I'm really happy to hear this. Serves you right for making calls and taking InfoPass all the time. You are unfairly trying to get ahead of others and lowering the productivity of USCIS. Let them work.

Instead of me letting USCIS do their work (in a way, i am calling them to remind their work..or probably you should tell IV folks to shut down everything and let USCIS do their work..a**hole....) probably you can quit job and go back to your country..I am sure you will do a great job of Lorry driver or cleaner (their psyche seems to match yours..sorry, lorry brothers no offense to you)

Hey ppl - Question for anyone who applied for a passport recently in NY embassy. The website states that they need 35mm * 35mm photographs. Are they strict about it or you can use the standard PP size photograph here in the US 50mm * 50 mm?

I want to know if one has to be in F1 visa to apply in this category? Please help...

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.
While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.

If my wife who is an MBA finance from Mumbai, currently working as a corporate banker with one of the top 5 banks in the world comes to the US on an H4 & decides to do a CPA certification, can she work on OPT until the H1B quota opens up next year???
It will be ok as long as they give her an F1. Here is something from a website -
Eligibility for OPT

The relation can sometimes be fairly loose; for example, a math major would often be relevant to a business job involving statistics, analysis of data, financial figures, etc. The determination is up to your employer, but they are well advised to be cautious. In case of doubt, it might be good for them to insert a mention in your offer letter subtly mentioning your major as being relevant to the job.
Your employment must be commensurate with your educational level; for example, cooking fast food would not be commensurate with a completed Business major.
You must have been in F-1 status at some point for at least 9 continuous months as a full-time student, not including high school. These 9 months can include summer vacation; one summer plus one semester might or not be enough. These 9 months can include time as a student in J-1, J-2, or other appropriate status.

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact others basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damege or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.
Bill Clinton did a wonderful fix by signing AC21 which corrected many shortfalls of immigration law.
I am personally not impacted by backlog. However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. there is ot a magic wand. We could help our administrators, law makers and law protectors and law upholders to make appropriate corrections. Hence, scientific and rational dialogue through fair and just means is our focus.
Let us highlight our difficulties in a logical way. Go about living normal life but stand up for something you believe in.

No, I didn't go out of the country for stamping, coz i was under the impression that my visa was Change of Status from L-1 to H-1. Only now, i could find from the immigration lawyer that i don't have a valid I-94. My employer was napping too, all this while.
u never got H1 approval notice with I-94 in it? If yes, then u have been out of status for over 6 months now.

Yes when you leave the country you are in status again! for i-485 AOS, USCIS will look at your status since your LAST entry into the country
Ok, so if I file the i-140/i-485 now and leave/re-enter the country with a new stamp. Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because by the time they are looking at the AOS application, I have already left and returned to the country??
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!
