    I'm calling on my way home from work.

    I've also sent emails to my local representatives and senators. See below (parts were taken from Ron G).
    While I agree that calling on the CHC reps could have some success, calling on the others might be even better. Just my 2 cents.

    I am appalled that the Congressional Hispanic Caucus is being allowed to
    dictate immigration policy to the United States Congress. As your
    constituent, I demand that you notify Speaker Pelosi that you earnestly
    desire that she stop giving in to the CHC and allow legislation to proceed
    to the floor for a vote.

    The Congressional Hispanic Caucus has decided that there will be no
    immigration legislation considered by Congress unless it includes an
    amnesty for illegal aliens. While I sympathize with the problems they're
    facing, it is no reason to keep all immigration bills hostage and ruin the
    lives of so many people.

    I have been legally in this country for x years studying, working and
    paying taxes. I have a Masters Degree in xxx from xxx. Our lives have been in limbo for the last 4 years waiting for our green card application to be
    approved. Any of the bills currently introduced for the EB community
    would give relief to many people caught for years in this waiting game.

    It is time for the tail to stop wagging the dog. This nonsense must end.

    Here are the examples I presented (lightly edited). Anyone wanting to meet with lawmakers should feel free to use as much of these documents as needed.

    Examples

    Case 1 (Waiting 10 years):

    - i left a very well-paid job after 5 years in multi-nationals before coming to US in 1999.
    - Did dual Masters from a top engineering school + business certification
    - Brought into US $25000 from savings abroad for my studies; Took $25K More as a private loan and have paid it off long back.
    - Never considered myself underpaid in USA. My compensation is amongst the best.
    - Have owned a house since 2002 and raising two US born kids, of course paid taxes for 9 years.


    Now,
    - it is the quality of life AND the quality of PEOPLE that i wanted to work with: one of the reasons why i came to US.
    - Would like to buy a larger house and can certainly afford it today with a credit score over 800.
    - Would like to start my own company, or try to do something different & more strategic for a job function.

    However,
    i have been in the EB3 queue since 2004, with no respite in sight. All is clear except that there are no visa numbers available.

    The issue as you all agreed to - is that this is painfully slow and everyone like me is stuck with one employer and the same job.

    As employers and their lawyers often decide when and in which category a candidate can apply, the employee is left at their mercy. It is understandable if an employer is sponsoring, they must benefit for their investment. Question is how? is 5 years of 'must-serve-us' good enough, or 10, or 15? When can an employee have the mobility?

    Why is it that someone with equal or less qualification / experience can become a US citizen 5 to 10 years before me? Just because they were born in a different country? Because their employer decided a faster EB category? Because they married a US citizen?

    I love America and remain grateful for the opportunities it has provided.
    However, I have trained a lot of US citizens / GC holders who have gone far ahead in career, and I am still doing the same.


    Liberty seems only a statue at times.

    Case 2 Engineer (Waiting 15 years):

    I have been in this country for more than 15 years and still waiting for the GC...I have never been out of status all along...Here is my story...

    I came to US in 1994 fall to attend graduate school and started working from 1997 as transportation engineer. I applied for green card in 1998, but unfortunately the rules were different and the goal post seems to change every time.

    During that time all engineering fields were clubbed together (computers, mechanical, civil etc.) under one generic field for labor certification purposes and therefore the wage requirement was much higher than what a typical transportation engineer would make at that time. Therefore my labor was denied. After talking to my immigration lawyer I was left with two options...Pick up a job that paid the asking labor certification wage (which was skewed and next to impossible) or send additional documentation and references to convince the dept of labor that transportation engineers do not make that much money and that I am being paid more than the prevailing wage for 'transportation engineers'. . After I send additional paperwork to dept of labor based on the suggestion given by my lawyer, what if the dept of labor still denied my labor? I would have been back to square one, and moreover I would have lost a year or two on H1 status. Please note that at that time you had ONLY 6 yrs of H1 visa and it COULD NOT BE EXTENDED EVEN YOUR IMMIGRATION PAPERWORK WAS PENDING. The above rule came later (instance of goal post moving), but I had to make my decision based on what the rules were at that time. So I decided to go back to school in 1999 and attended graduate school to get a computer science degree.

    In late 2000, I joined a company in CA and resumed my paperwork for the green card. My labor was approved and filed for 140 and 140 was also approved in 2002. In 2005, my spouse started to work full-time and started the green card process. We finally applied 485s in 2007, but are still waiting for the approvals. It took CIS almost A YEAR to get our EADs! That too after many calls, letters and contacting the local senator! What an inefficient bureaucracy!

    When the economy was good, I was helpless with CIS rules and its bureaucracy. By the time I received my EAD, the economy is in shambles now...In the process, I had nothing to show for the past 5 yrs!

    Few years back there was a pilot program at TSC where they issued FB green cards under fast track. I personally know someone who applied for their parents, and they got their green cards within 60 days! Their parents never visited US before and during their first ever visitor's visit, they have their green cards? Here I am, came to US in 1994, attended graduate schools, paid tuition, contributed to research, paid my taxes, never was out of status and most importantly, played by the rules, but I am still waiting in this mess!

    Case 3 Partner (Waiting 14 years):

    I've been here for 14 years now; and my wife for 9, legally for every single day. We have two US graduate degrees each. We have paid over $100,000 in federal income tax alone, in each of the last few years. We own our home. Our child was born here. I am a partner at my firm. And we have many wonderful friends here. But we continue to wait indefinitely for our green cards. Citizenship seems an impossible dream at this point.

    Any provision that would bring us closer to citizenship (such as "citizenship fastrack for those who've legally been in the US for more than 10 years" and/or "paid taxes for N years" and/or "earned US graduate degrees" etc) would be very welcome.

    Thanks for your efforts.

    My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.

    These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.

    Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.


    Thank you Totoro. People like you keeps the hope alive in our heart that someday justice will be done.
    So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
    However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
    Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
    Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
    Firstly, How fair will that be for our children who are Legit Citizens of US.
    These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
    If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
    This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).
    BTW, my moral support has always with Obama, and with Zoe Loefgren.
    Many of us cried when Obama read his oath. That was the defining moment for all people who have been subjected to injustice, been told that they were not good enough because of their race or country of origin. Think about it... The Chinese and Indians having to wait so many years just to get a GC is injustice being done to a people of certain origin. Oh well!

    I think most on here know that IV's central goal is to clear the backlog
    However there are many underlying specifics to get to this goal
    and i think that's what the members on here want to hear about.
    for example
    Re-capture of unused visa numbers
    removing country specific limits
    Automatically granting visa numbers to those who have waited 5 years or more
    Increasing the total number of EB visa numbers
    Allowing non-current people to file I-485 and get EAD

    As you can see there are many different causes and many different solutions
    What is IV advocating...which cause?...which solution?

    StarSun, Pappu please don't take things personally. Not all members can go to DC or visit their state representatives. I am sure IV has many other needs. If we can identify and openly publish a list of things that are needed then we can certainly increase volunteers and participation

    Btw...how do you join the state chapter?
    The answers to many of the questions asked may be obvious for you since you are heavily involved with IV...but they are not obvious to a lot.

    I got my original passport renewed at Houston. Here are my details.

    Original Passport expiring on Feb 05/2011. Sent the completed application form with all the required documentation to Houston on June 17th. Received new passport on Jul 07/2010.

    Prompt service in less than 3 weeks. Last week I emailed them requesting the status of my application and never got a reply. Tried to reach them on the phone, but no one answered. Was getting little concerned as I have an upcoming trip by end of this month. Got the fedex this afternoon. Very good service.

    I am jumping ahead of the situation here, but I just wanted to see what other members think/know. Assuming that the 90K visa recapture happens, It doesnt take too long for them to be used up in the current situation where there are a lot of people with labors and approved 140's (w/PERM). Not every one will have an oppurtunity to file for a new labor and file for 485. If DOS makes the PD's current / post Mar 2005, wouldn't it be unfair to people who labors are pending for 3 yrs. How does this work out in the previous recapture? HLG doesnt say about numbers being forwarded to the next year though.

    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    This warning was issued in the March 2000 VB:
    VISA AVAILABILITY FOR APRIL(2000)

    �Demand for immigrant visa numbers by INS for AOS cases in all categories, continues to be steady but has not reached the level requiring action at this time. It is anticipated that INS demand for numbers will require the establishment of visa cut-off dates for April in some or all of the CHINA-mainland born and INDIA Employment categories�.

    In May 2000. EB2 was retrogressed to 01JUL97 for China and 01APR99 for India

    In December 2000 VB the big announcement came:
    Greater availability of EB immigrant visas: On October 17th, the President signed P.L. 106-313. Title I of this law is known as the "American Competitiveness in the Twenty-first Century Act of 2000" and contains amendments to the INA regarding EB immigrant visas.
    In fiscal years 1999 and 2000, due in part to the per-country limits, the annual limit for EB immigrant visas was not reached. P.L. 106-313 makes the following changes in an attempt to rectify the situation with regard to per-country limits:
    Section 106 recaptures those EB visa numbers that were available but not used in fiscal years 1999 and 2000, creating a "pool" of approximately 130,000 numbers. These numbers could be made available to applicants in the EB1, EB2 and EB3 preference categories beginning in fiscal year 2001.
    Section 104 removes the per-country limit in instances where the overall applicant demand for EB visas is less than the numbers available without regard to those limits. This determination will be made quarterly, based on a comparison of the overall demand versus the available numbers. If the total number of available EB visas is greater than the number of qualified applicants who may otherwise be issued such visas (during the same period), the per-country limitations on EB visas will be lifted for the remainder of that quarter.
    In May 2001 EB2 became current again for both India and China.

    July 2001 VB:
    EMPLOYMENT-BASED PREFERENCE CATEGORIES:
    All categories have become "Current" for July, and are expected to remain so for the remainder of FY-2001. The cut-off date movement in all oversubscribed categories has been extremely rapid during the past year. This is because the FY-2001 limit is approximately 50,000 higher than normal, and legislative changes removed the per-country limitation if there are otherwise unused EB numbers available.
    All categories are expected to remain "Current" for the foreseeable future.

    January 2005 VB
    OVERSUBSCRIPTION OF EB3 FOR CHINA, INDIA, AND THE PHILPPINES

    EMPLOYMENT VISA AVAILABILITY DURING THE REMAINDER OF FY-2005
    During the past month there has been a significant increase in the amount of numbers being used by CIS offices for AOS applicants. This level of demand has significantly depleted the supply of EB numbers available under the annual limit. Recent discussions with CIS have made it clear that their backlog reduction efforts will sustain or increase the current level of demand. Therefore, continued visa availability in the EB categories cannot be guaranteed during the final quarter of FY-2005. If demand continues at the current rate, it will be necessary to oversubscribe many or all of the EB categories on a Worldwide basis. Such oversubscription could result in the establishment of cut-off dates, retrogression of already established dates, or some categories becoming �unavailable�.
    July 2005 VB
    EMPLOYMENT VISA AVAILABILITY FOR JULY AND THE REMAINDER OF FY-2005
    EB3 and Third Other Worker categories have reached their annual limits and no further FY-2005 allocations are possible for the period July through September.

    September 2005 VB
    EMPLOYMENT VISA AVAILABILITY DURING FY-2006
    The backlog reduction efforts of both CIS, and the DOL continue to result in very heavy demand for EB numbers. It is anticipated that the amount of such cases will be sufficient to use all available numbers in many categories. As a result cut-off dates in the EB3 category will apply to the China, India, and Philippines chargeabilities beginning in October, and it is possible that Mexico may be added to this list. In addition, it is anticipated that heavy demand will require the establishment of a EB3 cut-off date on a Worldwide basis by December.
    The amount of Employment demand for applicants from China and India is also likely to result in the oversubcription of the EB1 and B2 categories for those chargeability areas. The establishment of such cut-off dates is expected to occur no later than December.
    The level of demand in the Employment categories is expected to be far in excess of the annual limits, and once established, cut-off date movements are likely to be slow.

    October 2005 VB:
    EMPLOYMENT PREFERENCE VISA AVAILABILTIY
    Item D in the September VB announcing the September cut-off dates provided information regarding the prospects of visa availability during the early months of FY-2006. Many categories have become oversubscribed for October, and cut-off dates established due to continued heavy demand for numbers by CIS for adjustment of status cases. Forward movement of the cut-off dates in these categories is likely to be limited.

    And IV was born.

    Unless one has studied in the US, one will not realize the worth of the US educational system. One clear attribute of US educated professionals is their superior written and verbal communication skills. Not to mention the enhanced ability to culturally fit in a diverse environment.

    If this were the case why so many "US educated desis" work for so called "body shoppers" and stay in "Guest houses" provided by these desi consulting companies.

    Hi, lets each get 1 American / Permanent Resident friend/coworker get to call at least 1 person from this list. Granted, they might not be as vested to call all of them. But each call counts. Please have them call at least 1 person. This should take less than 1 minute and if needed, dial from your phone and give it to them :).
    Please, consider doing this. I know it is hard. I know it can be uncomfortable. Ask your immediate manager. Ask your coworker. Ask your brother. Ask your graduate TA. Ask your advisor. Ask anyone. Just get those calls out there. This really is about asking them to help you so that you can live a 'normal' life in a free democracy that is less than free for you. Please. Consider asking at least 1 person to call 1 person on this list.

    Its not as hard as you might think.

    The goal of Team IV is to raise awareness about the issues faced by highly skilled legal immigrants in the communities we live in and garner support from fellow Legal Immigrants and US Citizens to further IV�s cause.

    Mission
    Team IV is the walking/running club of Immigration Voice. Team IV�s Mission is to raise awareness for the issues faced by Legal Immigrants and to promote a sense of community by participation in walking/running events throughout the U.S.

    Team IV�s goal is to have over 150 members and raise at least $45,000 to support Immigration Voice and help prevent childhood obesity in the United States.
