I don't know that much about immigration and what I do know, is blurred by the amount of information out there - that said, I do think that a bill that represents the people contributing to the betterment of this county by working in their specific fields is a good thing. And it gives way to a cleaner system to evaluate immigrants. I would rather have heard a no in the beginning than be approved and sit around waiting for the forseeable future.

If this kind of restriction is not done what will be best way to resolve H1b issue? If H1b increase is done and similar increase is not done on GC then also problem to all IV members(retrogession will continue). If there is cap then certainly it will be reached every year within April.
If they restrict consulting then Most of the H1b persons will get permanent job. Because of less number of H1 most of them will get gc within 2 or 3 years. GC holders and US citizens will do consulting. System will adjust iteself within a few months

That training made them capable of gettting H1 and paycheck, not the books they read in US masters courses.

When employees of chipmaking and software development companies are laid off en masse, (and many of whom have masters degree from USA) where do they do to fall back and file H1 before the grace period expires?

I am in a similar situation. My wife who is on H1B did not worked till date.
Is it possible if she carries the vacation letter from the employer and go to India for H4 stamping? My wife do not have any paystubs.
I have also contacted my attorney and waiting for his response. I am running out of time due to the GC priority dates being current. If the attorney does that while she is in the country, it would take around 4-6 months. By then, the priority dates might be retrograted.

In this country, anybody can sue anybody over anything!
Now why would i sue IV. It is the organization which is making an effort. Sadly that effort is hurting EB3 folks. The whole idea is that we are a community and as a community we need to discuss all issues. Now when i talk about EB3 issues a EB2 volunteer (I commend you for doing what you are doing w.r.t. advocacy) asks me how many law makers did i meet. Now why would i meet a lawmaker as a representative of IV if i believe what IV articulates impacts EB3 adversly

I couldn't agree more with you. This is the worst thing to happen for ppl who have been patiently waiting in BEC lines since 2001 !!! But remember you are getting screwed now others have either been screwed at some other point or will get screwed later. We all get screwed :D
I couldn't agree more. I am one of the lucky PERM filers with a 2006 PD who will get to file the 485 next month....but doesn't mean, I haven't been screwed before.
DOL screwed me the very first time in 2001 with my RIR labor....after 2 years they remanded it back to traditional labor...since 2003 it had been languishing in the labor queue and then at the BEC until finally in 2005, I lost my job...
After 4 years of struggle with the DOL, all I got was to start everything all over again in late 2005....In 2005 when I started this new job, the 485 filing looked almost 5 years away...through all of this me and wife had started living separately due to our professions and respective H1s...
Up until May of this year, it almost seemed like nothing was going to change and we will have to keep up with this wait and separation at least for the next 3 years or so...
But, we do get to see the light at the end of the tunnel now..

I am also waiting for the PERM process in chicago center. But its not a year. Its only three months. There is no info from DOL, no auditing. But so many guys applied after me got approval. So I am really pissed off. I dont know what order they are processing the papers.

Its risky but it is fulfilling when done in the right way.
It is easy to loose your shirt if you are not disciplined and stick by the rules (More on how to build your rules later)
GREED is the one number one enemy of PDTs.
Overcome greed and you will love to trade....you will love to convert your loosing trades into winners.
I welcome comments from traditional traders as they serve as a filter as well.
To say the least ...my dad who has been an active investor for years is still against DT or short term trading since he is a traditional investor.
No doubt you will make money there too but its like planting a seed and watching it grow every minute .(In a good , long and boring way I think)

While we know that all NON GC Holders will stop buying houses for the correct reasons I want to underscore some subtle reasons that influenced this buying spree. It is not my intention to put any one on pedestal. I am just writing what I observed. Not intended at any one in person.
Greed and lack of understanding
Want to make easy money. People think that Real estate value does not fall, just like in the places where they come from, where property has two values, Market value and government value with a huge differential. In the US, the county property assessments are purely based on market value. So thinking that the gains are not going to evaporate is lack of understanding of the system coupled with greed.
Do I/We really need a house?
Not many of the troubled home owners might have asked this Q. Had if they asked this Q, things would have been a lot better. The discussion of buying vs renting was almost gone. Every one held the opinion that buying trumps renting.
Save money on Taxes
This IMO, is the biggest myth. One needs to keep changing the house every 5 years to have the itemized deduction more than the standard deduction.B T W, If you live in one of the states that do not have state tax, your itemized deduction might not be so big that you will really benefit a lot every year. Hey! It does not matter where you are paying. Either you pay your taxes to uncle sam directly so that the govt can run fine or buy a home and contribute to the economy. In the end Govt gets the money. Biggest lie propagated by Realtors. Look at the amortization tables of your mortgage to find out.
Bad Realtor
Giving cash back to the buyers and trying to sell every damn home. When I buy a home, I will refuse to take the money from the Realtor off the bat. I will make him/her work and find the right home I want and would not just buy a home in a day. Easy money for the Realtor and a bad home with a bad loan for buyers. There are people who went out on the weekend and signed a home and told me at work on Monday.

DINKS=Double income no kids. So what? That is now. what about six months from now? Are there going to be any life changing events? We cant predict every thing but it is NOT difficult to forecast whether a family is going to have a kid or not and what kind of financial implications will such events have?

There is a reason why 20% down payment was a norm in the mortgage industry for a long time. 20% down payment keeps PMI and the high interest rates on your secondary loan away. I know people who are burned because of PMI and interest rate on second loan. Such down payment will keep the monthly EMI affordable and leaves out gimmicks.
I can understand taking a second loan on the 10% down payment, but people were let go with 0% down payment leaving them with a bad loan and a bad home. Some people bought the home they wanted, but the price was too high. Thats all they are left with.
As President O said, we collectively failed to take difficult and correct decisions even though the greed and deception can be attributed to some people on the wall street.

There have been a number of publications that have shown that the vast majority of the "illegal" immigrants actually pay SS and Medicare taxes. They also contribute to federal and state tax regardless of the benefit that they receive from it.
Well it is against the law to employ illegals and this is enforced strictly, so we can forget about tax deduction at source, SS, etc. It will be minuscule. These so called publications are from their supporters which they have numerous of.

An American I met a few days ago was telling me about how he was unemployed for almost 3 years. He is a well educated person and didn't think it made sense for him to find low-skilled labor!
I am aware of that well publicized stunt. Do you know we have only 800K farm workers and 1.5 million farm workers were granted amnesty in 1986?
The only way to get cheap labor is with short term foreign contract labor, amnesty will never work, they have to return anyway.
The farmer will stop working in the farm, the day he gets his GC. Lets not compare an educated american. A citizen with no schooling would take the job at the right wage.
The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills.
There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.
we, too, like the "illegals" contribute to a system that we cannot benefit from anytime soon. (Like social security and Medicare). We do need to push legislators to come up with a good immigration policy. Bashing another immigrant because they came here to do something different from you is not going to get us very far. Be compassionate towards those people too

My aim is not to bash them, I hope they can find a solution. Citizenship is not the answer and I'm tired of seeing all immigration bills partial to illegals. The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills.
There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.
we, too, like the "illegals" contribute to a system that we cannot benefit from anytime soon. (Like social security and Medicare). We do need to push legislators to come up with a good immigration policy. Bashing another immigrant because they came here to do something different from you is not going to get us very far. Be compassionate towards those people too
We are not like illegals. The only one who is like them is an illegal employee at a gas station or grocery store.
My aim is not to bash them, I hope they can find a solution. Citizenship is not the answer and I'm tired of seeing all immigration bills partial to illegals. They should go to the back of the queue and get reform only after legal immigration is fixed. Their supporters are hampering our efforts. The sad news is they thought they could get amnesty like 86, but most will end up being deported.
Do you know of the 400,000 deported this year 50% were convicted criminals?
Compassion should be preceded by what is better for the US. There are millions of poorer people in Africa and India who need more help. These countries have better farmers too.
