december.

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.
absolutley true........ AC21 is not mandatory........respond only if RFE is generated....

This is my opinion for your questions.
Maybe,...
1. If USCIS get <= 20k on April 1 (sunday), 2 and 3, all US-MS petitions are guaranteed to be at least processed ??
Yes.
2. If UCSIS get > 20k on April 1 (sunday), 2 and 3, then i guess, all 20k+ numbers with receipt date including that date when USCIS officially announce H1B-US_MS cap reached, will be under random lotter??
Yes.

Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.
The idea inherently appeals to those who believe in fair play. How do we take this forward.
I do agree with you, USCIS honors the old PD on the Labor, not the I-140 filing date.
Dont know the exact rule on the labor substitution cases, but i know for sure people who applied in 2007 with old sub labor PDs from 2000 and 2001 received their GCs. I would simply call them lucky as they found the Employers who took advantagfe of the sub labor rule and filed their petitions before the sunset date of July 16th 2007.
Lets hope USCIS do their job and approves only the genuine lab sub cases.
For rest of us who were the victims of backlog elimination centre and then the stupid July 2007 fiasco of making very EB category current, its just our bad luck, in backlog centre too DoL processed our apps out of order and now USCIS doing the same thing.

Hi All,
There is nothing wrong in sending the flowers. People will have to make sure that their message is well written.
Please note that it is not USCIS who decides the priority dates. It is DOS who decides the VB. USCIS just follow that VB says.

Can someone advice on this.
Currently I am on H1B visa and I will apply my AOS before 17th august as dependent(Secondary applicant).
After applying AOS if I have to leave my job then will I be out of status since I won't be on H1 status and I won't be on H4 ?
Can I leave my job after applying AOS or I have to wait till We get receipts of 485?
Thanks in advance.
You will be in "pending adjustment" status as a dependent, but since you're not on a H4 I am not sure what may be in store. Check with a good lawyer.

Just because this article says so doesnt mean its true. The whole point of this article was to demonize the law enforcement efforts directed against illegals.
This is from amnestyusa website:
Twenty-three state departments of corrections and the Federal Bureau of Prisons allow the use of restraints during labor. Alabama, Alaska, Arkansas, Arizona, Delaware, Idaho, Illinois, Indiana, Louisiana, Maine, Massachusetts, Minnesota, Mississippi, Nevada, New Hampshire, North Carolina, Ohio, Oklahoma, Pennsylvania, South Carolina, Tennessee, West Virginia, and Wisconsin.
Key Findings: Use of Restraints on Pregnant Women in Custody (http://www.amnestyusa.org/violence-against-women/abuse-of-women-in-custody/key-findings-use-of-restraints-on-pregnant-women-in-custody/page.do?id=1108300)
Your article reference does not specify any specific policy on Arizona. The original article referenced the Arizona Department of Corrections.
I looked that up and Voila! thats exactly what the Arizona Department of Corrections states
Here it is under "705.10 USE OF RESTRAINTS "
"1.3 General Exceptions to the Use of Restraints
1.3.6 Pregnant inmates shall not be restrained during the delivery stage of childbirth. An officer shall be present at all times. If necessary, a second officer may be assigned in accordance with the security risk, escape risk or custody level. After the birth of the child, prescribed custody level restraints shall be reapplied."
Here is the link
Arizona Department of Corrections (http://www.azcorrections.gov/Jeff_Policies_700_705.aspx#705.10)
Unfortunately i don't think even a proper reference of the LAW is enough to change your mindset. But i wanted to show that the so called LAW protectors are breaking it themselves
