Politico reports on a McCain interview with CNN. The other interesting takeaway is McCain's indication that he'll stand firm in insisting on a guest worker program in the comprehensive immigration reform bill if he's going to work for its passage. I hope he's successful in that effort. Without addressing the future flow of immigrant workers, we'll be debating another legalization bill in ten or fifteen years.

My friend has his I-485 filed and has got EAD/AP, but the priority date is so behind, that he has no chance of getting a green card before his marriage. So, as I understand he should be able to bring his wife on H4 (as long as he maintains H1). My question is: does he have to re-file for I-485 to include his wife and if so will the priority date remain the same as the first application?She needs to file her own I-485 but only when PD become current. She has the same PD as primary applicant.

Hello every1,

A SVP of 7 equals 2-4 years of education/training or experience (A job zone of 4 is treated as an SVP of 7.0 < 8.0).
A SVP of 8 equals 4-10 years of education/training or experience (A job zone of 5 is treated as an SVP of 8 & above).

A MS Degree is calculated as equal to a BS +2 or 4 years experience and no education.

NOW, BS + 5 / MS + 0 -- Minimum qualification for EB2..
So now a person working in Job Zone 4, which requires minimum of BS + (2-4) experience would get an entry level job at OES Level Wage 1.

So Can we conclude from this that a job which falls under job zone 4 which needs to applied for EB2(basically raise SVP to 8) would have a minimum OES Level 2 wage ????

What will be the status of pending H1B extension case if EAD/AP is used on reentry to US. If the case is approved after rentry, is it possible to change status to H1?

Hi All,

My Green card Priority date is April 2004 under EB3 category.
I-140 was approved 1yr back and I-485 applied in August 2007.

Where to check the current processing dates and when will we receive Green card?

Any idea still howmuch time will it take to get GC for the people with above PD date?

Do i need to check the URL https://egov.uscis.gov/cris/jsps/ptimes.jsp?

Hello gurus..

I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?

All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?

I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

Hello friends -
My Receipt notice states that RECEIVED DATE for my 485 is July 17, 2007 and the NOTICE DATE is September 14, 2007.

In my USCIS online account when my click on my 485 RECEIPT No. it states -"CASE recd. & pending" ...On September 14, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice......

Shouldn't this state that they recd. the case on July 17, 2007.?? Can it be true that their system is showing a recd. date of 9/14 when actually the recd. date on the actual notice/797 is 7/17/07.

How many folks are seeing this.?? Is this how it is supposed to be..I mean is it normal for them to generate a default message like this using the NOTICE DATE when you click ur case #..??

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

Your H1 is NOT subject to cap as you had H1 in last 6 years.

if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

Disclaimer: I'm not an immigration attroney, so please check with one for your situations as laws/procedures are changing frequently.

I have a question on filling up this form

It asks for Alien Registration Number (In section 5) - can anyone tell me what to fill this up with, since I do not have Green card?

There is a slot for I-94 admissions# which I have filled up.

Any help will be appreciated.

This incident opened my eyes and prodded me to move my fat ass to do something about this.

I just made my first contribution of $100 to IV.

Gandhi once said "Make your contribution, however insignificant you think it is. In reality, your contribution makes a huge difference".

Like he said, our little acts when combined become a formidable act and can accomplish a lot. I would suggest others make contributions too - especially now when everyone is excited - before you get back to the usual reticent state. let us not try to ride piggyback on some else's efforts.
