If my GC gets rejected 3-4 years from now for any reason (however weird or stupid) then I don't think I would go through the whole GC nightmare once again.
Since this is my last GC application, I would rather use whatever benefits I have to the fullest then simply waste them. ;)

I have tried to convince people (Indians and some Chinese) to join IV. People don't. They don't believe IV has the capability to get anything done. A lot of people don't care if IV existed or not. They believe that Congress will get to it when it deems right. Core members were asking a few weeks ago if that is the message people are sending. Yes it is.
Yeah. We know that. A lot of people think IV cannot get anything done. IV never promised that we will cause CIR to happen. We never promised that we will cause SKIL to happen. They all happen, mostly on their own. IV's role is to add amendments when they come and remove provisions that hurt us. We did that successfully last year by getting the hard country cap removed. No one else was interested in removing the hard cap. It took a lot of co-ordination and lot of trips and lot of hard work to get it done. If that harmful provision had stayed, then the new quota of 650,000 in S 2611 would have been useless. People forget achivements of IV or think that it was negligible. Retrogression would have been exacerbated with hard country cap.
And this year, if CIR or SKIL bill come, we will be able to achive much much more. We are in much better shape and its hard for me to convince you of that unless I divulge details. That I cannot do. Its up to you if you can trust IV core on that.
You are reading the message right. I don't want IV to die. I am suggesting people with leadership skills to come forward and get SOME F**KING RESULTS. That is what is needed. It is do or die situation.
Yes, we know that your situation and a lot of other people's situation is do-or-die situation. We know that lot of visitors and members are being squeezed by their situation (exploiting employer, travel restrictions, naggin H4 spouse, no wage growth, no job mobility, no promotions) and that will end only when they get out of H1 and get GC. Its actually the do-or-die situation that prompted the creation of IV.
I am not a leader and I don't want to pretend that I am. I ask others who are not to step down and encourage the right people to take leadership positions.
That's what it seemed from your original post. And nothing wrong with that. If you are up to the job then you are welcome. We already have state-chapters and people are not actively participating in that. Last week, on California's state chapter conf call, 2 people came. If you take leadership, you need to do things locally like meeting with other people in your city, forming a group of 4-5 people and going and meeting your congressman. And if you want to be in IV core, then you have to call us on the phone number listed and we can see if you can add any value to core by doing things we routinely do, like content prep, website maint, travelling to DC for meetings, talking to other orgs etc. If you are up to the job, sure, why not. Anyone who considers themselves fit for IV core, please call us. We really do need help as we are overwhelmed.
I am a very dissatisfied member of IV. Are you satisfied with IV so far? Why doesn't everyone raise these questions? What has caused us to fail so far?
I am dissatisfied too with the results. Its not like I am a happy camper on H1. What has caused us to fail? The same thing that has caused us to fail last year, the same thing that caused industry to fail in getting H1 quota raised, the same thing that caused failure of Universities to get F4 visa for masters degree holders. And these guys have lobbying budget in millions? Why do you think they failed?
Whatever caused their failure, caused our failure too. In DC, issues are not debated and legislated based on morality and merits of those issues. They are taken up based on contemporary politics and other factors like lobbying, public attention, elections and political parties.
For example: Last year, they debated a constitutional amendment to ban flag burned in USA. And spent precious time of congress on debating it. How to you think that would have helped anyone? Even it had passed, what was the merit of the issue? Flag burned mostly happens outside USA. In USA people rarely burn US flags. So banning flag burning in USA is like banning metric system. Its meaningless. Yet, they spent time on it.
Read papers, read articles from other lobbying orgs and learn something. Legislations dont happen on their own because the issues carry weight and have merits. Merits have nothing to do with congressional action.
To quote a bestselling economist Steven Levitt :
"If morality is how we would like the world to work, economy is how the world actually works".
Same thing applies to US congress. They dont set their timetable of bills based on morality and merits. There are other factors.

Eb2 will be always better positoned as the spill over from Eb1 and other countries happen towards the end of the year. If there is some spillover for Eb3 then waiting time will decrease based on the numbers given.

I have worked with a senator's office for a completely different matter and they are very responsive - since you have caught their attention and already have a file open, it will be helpful to respond with a concise letter so that you can get more accurate information.[/QUOTE]

I have somewhat uderstood the rulemaking process. What I fail to understand is that since the rule to stop labor substitution is the final rule, does it mean that this rule has been implemented? Or is the next step for OMB to approve the final rule?
I am confused!

StuckInMuck thanks for the awesome compilation. I have a follow-up question to the guru's on forum.
I did an AC21 before my GC got approved. I did this on my EAD card and when I joined I filed my I9 form for taxes. Now after getting GC do I need to renew my I9 form or the old one stays valid?
Also since I am not with my GC sponsoring employer do I still need to follow the 6 months rule with my current employer since date of approval?
Also can we move this compilation to IV Wiki?
#1 You need to update the I-9 form of verification because previously you employment authorization was the EAD card now your employment authorization is the GC card.
#2 First of all there is no 6 month rule. Secondly even if theoretically there is a undefined period it does not apply to you anymore since you are no longer with your GC filing employer.

Aghast...... Can this happen? I think they have to return the application filing fees. Has any one else heard about this.
USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

Hello anurakt,
Thank for contributing again to IV. You and other members like yourself would be the reason for IVs success in changing the flawed green card system.
Thank you for encouraging other IV members for contributing. As you know, this is very important and more amongst us should encourage our fellow IV members to contribute. Often times it is evident that few IV members are struggling to keep a positive tone on the forums. As you may have experienced, it is easy to post few messages here and there. The message of some of these posts is to throw out ideas for others to implement. But in the end, the success of our community will depend on the contribution from kind members like you. Thank You.
Regards,
WaldenPond
Waldenpond, here is my $100 contribution. This is in addition to my previous several contributions and I am glad to contribute again.
Thank you and IV core team for your continued dedicated efforts and leadership. I wish all of us success at the end.
FRIENDS ON THE FORUM : Please give it a THOUGHT and CONTRIBUTE .. Your contribution as mentioned by waldenpond can make a DIFFERENCE at the end.

PD provides twoway door, one for new people to apply and other for USCIS to approve pending cases. Having more applications pending (out of PD range) will not help USCIS to approve cases, they need to move the PD forward for more applications to become current and for them to approve some of them.
Most of the people who rushed into July-Aug 2007 where EB3 or EB2 India/China. Since EB3 is closed for the year they have to move the number of EB2 India/China to pick those applciations.
well yeahhhh ... anyways, we will definitely have the numbers moving from now on EB2 and it may retrogress but not beyond April 2004 :)
anyone who opted for CP between april 2004 and june 2006 are the lucky ones if they can get visa appointments ... true ?

WaldenPond is too nice to answer your question. Personally, I wouldn't consider it obligatory to answer a specific question by someone who cannot volunteer due to "Personal Reason", whatever that may mean. If you cannot volunteer, cannot participate in IV's action items, cannot contribute, then you are most welcome to use IV's portal to get answers to your questions or get other kind of information - but do not expect updates from anyone as your right!
IV is not a top-down organization and if you think that it is becoming like Immigration Portal then partially it is due to people like you who do not want to participate but just want 'updates'.
You are partially right.
One thing I know for sure - you know how to copy paste and repeat the same post again and again :)

With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV). The more obvious things that can be found for example in USCIS handbook (http://www.uscis.gov/files/nativedocuments/M-618.pdf) are not included here. Below is a snapshot of what I have gleaned from Internet so far, and please add your own input(s):
LIST of DO's :
[This is an evolving list thanks to valuable inputs from folks here and elsewhere, so keep checking back.]
Cheers,
Stuck(no more)InTheMuck
Thanks for the detailed information.
I have a unique situation here. My original GC sponsor (a multi billion dollar industry leader) laid me off after 6 months of I485 due to lack of position in the company.
I ported my GC using AC 21 and joined another small consulting company. Now my GC is approved and I have an offer in hand from another company.
Will it be a good idea to move or do I have to wait for 6 months or 1 year before I make an employment switch.
My most important consideration is that there is chance of potential loss of job (may god forbid) with the current position. I may be able to save myself by switiching job right now. And of course there is more money on the table.

Top 10 Immigration Hawks in Congress
Posted Feb 24, 2006
10. Sen. Tom Coburn (R.-Okla.)
One of only two Senate GOP co-sponsors of the Border Security and Interior Enforcement Improvement Act to build a border fence, increase agents, give local law enforcement the ability to protect citizens from illegal immigration and require countries to accept their citizens back quickly. Sponsor of bill to deny birthright citizenship to babies of illegals.
9. Rep. Elton Gallegly (R.-Calif.)
Has called for a constitutional amendment to deny "birthright citizenship" to babies of illegal immigrants and for an end to welfare for illegals. Sponsored amendment allowing states to deny education to illegals children. Introduced a bill to require employers at critical infrastructure sites to use computerized system for verifying an employees Social Security number.
8. Rep. J.D. Hayworth (R.-Ariz.)
When Mexican President Vicente Fox called the idea of a border fence "disgraceful and shameful, Hayworth declared, President Fox should shut up." Author of Whatever It Takes: Illegal Immigration, Border Security, and the War on Terror (Regnery, 2006a Human Events sister company).
7. Rep. Steve King (R.-Iowa)
Has assumed role as a national leader on immigration reform and opposes guest-worker program, saying, "Mere discussion of the possibility of amnesty encourages illegal immigration." Sponsored an amendment to enforce a law forbidding localities from preventing police from reporting immigration information. Led series of immigration forums titled "Secure America's Future."
6. Rep. Lamar Smith (R.-Tex.)
Recently named to U.S. Border Controls Honor Roll for his perfect voting record on immigration and border issues. His 1996 Illegal Immigration Reform and Immigrant Responsibility Act mandated implementation of a national exit-entry tracking system for all aliens but is not near completion.
5. Sen. Dianne Feinstein (D.-Calif.)
Supports stiffening penalties for alien smugglers and increasing number of border control agents. Last week announced new legislation to crack down on the construction or financing of tunnels into the U.S. Sees guest-worker program as a magnet for continued illegal immigration. Told Human Events that if we can build a fence along the entire Mexican border, we should.
4. Rep. Duncan Hunter (R.-Calif.)
Chairman of the House Armed Services Committee. Advocate of building a fence along the U.S.-Mexico border, sponsored amendment to authorize construction of several hundred miles of fencing, which passed 260 to 159. In 1995, led fight to authorize an additional 5,000 Border Patrol agents when Clinton Administration attempted to cut resources.
3. Rep. John Hostettler (R.-Ind.)
Chairman of the House Judiciary Subcommittee on Immigration, Border Security and Claims. Sponsor of the Secure America Act to strengthen immigration enforcement and sentencing and to authorize use of the armed forces on the border. Said Bush's guest-worker plan "puts the interest of foreign, illegal workers above those of our own American citizens."
2. Rep. Jim Sensenbrenner (R.-Wis.)
Chairman of the House Judiciary Committee. Authored the REAL ID Act, preventing driver's licenses issued to illegal immigrants from being used for federal purposes, such as boarding a plane. His Border Security bill rejecting Bushs guest-worker plan passed the House in December.
1. Rep. Tom Tancredo (R.-Colo.)
Chairman of the Congressional Immigration Reform Caucus. Has repeatedly attacked the Bush Administration for its support of a guest-worker/amnesty program for illegal aliens. Once said that President Bush is an obstacle to immigration reform and that Bush's "open door" border policy is a threat to national security. Afterwards, was reportedly told by Karl Rove, "Don't ever darken the doorstep of the White House."
Thought it would be a good read..

the worst idea ever.
first - probability that potential employee of that employer will read it is zero.
second - employer continues to act same way to other people.
third - employer can actually sue him for doing so.

My impression from the description of the original poster, , which could be incorrect, is that the first 5 cars were at a stand-still or barely moving (due to traffic jam or red light); the OP or the 6th car hit the line from the behind. It is not about tailgating.
I am sorry, I should have worded it properly. My message was for people tailgating too close. On a rainy day, one of my friends skidded and hit a vehicle in front of him when it stopped suddenly, but he was the one given the ticket.
