Hi guys,
Is there a way to check your PERM status online using the receipt number? I tried researching it but did not find anything.
Only your lawyer or company can check it ...Labor is for company and not you.... so they have a right to check it.

No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.
You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.
I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.

I e-filed on 2nd June at TSC and around 22nd June, I went for FP. I received CPO email yesterday. I had not seen any LUD after FP. I guess, calling USCIS helps so please keep calling and request them that you need EAD badly. I remember , a couple of days back when I was talking to an lady IO, she said, she can send a request to IO but there is no guarantee that it will help. I guess, that might have made difference. So I would strongly suggest to keep talking to them.

It was great to attach faces to the IV handles...
I walked into situation room on Sunday night at 9 and was thrilled to find almost 30 - 40 ppl working hard on the preparations for the lobby day on monday. It was great to meet aman, paskal, pappu, logiclife, gsc999, nixstor, arun,..... (list is too long:D)
Soon I and mark teamed up to do the preps for the lobby day meetings. Monday was fun, with all the meetings with lawmakers with barely any time in between meetings - we were literally on the run, hopped on to taxi to save time and walk!! It was a chilling feeling when couple of times ppl on the hallway of Rayburn/Cannon stopped us and asked "R U lobbyist?":D
Dinner was a great. Hats of to Anu and Meenal for the menu... It was nice that we got the food all the way to situation room, so that we can have another go at it!!! Speeches by fellow IV-ers, lawyers and lawmakers at the dinner really primed us with lots of energy for rally on Tuesday. Ofcoz the wine helped too:D:D
The rally was just great. Even though I didn't have my breakfast, the energy of the people around me kept me going or was it the wine...
I had an opportunity to meet a great bunch of folks focussed on a common goal. After meeting 6 lawmakers and seeing the enthusiastic members who drive this organization. I am confident success is around the corner:D

- Issue one time executive order to grant green cards to those who have Priority Dates older than 7 years.
- Visa re capture if above two are not issued.
- Count primary applicant as a visa number and not dependents.
- If none of above are done at least deny/approve I-485 application as soon as possible and issue green cards later so that applicants know what they should do with their lives.
- If none of the above are possible, please shut the immigration.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

The status has been RFE Response received since Jan 2009. Called up UCSIS and created an Referral (i guess thats what is called as an SR). Not sure, if this will help.

Has somebody ever wondered if EB limit is 140000 why the heck USCIS is allowed to accept millions of applications at the first place?
Can we sue USCIS for that?

Admins or mods must change the title of the thread. This is going to disappoint a lot of our friends in this forum.
Well this thread has a good begining and then some suspence and then a dose of harsh reality.
Isnt that the story of some of us who came to US with a rosy picture in our mind and worked hard and the immigration system in the country gave us heartaches and headaches!!
It also tells our members how difficult getting a law passed is. We all need to work harder and harder to get anything done. We need everyone's full support in order to achieve our goals.

And they actually believe themselves they have every right to become a permanant citizens than legal immigrants waiting in line.
Some folks can't even bear the thought if some one thinks they should try to influence the law makers.
Illegals have nothing to lose. If CIR happens...they celebrate, now that they can all be legal and apply for their families to follow them
If CIR does not happen...they still continue to live here, work their jobs, keep sending money home, and try and get their relatives over here by paying the "coyotes"...it makes no difference to them.
Even if these guys are legalised, they will still NOT pay taxes, NOT learn english, NOT try and be upstanding residents.
They have huge numers, both in population and political support.
They represent a MASSIVE democratic vote bank.
WE (EB) have none of the above and a lot to lose)
Hence, the attitude.

I have seen that same tendency on ,when I asked about that, I was told that once your PD is current the RD plays the final role, if my RD is before someones with a 2004 PD then mine is done first. Now the service guy was the one telling me that. Question is how much can we believe them. Obviously we are getting mixed info here.
Lets just hope we all get it soon and this confusion they are causing with all the mixed messages is over soon!

I don't mean to be pessimistic regarding your application, but it seems that USCIS is processing old PDs 2003 and 2004 without looking at RD ( if it is within the published processing time or not). so if you have a PD of 2004 or older, don't worry about your RD and they will touch yours soon, assuming I-140 already approved. but if you have a PD newer than 2004, it might be a while before they get to those even if your RD is before 06/08/07 (published)
Also regarding the service request. I did a SR back in February to get an update of my case and they asked me to wait 45 days to hear something. I called again today ( 60 days later) and it seems that SR I did disapeared ( I even have a reference #). Customer Service rep said they can start a new SR but not sure if it is gonna do anything. they will get to the application when they can. and right now they are precessing 2003 and 2004.

Finally i got the email saying card production ordered on May 10th. My priority date is Ju26th 2006 , EB2. Thank You IV , Aman , Anu, Himanshu, Gopal and all other IVans for the help and most importently Aman for forming IV and giving us a forum to congregate and fight for our cause.
I am donor member since 1.5 yrs, was a member of advocacy day event last year. This april i could not take part because of a family emergency back home. IV has helped me immencely both informationwise and also psychologically during days of regression.
I will continue to be DONOR member in the future as well. I hope that will help other IVans.
I wish you all best of luck in your wait.
