I hope we have a flood of approvals this month. The more approvals we see the further the dates will progress in Oct. So I am hoping that USCIS clears all pending cases till Jan 2005 and then moves the dates to Jan 2006:)

macaca it does make sense. This si what they are doing...opening up the flood gates and allow for a flood. from this flood they will be able to easily approve 40k cases.
once that is done they will shut the flood gates so that the level starts moving towards equilibirium...with labor substitution ending on july 16th ...the 70k backlog elimination labor aps will be done quick enough.. since many will have redone their LC in PERM..and uscis will have an accurate headcount of people in line from this floodgate opening process.
i dont think we ll see retrogression back to 99... but maybe more mangeable levels

Dear All,
The idea about the oath is good. Most of us do great, creative things at work and earn the appreciation of our peers and seniors. Why not we brainstorm now, come with creative ideas to help ourselves?
Let us be open all new ideas. No idea is stupid!
Personally I would think of a mass satyaghraha but not sure now many will like it. It is a peaceful and well tried Gandian method to highlight our plight

My PD is Nov 2001. It became current last month. Filed 485 this month. Now I see people with 2007 PDs eligible to file. Can't complain. Take it as it comes and proceed. You are not a player in these. You are only a spectator.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

The very very first, if not only reason for both party to work on this issue is to gain their vote. What do you gain by giving them goodies but does not offer them a chance to appreciate you back (vote)?
I don�t know what is so hard about this deadlock. Don�t they know that if:
1. Illegals are given temporary visas for them to return after a number of years, no-body would come forward. The illegals would see this as shooting themselves in the foot. They would prefer to remain in the dark and live here permanently. Purpose defeated.
2. A tough enforcement only bill is passed, with the hope that there would be attrition after a while: How long would it take for all 12 million illegals to finally leave? 1 million per year? 500K per year? 24 years? Yeah right! Ok assuming they leave at a rate of 500K per year (which I know wouldn�t happen) what would be the rate of inflow of more illegals?? What would be the balance of illegals after say 10 years? Think about it.
3. Give them a path to citizenship. Well they are here anyways but this idea might jeopardize the bill.
So my proposal is: Since �a path to citizenship� is the major road block to this bill, make a law that gives the Illegals an opportunity for GC but include in the law that �Anybody that ever comes into the country illegally CAN NOT become a citizen�. i.e they can get a green card but they can never be eligible for citizenship. US or in Timbaktu. So IMO, the biggest advantage of GC is getting back the money
you've been paying as part of Social security taxes.
And for those of you who think Social Security will run bankrupt....that will never happen,
or the US president will lose his job. The Govt will always fund SS even if it means
increasing a ballooning deficit.
Not only do you get SS but you also have to pay taxes to US irrespective of where you live for the rest of your life. So on a net it is still arguable depending on your long term residency plan. And my friend, Social Security is going away in the next 10 years. You think the USA can maintain this kind of a deficit for ever with people not willing to see an increase in taxes.

Can you tell me when NVC mailed the packet to you (is there a post mark date) ?
I have been waiting for my packet since April 25th and still nothing. NVC told me that they mailed it on the 25th.

My post has no relevance to this thread and my apologies for that.
I have been trying to find the latest CIR thread by Pappu (where he talks about it being introduced) from last week (or the week before ?!) but was unable to locate it.
Could someone please point me to that ? No matter how bleak the chances are for it's passing, I would still like to follow it since it's our only hope at this moment.

Possibly not. But it has to reach USCIS and I was thinking of getting through the liason process of the senators / congressmen.
If IV can take up this effort, then there is a channel that we can get through. But I dont think it is going to happen, because of the infights. Even if USCIS does'nt react, we can use this process to challenge the intrepretation and show them the mess that they have created. May be that will help

EB2 group should unite and lobby hard to ensure that the current equation EB1 > EB2 > EB3 is not disturbed. After all, everyone is selfish when the pins are down. EB2 friends, can we be proactive and protect our interests before it is too late? Nothing to get emotional about

I have been looking at number and the IV forum and there are very handful number of cases with December 2005 that have been touched.
I think we need to cheer up and be optimistic in addition to creating SR, senator route and infopass. I have a feeling that all the October, Nov and December cases might be in a single lump of files and we will get it in the next week or so.

If you are saying that EB3 would move from 2001 to 2004 this year, then that is what BharatPremi and I were saying. We should be OK with 3 years movement for EB3.
And, guys don't jump on me, if we accept that 3-4 years for GC is acceptable (though I agree that GC in 6 months would be the vision, dream...), then guys who have filed in 2004 should be patient till 2008 and guys who filed in 2006 should wait till 2010.
The only guys who should worry is those with PDs 2001 and 2002. Again, most of them got cleared in Jun, July this year except those who are stuck in name check and LC in BEC.
