    is your lawyer saying? You are paying them to answers these kind of questions.

    I have a phone call set with my lawyer. I am going to listen to his recommendation. However knowing how others are handling similar situation will help me in taking decision.

    Uma001, My labor mentions Bachelors plus 5 yrs of exp., I am not Masters. 60 months exp. is written on my Labor and so thats what the RFE is about.

    Any thoughts ?

    So that means you have 4 more years of additional exp before PERM filing. But USCIS did not ask for those letters.

    I just want to know why people think like that. Whoever I talk to thinks that after getting EAD everything is good and greencard is not that important. Is that true.

    There is a big difference in EAD and GC. EAD is always temporary in nature. You will be always dependend on USCIS . Many companies do not entertain v.s GC EAD e.g. State Government(s), defence companies and etc..

    You cannot use EAD to return back to this country, you have to use AP.

    A biggest thing i.e. fear. The fear would be always in your mind, if something goes wrong for your I-485 and you will be out of status except MTR.

    Call the office and tell them you did not get the answer to the questions and issues you raised and want to speak with the person who handles immigration policy matters. Follow up with this person. Letters go to junior staff and issues get lost unless you contact the senior staffers and seek appointment from them.

    I have 4 years degree with Masters. However, if you made through EB3 you should be able to get through EB2. Nevertheless, it is worth a try as gains are large. I understand there is a risk (no risk no gain).
    I have just started the process and my labor is in process. I am filing with my current employer who filed my EB3 case. Green card is for future job so they are taking me for higher position say manger. My lawyer is making sure there is some kind of sync up with Eb3 labor and H1B application. They should be supporting the present labor application.
    Your employer need to be supportive and should be willing to work with you that help a lot. They have added some managerial stuff and kind of technical lead. I have not used my experience with present employer.
    To best of my knowledge, there is no impact to eb3 case.

    The issue is that my company lawyer said that there will be a need for a visa stamping done for the extension because of the Last action rule. The murthy forum reference is something I dug up via google.

    Because the extension will be for a future date (March 1). Current visa stamp is till Feb 28, 2007. So if the officer gives a new I-94 with Feb 28, 2007 as the validity date, the attorneys claim that it will invalidate the approved extension due to a "Last Action Rule".

    It is hard to trust these corporate lawyers.

    Thanks for your suggestions.I checked with my Lawyer about the job title .she says job responsibilities matter in this case.Job title is for any company's internal designation it seems.

    I don't know exactly what AC 21 regulations are.I just want to follow any best Lawyer's advice in this matter.

    The term Technical Recruiter is very generic This job can be done by any person who doesn't have any technical background .But If a person with good technical skills will bring more value to the company.

    The area which i'm focussing is basically IT Sales.Company which is offering me this Technical recruiter position is impressed with my technical back ground and hiring me.They are actually looking for some one who is very senior and having good amount of experience with Technical back ground specially ERP Packages.The role is also not confined to just recruiting but meeting the clients and bidding the tech support and new impementations for the company.

    I personally see lot of career growth in this path.But unfortunately there is nothing one can do in this matter.

    I am little more confused now: even if we ignore the title for a moment, none of the duties you have described:
    - hiring software engineers
    - bidding on tech support and new implementations
    - meeting clients to bring in new business
    seem to be inline with that of a software engineer...

    I would be uncomfortable about this, but if you believe your lawyer can prove the job duties are substantially similar to that a software engineer in case of an RFE (again going by the O*NET codes as thats what USCIS looks at) you can take a chance.
    Atleast get a second opinion from another, good attorney before you decide anything. The market is in general good, and there are lots of jobs around, dont lose years of your waiting time because of one lawyers interpretation of the rules just for the sake of this position.

    My I 140 was approved a year back .. I went to chennai consulate 1/23 for stamping .. V.O officer asked me your perment residencey is filed or not?I said yes.He said I will get the visa in few days... He not even bother to look at me W2 or any documents:)

    Dont you get it. berkleybee was a great asset to IV as a core team. Atleast I felt so. Her/his analysis and post on IV were great. All of a sudden BB disappeared from IV.

    So I figured BB and IV did not fell out. I for one have great regard for BB and will any day trust his/her analysis.

    IMHO IV would have been much stronger with Raz4u , BB etc.
    They just vanished.
    I was not around when berekeleybee was here. I joined this forum recently because my old lawyer kept telling me the dates will move and I was not aware of the seriousness. anyway, looks like what this person berekelybee says is true, and that is not nice news.

    You can enquire with the Canadian authorities if they will collect it and pass it on the US post. If not you can take a U turn once you enter Canada and go back to US to give them the I-94 and take a U turn again to re-enter Canada.

    Hold on a second. Taking U-turns on the willy-nilly just like that is not something you can do at the land border. Once he is in Canada, I think he will need valid visa or advanced parole (I dont think he has AP since he hasnt applied for GC at all). So he cant just "Make a U-turn" and if he does, US wont allow him to enter without a visa/AP.

    Others, who have used Auto-matic visa revalidation based on I-797 and without current visa stamp, please weigh in on this issue.

    I think you should contact a good lawyer because I dont think USCIS customer service is trained to answer this question.
