It is so sad that H1Bs are exploited by those "consulting" companies (which essentially are "human trafficing companies" like doing "slave trade") while Americans (at least some Americans) hate H1Bs. We are like modern "slaves" that nobody cares about. :rolleyes:

To forestall disappointment, and FYI, this may not happen in August even though our priority dates are current. Hopefully this quarter though, if CIS judged the numbers awaiting visas correctly before they jumped the dates ahead.

Mr. Nathan I have a great deal of respect for you and all those who have committed themselves to driving IV and all activities it is doing. But what you understood from my post is entirely wrong, and I have to explain why, because if this is the misconception you are having, not about me in particular but everyone who is not involved, then it definitely needs answers.
As I already clarified, I had stopped worrying about GC, long time ago, not after getting EAD.
I bought a house when I didn't even start my current GC process.
I went to India (Chennai) in my 7th year for H1 extension stamping (after completing 6 yrs of H1 and before I even filed 485). I didn't postpone it till I got EAD.
I left my employer who had filed for my labor in 2004 because he started acting up at the end of my project and started GC process with new employer well into my 6th year.
I do understand some people run to IV only in time of need. But all I am saying is not to paint everyone with same brush. Even if you think about people who want anything to do with IV only when there is need, lets try winning them over rather than stating the obvious and ridiculing them.

If you are on H1B you are facing lots of hardship and it doesn�t matter even if you are genuinely employed and in status. They used to ask only for client letters and now it is laundry list. Till 2007 things were different.
All the information is available in the IV's about page or wiki. There are people who genuinely do not have much info but there are people who do not want to participate. Because it�s not going to help them immediately until it�s going to bite them. Until then they do not see the value for their investment.

Can I begin Cons.Proc.after uscis approved my 140 case?or only when my PD become current?thanks
Ideally, you should have opted for CP at the time of filing your I140 and that way your I140 approval would have been forwarded to NVC and they would have initiated the CP. If you had opted for 485 9on your I140) then changing to CP is a cumbersome process.

Options for EB3I relief:

Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

Going by that, I guess, dates may move forward very slowly until these new applications are dust-shed and taken for process. And, this may take atleast 6-9 months or more in my opinion (going by the processing times of various USCIS centers).
They have started FY 2008 with some caution after July fiasco and may ease it up a bit in the next couple of months. I am confident most 2002 cases and some 2003 cases would see approval in the next 3-4 months.
2003 EB3 India? That would be interesting (because dates need to jump forward two years for that to happen)

No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.

I sent it on Thursday Sep 11th before hurrican IKE to CGI Houston. Money order was cashed on Sep 23rd. Sent $60 including the express mail for returning the new passport. I haven't received yet. Calling them doesn't help a lot. Does anybody think going in person will help? Do I need to get an appointment to enquire about the passport application? Thanks in advance for your help.
Try contacting them via email ( check on website). I have received good response from email than any other form of communication.
Donot worry, CGI Houston is just a tad slow but they will get your papers done.

Hi,
In my birth certificate, the name given is different than that used in my school records and passport. I have a laminated photo copy of the gazette record that confirms the fact that my birth certificate name has been changed to the name I have in the school records and passport.
Also, the municipality will not issue me a Not Available certificate since they already have one but with a different name.
Has anybody been thru a similar situation, if so, will the gazette record of the name change and the original birth cert( with a diff. name) be used as valid biographic documents.
Any help is deeply appreciated.

I had the same situation. I don't want to scare you but I went through hell to get it corrected. We filed a case against birth registrar and Courts rightfully gave a verdict in our favor. Total time taken to get it corrected: 18 months.
I would just give one suggestion: If your birth cert is not in right order, move on the fast lane and try to get things rectified at the earliest. Good luck!!
