Please refrain from using the terms "Indian legal immigrant community" in your communication with OMB. IV represents the skilled legal immigrant community in general and not immigrants from only one country. Doing this defeats our own cause and divides us. As a matter of fact I know several people who belong to EB2 ROW whose PDs are 2005-2006 and they are still waiting.
IV was established to represent legal immigrants from all over the world. Please do not indulge in such divisive campaigns. You have been warned.

I think ur's was a simpler case than mine.
The problem with mine is that the entire name is on one single line and I would like it separated, first and last name on their respective lines. The NY consulate has refused to do so without an affidavit.
The procedures on the website also clearly say so for a name split:

My PD is Sep 2004 ( EB2 India ) and I was also July 2007 filer, and also the victim of my 485 being closed by USCIS nebraska in May 2008, which anyways got reopened within a month after supplying necessary documentation ( Approved I140 and moved to new company etc ) . I work on an EAD now. My question is
1) My AP is expiring in mid October. Should I file for a AP renewal and spend extra money ? Do I have a chance of getting GC in September ? Btw I was told last year at USCIS newark, NJ office that all the background checks and other things show clear on my case.
2) I moved my apartment 2 blocks away early this year, but my city and zip code are the same. If I file an AR11 ( change of address ) , will it raise any flags, since I have read on this forum that a change of address sometimes prompts an RFE. I am a bit scared of going through ups and downs, so I just feel like not doing anything which might create any kind of issue after so many years of pain.
Please give your insight. Thanks so much in advance !
Jim77, it is highly advisable to apply for your EAD (if it is expiring soon), not neccessarily your AP if you do not intend to travel. You also will need to file your AR11, reason being any government communication is not forwared to the new address. If you were to be approved for the GC next month, it will not reach you as the post office will send it back to USCIS as undeliverable. Filing an AR11 will not trigger any RFE. Maybe if you changed cities, then it might coz there might be a concern on what status you were working on, like if you had an AC21 etc. but within the same zipcode, I dont think so.

So the worst that could happen is that our friend ends up paying $3,000. Also note that I-485 will be in trouble if and only if the prison term in more than 1 year (or) if the beneficiary had failed to include his arrest record on his I-485 application. Besides that, there are many waivers available for first time convictions.
When USCIS is protecting illegal aliens through "U Visas", wouldn't they be considerate on a case involving the baby of a legal alien?
Going by the above, it makes sense for "thunderbolt" to take help from a qualified attorney and report this case to cops. Posting the video in youtube or bashing the Nanny is Sulekha/citysearch is all fine. But when you child grows up and asks what you did when he was abused as by the nanny, you don't wanna answer "Dear child! I took the video footage of the abuse, showed it to my friends and posted it on you tube and then I bashed her with my comments on sulekha/citysearch."
Hence if there's any justice to be done for the poor soul who couldn't even express himself, then take the evil nanny to cops. Or else you're just letting everyone to walk all over you like a doormat.

I have been in this country for 7 years and waiting for PD to apply for 485. I want to share with everybody how employers can really **** the GC. My labor was cleared in sept. 2004, that time it was current and was eligible for concurrent filing. My employer kept on delaying and applied during december christmas week end. Later he surprises me saying that it was rejected, attorney had sent 140 and 485 to California processing center instead of sending it to vermont. On the labor approval, it is clearly written that it should be sent to Vermont for 485. He did not provide me any proof that he had applied for 485 before retrogession was effective.
From the looks of it, your employer is willing to go to ridiculous extents to keep you from obtaining a GC. So why do you want to reward his malicious behaviour by continuing to work from him? What's the guarantee that he will apply even when your priority date becomes current?

Is this period (July 1st 2004 to Feb 28th 2005) considered as Legal Status assuming the following scenario
1.company Applied for H1 transfer on July 1st 2004
2.Started taking Training from the companyfrom July 1st 2004 and finished Training on 30th Aug 2004
3.Started the client project and got payslips from Sep1st 2004 till 15th Feb 2005
4.Got employment letter from company from July 1st 2004 to 28th Feb 2005

Yes, but it is not the receipt generation, it is the actual review of the case as per advertised processing dates. if your case is in the Processing Date window (based on your online receive date), then most likely your case is preadjudicated, and now is waiting for the visa in sequence of PD. Best of luck.

Currently NSC processing time for employment based 485 is 15th Sept. 2007... My notice date is 18th Sept. 2007 (based on case status shown on USCIS site)
Looks like I am going to miss my GC by 3 days and wait till next year :mad: I highly doubt that dates will stay at 2005 during next month bulletin.. (I truly hope I am wrong!)
My PD is 12/04 and yesterday I learned they haven't even opened my case file. So for all these years it had been gathering dust. But that could be just my kismet and your might be different. Anyways, I am not looking for GC till 4th qtr 2010:cool:.

Kudos & thanks a lot IV team! I hope this inspires members to contribute regularly which in turn will enable the core team to carry on the sustained lobbying effort to bring about systemic changes. Although today's news is great, this is only a small step. Now begins the long long wait till our cases are taken up for adjudication. Our woes will not go away unless the underlying problem of severely constrained visa availability is addressed.
Time to roll up our sleeves and continue working with renewed vigor.
