Employment-based categories are as follows: EB-1 remains current for all countries; EB-2 remains current, except for India and China which are at May 2006; EB-3 is at Jan. 2005 for all countries, except for India (Jan. 2002), China (Nov. 2003), and Mexico (April 2001); EB-3 other workers is at March 2003 for all countries, except India (Jan. 2002)and Mexico (April 2001); EB-4, religious workers, EB-5, and targeted employment areas and regional centers are all current. Family based petitions are backlogged, with the most recent date at April 2010.

Hi,
I am confused with AP expiration date.
The printed exiration date is :July 29, 2009
But my latest paroled stamp on AP it is : Dec 05, 2009.
Which date should i follow to renew my AP?

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

Hello Guys,
I need urgent help regarding my EAD.
I received my EAD after long wait 5 months .... and now it is valid just for 2 months :mad:
where as my I94 is valid till Oct 2011 and so as my husband's.
I called service center and they said that , if I feel there is an error with my card, I will have to send it back and USCIS will correct it if they feel the same and there is no time line for correction..
I need an advice on what should I do - send it for correction or file extension? I already have a job starting soon and I am scared that If I don't get it back in two months I will not be able to take it....
PLEASE HELP...

Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

Hi,
I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.
Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.
My questions is -- How do you count the expereince if its Masters + One year
Will you count one year after finishing the Master Degree completed (or)
Will you count one year after finishing the Bachelors Degree.

My case: NIW 140 approved, PD 2006/10, now 485 pending. But I am leaving USA to another country for a permanent job. I am not sure if I should withdraw the 485 or just convert it to CP.
1. Will it be possible for me to get the green card thru CP if I get interviewed and can't show any ties with USA? Can I enter USA during CP? I hope to have green card in case I don't like my new job and come back to US someday. But I may just cancel 485 in order to affect the least my future visiting visa application. Suggestions?
2. I am on H1 now, but H1 will expire 1 month before I leave USA. So I understand that I can stay legally on AOS for the one month, true? Do I need to do anything for switching from H1 to AOS? Again, I need to come back to USA for business/visiting, so I want to do everything right not to harm my future non-immigrant visa application.

With only 3 weeks left in Sep 2008 (keeping in mind that my PD is current since Aug-01), I have decided to contact DHS Ombudsman and Congressman for help.
But I dont know how to start.
I read the posting from googler.
